145. Regulation of the Federal Minister of Transport, Innovation and Technology, which changes the ÖAeC jurisdiction regulation

On the basis of § 140b of the Aviation Act (LFG), BGBl. N ° 253/1957, as last amended by the Federal Law BGBl. I n ° 83/2008 and the Federal Ministries of the Federal Ministries of Law 2009, BGBl. I No 3, shall be assigned:

The ÖAeC Responsibility Regulation, BGBl. No 394/1994, as last amended by the BGBl Regulation. II No 207/2006, shall be amended as follows:

1. In § 1 (1), the Z 12 to 21 shall be replaced by the following Z 12 to 20:

" 12.		Assessment of airworthiness for motorized slopes and paragliders (§ 68 of the Civil Aviation Vehicle and Aeronautical Equipment Ordinance 2010-ZLLV 2010) and the exhibition of the noise certificate for motorized slopes and paragliders (§ 4 of the German Civil Aviation Vehicle and Paraglider) Civil Aircraft Noise Admissibility Regulation 2005-ZLZV 2005),
13.		Verification of motorised slopes and paragliders and setting of shorter intervals for periodic inspection (§ 69 of the ZLLV 2010),
14.		Recognition of foreign confirmations of the permitted use in the flight, revocation of such recognition (§ § 18 para. 2 and 19 para. 2 LFG) as well as authorization of the extension of the time limit pursuant to § 15 para. 4 LFG for motorized hangings and paragliders,
15.		Determination of the lack of conditions for use in the flight (§ 70 ZLLV 2010) for motorized slopes and paragliders,
16.		Inspection of gliders (§ 40 para. 1 Z 1, 2, 3, 4, 5 and 7 ZLLV 2010),
17.		Verification of ultra-light aircraft (§ 40 para. 1 Z 1, 2, 3, 4, 5 and 7 ZLLV 2010),
18.		Periodic review (Section 40 (1) Z 4 of the ZLLV 2010) of motor seaters not used within the scope of air carriers (§ 102 para. 2 LFG),
19.		Approval of maintenance and repair services for motorized slopes and paragliders (§ § 72 of the ZLLV 2010) and their maintenance manuals and
20.		Publication of airworthiness notices, pre-writing and presentation of airworthiness instructions in accordance with § 76 of the ZLLV 2010 and performance of the tasks as supervisory authority in accordance with § 79 of the ZLLV 2010 for parachutes, hangings and paragliders as well as motorised slopes and paragliders "

2. § 1 (2) and (3) reads:

" (2) The transfer in accordance with paragraphs 1, Z 13, 16, 17 and 18 shall be subject to the provisions of Section 40 (4) and (4) respectively. § 69 (2) of the ZLLV 2010 shall not be affected.

(3) A copy of the review certificates and, where appropriate, the certificate of application after carrying out the inspections in accordance with paragraph 1 Z 16 to 18 shall be submitted to the Austro Control GmbH at the latest by the end of the following month. The Austro Control GmbH must be notified without delay of any detected defects which have a negative effect on the airworthiness and which have not been remedied by the aircraft owner in due time. "

3. § 1 (4) shall be deleted.

4. In § 2 (1) the expression "Aeronautical Equipment-Regulation 2005" by the expression "Aeronautical Equipment-Regulation 2010" replaced.

5. In § 2, the second paragraph of paragraph 2 is deleted and the previous paragraph 3 is replaced by the title para. 2.

6. In § 9, the following paragraph 8 is added:

" (8) § 1 and § 2 in the version of the BGBl Regulation. II No 145/2010 shall enter into force on 25 May 2010. '
