122. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the statistics on the structure of agricultural holdings and on agricultural production methods in 2010

On the basis of § § 4 to 11 and § 32 paragraph 4 Z 1 of the Federal Statistics Act 2000, BGBl. I No 163/1999, as last amended by Federal Law BGBl. No 125/2009 will be in agreement with the Federal Chancellor, with regard to § 13 in agreement with the Federal Minister of Finance and with regard to § 12 on the basis of § 3 of the LFBIS Act, BGBl. No 448/1980, as last amended by Federal Law BGBl. No 505/1994,

Arrangement for the compilation of statistics

§ 1. The Bundesanstalt Statistik Österreich (Bundesanstalt Statistik Österreich) has been responsible for the fulfilment of Austria's obligations under Regulation (EC) No 1166/2008 on farm structure surveys and the survey on agricultural production methods, as well as on the repeal of Council Regulation (EEC) No 571/88, OJ L 57, 28.1.88. No. 14., to carry out surveys in accordance with the provisions of this Regulation and to compile statistics on the basis of the data collected by 31 March 2013.

Statistical units, survey mass

§ 2. (1) Statistical units shall be agricultural holdings within the meaning of Article 2 lit. (a) of Regulation (EC) No 1166/2008, which shall reach one of the following thresholds:

1.

a hectare of agricultural land;

2.

25 working wine-growing area;

3.

15 Ar intensively used mob surface or 10 Ar intensively used berry fruit, strawberry, vegetable, hops, flowers or ornamental plants or reb, forst or nursery surface;

4.

an Ar predominantly commercially managed greenhouses (high-glass, foil tunnel, glass);

5.

Livestock farming with three bovine animals, five pigs, ten sheep or ten goats or at least 100 poultry of all kinds.

(2) Statistical units are also forestry holdings with at least three hectares of forest area.

Reference periods, reference periods

§ 3. (1) The following dates shall apply:

1.

1 April 2010 with regard to the characteristics referred to in Annex I Point 3.

2.

15 May 2010 as regards the characteristics referred to in Annex I Point 1.3.1. and Annex II lit. A, point 2, 3. and 5. to 7. and

3.

31 October 2010 with regard to all other survey characteristics.

(2) Reference periods shall apply:

1.

1 November 2009 to 31. October 2010 as regards the characteristics referred to in Annex I Item 1.3.2., 2., 5., 6. and 8., with the exception of point 8.3. and 8.8.1.,

2.

1 January 2008 to 31 December 2010 with regard to the characteristics referred to in Annex I Point 7., 8.3. and 8.8.1.,

3.

the calendar year 2009 with regard to the characteristics referred to in Annex II Point 8. and

4.

the calendar year 2010 in respect of the characteristics referred to in Annex II Item 1., 4., 9. and 10, as regards the characteristics referred to in Annex I Point 3., if there is no animal of the animal species held during a holding operation on the cut-off date of 1 April 2010.

Survey type, survey characteristics

§ 4. (1) The survey characteristics according to Annex I and Annex II are to be collected in the manner of the full survey as follows:

1.

the characteristics according to Annex I Point 1.1. and 2.9.1. by drawing up statistics,

2.

the characteristics according to Annex I Points 1.3., 2.1. to 2.9., 3.2. and 7. by drawing up administrative data from agricultural market Austria,

3.

the characteristics according to Annex I Point 3.1., 3.3. to 3.8. by drawing up administrative data of the Federal Ministry of Health and Health

4.

the other characteristics by questioning the statistical units.

(2) Insofar as the collection of statistics or administrative data cannot be carried out in individual cases, the survey shall be carried out by survey of the statistical units.

Implementation of the survey

§ 5. For the survey in accordance with § 4 (2), the Bundesanstalt has to compile uniform survey documents (electronic questionnaires and explanations) and to make these available to the respondents.

Obligation to provide information

§ 6. (1) According to § 9 of the Federal Statistics Act 2000, there is a duty to provide information in the surveys.

(2) For the purpose of providing information, those natural and legal persons as well as registered partnerships are obliged to operate a statistical unit in its own name.

(3) In order to provide information in the form of a reasoned empty message, those natural and legal persons as well as registered partnerships are also required to operate either an establishment on which the conditions laid down in accordance with § 2 shall not apply or which have left the establishment.

Obligation to provide information to the parties responsible for providing information

§ 7. The parties responsible for providing information shall make their data timely, complete and to the best of their knowledge. The information may be provided at any time within a period to be determined by the municipality directly by providing information to the congregation or by electronically entered into the questionnaire within four weeks by the person responsible for providing the information. Participation obligations of the municipalities

§ 8. (1) The municipalities in whose sphere of action a statistical unit is situated shall be obliged to participate in the survey referred to in paragraph 2.

(2) In the case of direct exchange of information with the municipality, the municipalities shall participate in the survey by means of electronic counting bodies used by the mayor to electronically survey the respondents in the questionnaire. Enter. The electronic transmission of the completed questionnaires to the Bundesanstalt is to be completed by 31 March 2011.

(3) The obligation to participate shall also extend to the conduct of the survey of the respondents who have been notified in accordance with § 9.

Other co-action obligations

§ 9. Former managers (farmers) of statistical units are obliged to participate in the determination of the new person responsible for providing information in accordance with § 6 para. 2 by the Federal Institute or by the municipality.

Information on disclosure requirements

§ 10. The Federal Institute has to provide information on the legal consequences according to § 66 of the Federal Statistics Act 2000 in the case of refusal of information and in the case of information which is knowingly incomplete or not to the best of its knowledge.

Duty of participation of the holders of administrative data

§ 11. At the request of the Bundesanstalt, the data shall be transmitted free of charge and to electronic data carriers within four weeks of the Federal Institute.

Data transmission to the LFBIS

§ 12. The Federal Institute has to submit the individual operating data determined in accordance with § 4 to the Federal Minister for Agriculture, Forestry, Environment and Water Management for inclusion in the agricultural and forestry operating information system (LFBIS).

Cost severance and cost replacement

§ 13. (1) A cost compensation for participation in the survey of EUR 5.70 per statistical unit raised will be granted to the municipalities.

(2) The Federal Minister for Agriculture, Forestry, the Environment and Water Management provides the Federal Institute with a cost compensation in the first quarter of 2011 in accordance with Section 32 (4) Z 1 of the Federal Statistics Act of 820,000, -- Euro.

Override

§ 14. The Regulation shall expire on 31 December 2013.
