56. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the setting of conditions for quality wines typical of the region with origin profiles for the wine-growing region of Mittelburgenland (DAC Regulation) "Mittelburgenland")

Due to § 34 (1) of the Wine Act 2009, BGBl. I n ° 111, shall be assigned:

§ 1. Wine may be placed on the market under the name "DAC" or "Districtus Austriae Controllatus" in connection with the indication of the wine-growing region of Mittelburgenland, if it meets the requirements for quality wine of specified regions and the following Requirements are:

1.

The wine must have been prepared exclusively from grapes harvested in the wine-growing region of Mittelburgenland.

2.

The wine must have been prepared from the quality wine grape variety "Blaufränkisch" (Blaufränkisch); a label-harmless incision must be tolerated.

3.

Any indication of the brand name, the vine variety or a smaller geographical unit than the wine-growing region must be made in such a way that it is subordinated to the indication of the wine-growing region of Mittelburgenland as far as possible.

4.

The indication of a further traffic description shall be prohibited (in particular, traffic names such as "quality wine", "cabinet" or "late harvest"). The designations "DAC" or "Districtus Austriae Controllatus" shall be indicated on the label in direct relation to the specified region of the country of central Burgenland and in characters not exceeding half the size of the indication for the indication "Mittelburgenland" used.

5.

The indication of the wine-growing region, the specified region "Burgenland" and of large-scale installations is inadmissible. As small geographical units, only one municipality and one in the case of wines according to point 10 lit. b (mandatory) and c a Riede are indicated.

6.

The wine may only be delivered in glass bottles to the consumer, unless it is to be immediately enjoyed at the place of administration. The nominal volumes of 1.0 l and 2.0 l are not allowed when the glass is delivered in glass bottles.

7.

The indication of the harvest year is compulsory.

8.

The amount of the appenoic acid must be less than or equal to 0.5 g/litre.

9.

The content of unfermented sugar shall not exceed 2.5 g per litre.

10.

"Mittelburgenland DAC" can be placed on the market under one of the following three categories:

a)

"Mittelburgenland DAC" ("Mittelburgenland DAC") "Classic", with the additional name "Classic":

-

Taste: typical, fruity, spicy;

-

Colour: covered strong red;

-

Odour: typical varietal bukett;

-

Extension: in the traditional large oak barrel (no to barely noticeable wooden clay) or steel tank;

-

the actual alcoholic strength by volume shall be indicated at 12.5% or 13.0% vol. on the label.

-

The wine must not be delivered to the consumer before 1 August of the year following the harvest. A request to obtain the state test number for wine with the sales designation "Mittelburgenland DAC" may be made from 1 May of the year following the harvest.

b)

"Mittelburgenland DAC" under compulsory indication of a Riede:

-

Taste: typical, fruity, spicy, strong;

-

Extension: in traditional large oak barrels or in used barriques (no to light wooden shade);

-

the actual alcoholic strength by volume shall be indicated at 13.0% or 13.5% vol. on the label.

-

The wine must not be before the 1. They will be delivered to the consumer in October of the year following the harvest. A request to obtain the state test number for wine with the sales designation "Mittelburgenland DAC" may be made from 1 July of the year following the harvest.

c)

"Mittelburgenland DAC" under compulsory indication of the name "reserve":

-

Taste: typical, fruity, spicy, strong;

-

Extension: in traditional large oak barrels or in barriques (noticeable to dominating wooden clay);

-

the actual alcoholic strength by volume shall be indicated by at least 13.0% vol. on the label.

-

The wine must not be delivered to the consumer before 1 March of the year following the harvest. A request to obtain the state test number for wine with the sales designation "Mittelburgenland DAC" may be made from 1. Jänner of the year after the harvest will be placed next year.

The state test number issued for a wine with the name "Mittelburgenland DAC" may only be used for the placing on the market of the wine tested under the name "Mittelburgenland DAC".

In the Federal Office for Viticulture in Eisenstadt, the Federal Office for Viticulture (Bundesamt für Weinbau) is responsible for the tasting of wines with the transport designation "Mittelburgenland DAC" in the context of the procedure for awarding the state test number for wine.

§ 2. Wine with the sales designation "Mittelburgenland DAC" is to be produced in the region of Mittelburgenland. A production outside the area may only be made with the permission of the Federal Office for Viticulture after consultation of the Regional Wine Committee Burgenland. Such authorisation may be granted, in particular, if the producer ' s vineyards are situated in the central Burgenland and the wine is produced on the premises of the producer outside the central Burgenland or if: Land contracts exist between a manufacturer with an establishment outside the central Burgenland and owners of vineyards in the central Burgenland region. The place of provenance, land number (s) and area (s) shall be shown on the invoices, delivery notes and transport documents to be paid.

§ 3. Wine with the sales designation "Mittelburgenland DAC" may only be transported outside the region of the Mittelburgenland region with a state test number.

§ 4. Anyone intending to submit an application for a state test number for a wine with the sales designation "Mittelburgenland DAC" has to inform the regional wine committee Burgenland in writing (also e-mail or fax).

§ 5. Wine bearing the name "Mittelburgenland DAC" may only be given if the bottle is provided with a specific capsule, the appearance of which the regional wine committee of Burgenland defines and is widely used in the transport Publication published. This capsule can only be obtained with a corresponding authorization of the regional wine committee Burgenland. This Committee shall determine the amount of the amount to be raised by the Committee in the context of the issuing of authorisation and the publication of the amount of the amount in a publication which is suitable for this purpose and is widely used in the transport travel. . The funds thus acquired are to be used, after deduction of administrative costs, for the implementation of measures to improve the knowledge and transparency of wine with the transport designation "Mittelburgenland DAC".

§ 6. This Regulation shall apply to wine from the 2005 vintage. § 1 Z 5, first sentence, however, only for wine from the 2007 vintage; quality wine up to and including the vintage 2006 may continue to be placed on the market subject to compliance with the previous legislation on designation of wine.
