41. Ordination of the Federal Minister for Economic Affairs, Family and Youth to determine the raw material surcharges for biogas-based plants for the calendar year 2009 (Raw Material Supplement-Regulation 2009)

On the basis of Section 11a (6) of the Ecoelectricity Act (ÖSG), BGBl. No 149/2002, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I No 104/2009, shall be ordered:

§ 1. For the calendar year 2009, pursuant to section 11a (6) to 9 ÖSG (ÖSG), for plants which generate electrical energy on the basis of biogas from renewable raw materials, and for those on the 20. § 2. (1) The appropriations required for the granting of these surcharges shall be set out in respect of the additional annual support volume (§ 21a) of 2009.

(2) The existing additional support volume to cover the funding required for the raw material surcharge is not sufficient to make an aliquot cut by the Eco-downstream Unit.

§ 3. (1) Applications for payment of the surcharges shall be submitted within three months of the entry into force of the Regulation to the Eco-current winding station.

(2) In accordance with Section 11a (8) in conjunction with Section 3 of the ÖSG, operators of green electricity plants based on biogas have to submit a raw material balance when submitting the application in accordance with paragraph 1 of the Eco-current winding station.

§ 4. On the occasion of the payment of the raw material surcharges pursuant to Section 11a (7) of the Austrian Austrian Development Fund (ÖSG), the "Ökodownstream winding station" has to draw the attention of the plant operators according to Article 11a (9) of the Austrian ÖSG that the raw material prices of the The actual amount of the transfer is fulfilled and an aliquot part of the received raw material surcharge will be reclaimed.
