109. Regulation of the Broadcasting and Telekom Regulatory GmbH, with which the regulation of the broadcasting and telecoms regulation GmbH, with the provisions for communication parameters, charges and value-added services are established (communication parameters-, pay- and the value-added services regulation 2009-KEM-V 2009).

On the basis of § § 24 (1) and (2) and 63 of the Federal Act, which enacted a telecommunications law (Telecommunications Act 2003-TKG 2003), BGBl. I n ° 70/2003, as amended by the BGBl version. I n ° 65/2009, shall be:

The regulation of broadcasting and telecom regulation GmbH, which lays down rules for communication parameters, charges and value-added services (communication parameter, remuneration and value-added services regulation 2009-KEM-V 2009), BGBl. II No 212/2009, as amended by the BGBl agreement. II No 265/2009, shall be amended as follows:

1. In the table of contents according to § 7 the word order " § 7a. International Call Numbers Universal International Shared Cost Numbers-UISCN " inserted.

2. In accordance with § 7, the following § 7a with headline is inserted:

" International Call Numbers
Universal International Shared Cost Numbers-UISCN

§ 7a. For services under an international telephone number for Universal International Shared Cost Numbers with the country code number 808, the participant is to be charged a fee of EUR 0.20 per minute. "

3. § 21 (2) reads:

" (2) The occupancy of public short-call numbers for emergency call services with tape messages or similar automatic systems, as well as a behavior that does not allow or initiate any assistance that is adequate to the emergency call situation, is not permitted. With the exception of this, the public short call number for emergency services 141, behind the audio tape messages or similar automatic systems may be switched if the service provider ensures that:

1.

information on the availability of the service is easily accessible to the public,

2.

at the times when the service is not reachable, the call ends the next office hours, and

3.

another reachable emergency call number. "

4. In § 31 the following Z 4 and 5 are added after Z 3:

" 4.

116 006 Advisory service for victims of crime,

5.

116 117 Stand-by for medical assistance in non-life-threatening situations. "

5. In § 32, the following Z 4 and 5 are added after Z 3:

" 4.

The service, which is addressed by telephone number 116 006, gives emotional support to victims of crime, informs them about their rights and the legal route, as well as other relevant organisations. In particular, they will receive information on the next police department and information on the law enforcement procedures, as well as on issues of damages and insurance. The service will also provide assistance in finding other bodies that can provide assistance to victims of crime.

The service addressed by telephone number 116 117 forwards the call to the appropriate medical service in urgent but non-life-threatening cases, above all outside the normal service times, on weekends and on holidays. It connects the caller with the trained and supported staff of the call center or directly with a qualified practical or clinical doctor. "

6. § 33 with headline reads:

" Allocation Requirements

§ 33. (1) The number 116 000, 116 111 and 116 123 eligible for application are service providers who fulfil the following conditions:

1.

At least three years of experience in the professional telephone service of people in problem situations, especially in the family environment, as well as in the cooperation with police departments. In the case of call numbers 116 000 and 116 111, the focus of the previous work has to be in the work of children and young people,

2.

Membership in at least one international organisation or association for the protection of children and young people, in the field of pastoral care or personal life assistance, and

3.

Proof of a corresponding amount of capital, so that provision of the service in the form envisaged by the applicant is in any case secured for the next three years.

(2) eligible for the 116 006 telephone number are service providers who meet the following requirements:

1.

At least three years of experience in professional telephone consulting and support for victims of crime, as well as relevant experience with Austrian and international victim support and victim protection organisations and cooperation with law enforcement agencies, psychological services, and all the authorities and institutions involved in victims ' concerns,

2.

Membership of at least one international organization or association of victim support facilities to assist victims of violence and

3.

Proof of a corresponding amount of capital, so that provision of the service in the form envisaged by the applicant is in any case secured for the next three years.

(3) The number 116 117 is entitled to apply for service providers who fulfil the following requirements:

1.

At least three years of experience in the professional telephone service of people in problem situations with medical background,

2.

Presentation of a concept which shows the fulfilment of the criteria laid down in § 32 Z 5, in particular as the criterion of availability of a qualified practical or clinical physician as well as the supply of the entire Federal territory will be met,

3.

Proof of a corresponding capital allocation, so that provision of the service in the form envisaged by the applicant is in any case secured for the next three years. "

7. In § 34, the word order shall be "call numbers 116 000, 116 111 and 116 123" through the phrase "for a phone number in area 116" replaced.

8. § 35 (2) reads:

" (2) In the event of the determination of paragraph 1 Z 3, the number 116 111, 116 123, 116 006 and 116 117 is not an obligation of a daily, 24-hour operation. However, if the service is not permanently accessible, the service provider must ensure that information on the availability of the service is publicly accessible and at the times when the service is not available to the caller, the next office hours. "

9. In § 117 (1), after the word order "in the areas 810, 820, 821, 900, 901, 930, 931, 939 and in the access identification number 118" the phrase "as well as in the area for Universal International Shared Cost Numbers pursuant to § 7a" inserted.

11. In § 128, the following paragraph 4 is added:

" (4) The amendment of the table of contents as well as § § 7a, 21 (2), 31 to 35, 117 (1) and 118 (6) in the version BGBl. II No 109/2010 will enter into force on 14 April 2010. '
