150. Regulation of the Financial Market Supervisory Authority (FMA), which amelaes the operating provisions of the Preliminary Provisions of the Preliminary Assassination Directive

Pursuant to § 39 (3) of the Operating Staff and Self-employment Act-BMSVG, BGBl. No 100/2002, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I n ° 152/2009, is assigned with the approval of the Federal Minister for Finance:

The Ordinance on Occupational Pension Fund-BVQA-V, BGBl. II No 253/2004, as last amended by the BGBl Regulation. II No 134/2008, shall be amended as follows:

1. In § 1 (1), the reference " § 74 of the Banking Act-BWG, BGBl. No. 532/1993, as last amended by the Federal Law BGBl. I No 108/2007 " by reference " § 74 of the Banking Act-BWG in the version of the Federal Law BGBl. I No 152/2009 " replaced.

2. § 2 reads:

" § 2. The quarterly statements have to be included in the operating system of the company's supply of storage products:

1.		Information on own resources within the meaning of Section 23 of the Federal Elections Act in conjunction with § 20 BMSVG in accordance with the outline in the Appendix 1 .
2.		Information within the meaning of Section 30 of the BMSVG on the balance of assets of each investment community, as defined in the Annexes 2 and 3 .
3.		Information within the meaning of section 31 (1) (3a) of the BMSVG in accordance with the outline in the Appendix 7 . "

3. § 3 reads:

" § 3. If an operating pension fund operates the future-care business within the meaning of Section 108h (2) of the EStG, the quarterly statements shall also contain the following:

1.		Information on own resources according to § 108h (2) EStG in conjunction with § 20 BMSVG in accordance with the outline in the Appendix 4 .
2.		Information within the meaning of Section 30 of the BMSVG on the balance of assets of the investment groups established for the future-care business, in accordance with the outline in the Annexes 5 and 6 .
3.		Information within the meaning of section 31 (1) (3a) of the BMSVG in accordance with the outline in the Appendix 8 . "

4. In Section 4 (1), the phrase " in the Annexes 2, 3, 5 and 6 " through the phrase " in the annexes 2, 3, 5, 6, 7 and 8 " replaced.

5. The following paragraph 3 is added to § 5:

" (3) The Regulation as amended by the BGBl Regulation. II No 150/2010 shall be applied for the first time on the quarterly pass of 30 June 2010. "
