57. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the setting of conditions for quality wines typical of the region with origin profiles for the Eisenberg wine-growing region (DAC Regulation "Eisenberg")

On the basis of § 34 of the Wine Act 2009, BGBl. I n ° 111, shall be assigned:

§ 1. The political districts of Oberwart, Güssing and Jennersdorf form the Eisenberg wine-growing region.

§ 2. Wine may be placed on the market under the name "DAC" or "Districtus Austriae Controllatus" in connection with the name "Eisenberg" if it meets the requirements for quality wine and the following requirements:

The wine must have been prepared exclusively from grapes harvested in the Eisenberg wine-growing region.

2.

The wine must have been prepared exclusively from the quality wine grape variety "Blaufränkisch"; any pruning with any other vine variety is inadmissible.

3.

The indication of a further traffic description shall be prohibited (in particular, traffic names such as "quality wine", "cabinet" or "late harvest"). The names "DAC" or "Districtus Austriae Controllatus" as well as the name "Eisenberg" are to be found on the front label. The designation "Eisenberg" is to be preceded by the sales designations "DAC" or "Districtus Austriae Controllatus". The characters for "DAC" or "Districtus Austriae Controllatus" may not be more than half as large as the characters used for "Eisenberg". For all further information-except for marks or fantasy names pointing to the bottling operation-there are smaller characters both on the front label and on the back label than for the indication of origin "Eisenberg". .

The wine may only be bottled in glass bottles with a nominal volume of 0.375 l, 0.75 l or a multiple of the same.

5.

The indication of the harvest year is compulsory.

6.

The content of unfermented sugar may not exceed 4 g/l.

7.

"Eisenberg DAC" can be placed on the market under one of the following two categories:

a)

"Eisenberg DAC":

-

Taste: typical, fruity, mineral-spicy;

-

Colour: covered strong red;

-

Odour: typical, refreshing sortenbukett;

-

Extension: no up to barely noticeable wooden sound;

-

the actual alcoholic strength by volume shall be indicated at 12.5% or 13.0% vol. on the label;

-

Closure: natural cork or screw cap;

-

the wine may not be delivered to the consumer before 1 September of the year following the harvest; a request for obtaining the state test number for wine with the name "Eisenberg DAC" shall be allowed from 1 June of the year on the harvest the following year.

b)

"Eisenberg DAC" under compulsory indication of the term "reserve":

-

Taste: typical, fruity, mineral-spicy, strong, with potential;

-

Extension: in the traditional large wooden barrel or in the barrique;

-

the actual alcoholic strength by volume shall be indicated by at least 13.0% vol. on the label;

-

the wine may not be delivered to the consumer before 1 March of the second year following the harvest; an application for obtaining the state test number for wine with the name "Eisenberg DAC Reserve" may be made from 1. Jänner of the year following the harvest will be placed next year;

-

Closure: exclusively natural cork.

In the context of the award of the state test number, the wine corresponds in sensory terms, if at least five of the six costers agree that it is marketable under the name "Eisenberg DAC". In the case of official samples and counter-samples, the general provisions of the Costing Regulation shall apply. In the case of a negative assessment of the wine as "Eisenberg DAC" with a score of 4: 2, the sample of another wine tasting commission is to be presented again. In order to take advantage of the additional costs associated with the execution, the applicant has to pay a fee in accordance with the tariff regulation in accordance with the tariff regulation for the grant of the state test number. In the Federal Office for Viticulture in Eisenstadt, the Federal Office for Viticulture shall be responsible for the tasting of the Commission within the framework of the procedure for the award of the state test number. All the co-esters of the official cost commission must have been trained by the Regional Wine Committee of Burgenland with regard to the assessment of the typical taste profile of "Eisenberg DAC".

§ 3. Wine with the name "Eisenberg DAC" is to be produced and bottled in the wine-growing region Eisenberg. A production and bottling outside the wine-growing area may only be carried out with the permission of the Federal Office for Viticulture in Eisenstadt, after hearing the Regional Wine Committee Burgenland. Such authorisation may be granted, in particular, if the vineyard of the producer is situated in the vineyard Eisenberg. The place of provenance, land number (s) and area (s) shall be shown on invoices, delivery notes and transport documents. Furthermore, the Regional Wine Committee of Burgenland is to be presented as proof of the management of vineyards in the Eisenberg wine-growing region, or land-based extracts.

§ 4. Anyone who intends to obtain an application for a state test number for a wine called "Eisenberg DAC" has written this year in writing to the administrative organisation of the Association of Weinidylle Südburgenland (also e-mail or Fax). This will forward the applications to the regional wine committee Burgenland.

§ 5. Wine called "Eisenberg DAC" may only be given if the bottle is provided with a specific capsule, the appearance of which is to be determined by the Regional Wine Committee of Burgenland. This capsule can only be obtained with a corresponding authorization of the Regional Wine Committee Burgenland. The Burgenland Regional Wine Committee shall set the amount of the amount and shall raise the amount. The Federal Office of Viticulture in Eisenstadt has the necessary data to be provided to the regional wine committee of Burgenland. The funds thus acquired are to be used, after deduction of administrative costs, for the implementation of measures to improve the knowledge of wine called "Eisenberg DAC", as well as marketing and PR measures for this wine.

§ 6. This regulation applies to "Eisenberg DAC" from the year 2009 and for "Eisenberg DAC Reserve" from the year 2008.
