202. Ordinance of the Federal Minister of Health on the implementation of § § 6 and 9 of the Federal Act on Documentation in the Health Sector (Health Documentation Law Implementing Regulation)

On the basis of § § 6 and 9 of the Federal Act on Documentation in Health Care, BGBl. No 745/1996, as last amended by the Federal Law Gazette (BGBl). I No 179/2004, shall be ordered:

Section 1

General

Scope

§ 1. This regulation applies to the reporting of data from the outpatient sector and to the use of these data in the framework of projects of the Federal Health Agency. Only the institutions, hospitals and service areas covered by these projects have to apply the provisions of this regulation in a binding manner. It shall apply to the reporting and use of data

1.

out of the extramural area by the main association of Austrian social insurance institutions and the statutory social insurance institutions

2.

out of the intramural domain by the carriers of the Fondskrankenanstalten and the Landeshealthfonds.

Definitions

§ 2. For the purposes of this Regulation, the terms shall mean:

1.

"Projects": Model tests within the meaning of the Federal Law on Documentation in the Health Care System or Projects within the meaning of § 459e ASVG.

2.

"extramural area": Abandoned doctors, group practices as well as self-employed outpatient clinics

3.

"intramural area": Ambulances of the Fondskrankenanstalten.

4.

"Fondskrankenanstalten": hospitals which are covered by national health funds and which are covered by projects according to Z 1.

5.

"Social insurance institutions" means all social insurance institutions, including health care institutions, who take part in the projects in accordance with Z 1.

6.

"Hauptverband": Main Association of Austrian Social Insurance Institutions.

7.

"Performance Catalogue": The catalogue of services for the inpatient and outpatient sector, issued by the Federal Ministry of Health.

Section 2

Data messages from the extramural area

Contents of the data messages of the main association

§ 3. (1) The main association has to submit to the Federal Ministry of Health data reports from the extramural area, which have to contain information on the following subject areas:

1.

Data on the recipient (s) (anonymized),

2.

Data on the subject of the service provider/provider,

3.

Basic data on frequency,

4.

Data on outpatient services, and

5.

Data for the diagnoses (optional).

(2) For the reporting of the data to the nominee/nominee/nominee:

1.

In any case, you must report:

a)

Age group at contact time,

b)

Gender,

c)

Citizenship,

d)

Main residence State, and

e)

Main residence-Postal code if it is one/a benefit recipient/
Beneficiaries with an Austrian residence.

2.

In addition, if this information is available, it should be reported:

a)

Main residence-Postal code, unless Z 1 lit. (e)

b)

Main residence-Municipal code number.

(3) The following applies to the reporting of the basic data on the frequency:

1.

In any case, you must report:

a)

SV-carrier number

b)

Specialist area of the service provider/provider

c)

Frequency Base Record Number,

d)

contact date,

e)

Contact time, as soon as the corresponding information is available in the e-card system,

f)

cost carrier, and

g)

Frequency type.

2.

In addition, if this information is available, it should be reported:

a)

Physical presence of the beneficiary/beneficiary,

b)

the type of access,

c)

The hospital number (BA number) of the hospital from which it has been assigned, provided that it is not a self-contained ambulatory,

d)

Field of the service provider/provider, assigned by the

e)

the type of departure,

f)

KA-number of the hospital to which it is assigned, provided that it is not an independent ambulatory, and

g)

Subject area of the service provider/provider to which the assignment is assigned.

(4) For the reporting of the data relating to the outpatient services:

1.

In any case, you must report:

a)

Ambulant performance code,

b)

Outpatient performance-number, and

c)

Treatment date.

2.

In addition, if this information is available, it should be reported:

a)

treatment time, and

b)

Outpatient performance-accounting relevance.

(5) If data on diagnoses are reported in accordance with paragraph 1, the following shall apply:

1.

In any case, you must report:

a)

Diagnostic code and

b)

Diagnostic type.

2.

In addition, if this information is systematically collected, it is necessary to report the diagnosis type.

Contents of the data reports of the social insurance institutions

§ 4. The social insurance institutions have to provide the main association with the data necessary for the reporting of the main association in accordance with § 3 for the documentation in the extramural area.

Flows

§ 5. (1) The social security institutions shall have the data reviewed and, where appropriate, corrected by them in accordance with § 4 quarterly for the respective second quarter by 31 July and 31 July respectively. October of the current year as well as up to the 31. Jänner and 30 April of the following year shall be made available to the main association. Where:

Data for a quarter not included in the corresponding quarterly report shall be included in the quarterly report for the following quarter.

The Federal Ministry of Health and the Main Association shall be informed of data to be deleted at a later date, indicating the information required for the unambiguous allocation of these data, up to the date of data reporting for the following quarter. Notify.

(2) The main body shall:

1.

the data on the services provided by the service providers to the service catalogue, and

2.

the data according to § 3 quarterly for the respective second quarter of the year until 31 August and 30 November of the current year as well as up to 28 February and 31 May of the following year to the Federal Ministry of Health , Paragraph 1 (1) (1) to (3) shall apply mutatily.

Section 3

Data messages from the intra-murals

Contents of the data messages of the State Health Fund

§ 6. (1) The State Health Fund has to submit to the Federal Ministry of Health data reports from the intramural area, which have to contain information on the following subject areas:

1.

Data on the recipient (s) (anonymized),

2.

Data on the service provider,

3.

Basic data on frequency,

4.

Data on outpatient services, and

5.

Data for the diagnoses (optional).

(2) For the reporting of the data to the nominee/nominee/nominee:

1.

In any case, you must report:

a)

Age group at contact time,

b)

Gender,

c)

Citizenship,

d)

Main residence State, and

e)

Main residence-Postal code if it is one/a benefit recipient/
Beneficiaries with an Austrian residence.

2.

(5) If data on diagnoses are reported in accordance with paragraph 1, the following shall apply:

1.

a)

Diagnostic code and

b)

Diagnostic Type

Contents of the data messages of the Fondskrankenanstalten

§ 7. The fund hospitals have to submit to the State Health Fund the data necessary for the notification of the State Health Fund according to § 6 for documentation in the intramural area. These data are to be reported for all frequencies.

Flows

§ 8. (1) In accordance with § 7 of the preceding quarter, the fund for the funds of the fund shall be sent to the State Health Fund until 31 May, 31 August and 30 November of the current year, and until 28 February of the following year. , Where:

Section 4

Common rules for the data messages from the extra-and intramural area

Type and structure of data transmission

§ 9. (1) The transmission of the reports by the main association and the State Health Fund to the Federal Ministry of Health and the reports of the fund hospitals to the State Health Fund has been collected on a quarterly basis on a quarterly basis. Provision of data

§ 10. The Federal Ministry of Health has to ensure that the social insurance institutions, the main association and the national health funds of the countries participating in the model tests are able to report these data by two in each case. , to the extent that this is necessary for the performance of the statutory tasks required by the institutions mentioned above, to be able to obtain authorized users of special jobs. In-Force-Tretens and Transitional Provisions

§ 11. (1) This Regulation shall be for the first time in respect of the data reporting on the 1. Quarter 2010.

(2) For the data message to the 1. By way of derogation from the provisions of § 8, the following quarter of 2010 shall apply to the intramural area:

In accordance with § 7 until 31 August 2010, the fund has to send the data to the State Health Fund.
