275. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management for the determination of the overall coverage rates of household packaging (Household Packaging)
Pursuant to Section 29b (5) of the Waste Management Act 2002 (AWG 2002), Federal Law Gazette (BGBl). I n ° 102/2002, as last amended by Federal Law Gazette (BGBl). I n ° 193/2013, is assigned in agreement with the Federal Minister for Science, Research and Economy:
Target
§ 1. The aim of this Regulation is to implement an extended producer responsibility for household packaging by setting overall coverage rates for the catering sector in accordance with § 13g (1) AWG 2002. The overall coverage rates are to be gradually adjusted to a high level for all collection categories in the next few years.
Definitions
§ 2. For the purposes of this Regulation:

"total mass" means the sum of the mass of packaging of a collection category, which is collected separately through collection and recycling systems for household packaging, the mass of the purchase and the amount of the repayment. |

"Purchase mass" means the mass of packaging of a collection category, which is collected according to the regional design of the separate collection according to plan with mixed municipal waste. |

3. |
"Distraction mass" means the mass of packaging of a collection category, which is recorded and treated together with mixed municipal waste, minus the purchasing mass, and for which a retribution is determined. |

4. |
"total coverage ratio" means the proportion of packaging in a category of collection, in relation to the annual mass for which the collection and recycling systems for household packaging have been carried out by the collection and recovery systems for household packaging. |

5. |
"Marktinputmasse" means the mass of packagings of a collection category identified as part of a collection-side survey which, in a given calendar year in Austria, either collected separately in a household-related collection, or was recorded together with mixed municipal waste. |

6. |
"Layers" means the division of municipalities according to socio-demographic and waste management data. The municipalities are divided into the following strata: |

Reference sizes
§ 3. (1) For the calculation of the retributive masses, the following reference quantities shall be determined for the calendar years 2016 to 2018:

(2) The masses of packaging collected in Austria, together with mixed municipal waste, as defined in paragraph 1 shall be divided according to: Annex 1 to the federal states.
(3) The reference quantities referred to in paragraphs 1 and 2 shall continue to apply after 2018, unless reference quantities for the subsequent calendar years shall be established by a novella of this Regulation.
Total coverage rate
§ 4. (1) For the calendar years 2016 to 2018, the proportion of total quantities of household packaging to be covered by the collection and recycling systems for household packaging per year shall be per class of collection, based on the total number of household packaging materials used in the collection and recycling of household packaging. the annual mass for which the collection and recycling systems for household packaging have been carried out:

(2) The shares referred to in paragraph 1 shall continue to apply after 2018, unless a novella of this Regulation lays down shares for the subsequent calendar years.
(3) The shares referred to in paragraph 1 shall be adjusted accordingly if the total mass of household packaging per category of household for which participation in a collection and recycling system for household packaging is involved in relation to the mass of the market tinkting has been changed by more than 10%.
Calculation Model
§ 5. For the calculation of the respective mass of packages to be deducted, which are recorded together with mixed municipal waste, the calculation model shall be: Annex 2 to use.
Distraction
§ 6. (1) The collection and recovery systems for household packaging shall have the appropriate costs for the collection and handling of the retaliatory masses calculated in accordance with this Regulation, in accordance with their market share per category of collection, to operators of the the collection of mixed municipal waste and the inclusion of corresponding provisions in the contracts pursuant to Section 29b (2) AWG 2002.
(2) In any event, the principles of Annex 2 shall be complied with for the calculation of the masses to be deducted. Where all the necessary waste-economic data are available in a Land in all regions, the calculation model shall be applied in accordance with Annex 2.

§ 7. This Regulation has been adopted in compliance with the provisions of Directive 98 /34/EC laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, OJ L 206, 22.7.1998, p. No. OJ L 204 of 21.07.1998 S 37, as amended by Directive 98 /48/EC, OJ L 204, 21.7.1998, p. No. OJ L 217 of 05.08.1998 S 18, notified (No: 2014 /522/A).
entry into force
§ 8. This Regulation shall enter into force 1. Jänner 2016 in force.
