223. Regulation of the Federal Minister for Economic Affairs, Family and Youth, with which the Electrical Engineering Ordinance 2002 is amended (Electrotechnic Ordinance 2002/A2-ETV 2002/A2)

Pursuant to Sections 2, 3 (3), 3 (3), 3 (11), 4 (2), 5 (2) and 7 (2), (5) and (6) of the Electrical Engineering Act 1992-ETG 1992, Federal Law Gazette (BGBl). No. 106/1993, in the version of the Federal Law BGBl. I n ° 136/2001, as well as Section 181 (2) of the MinroG MinroG Act, BGBl. I n ° 38/1999, as last amended by the Federal Law BGBl. I n ° 115/2009, respectively, in conjunction with the Federal Ministries of the Federal Republic of Germany, 2009, BGBl. I No 3/2009, shall be ordered:

The regulation of the Federal Minister for Economic Affairs and Labour on the safety, normalization and typing of electrical equipment and equipment as well as other installations in the hazard and disturbance range of electrical installations (electrical engineering regulation) 2002-ETV 2002), BGBl. II No 222/2002, as amended by the BGBl Regulation. II No 33/2006, shall be amended as follows:

1. § 2 para. 2 reads:

" (2) The BGBl 2002 Annex I of the ETV. II No 222/2002, as amended by BGBl. II No 33/2006, binding and in the annexes to ETV 1993, BGBl. No 47/1994, on ETV 1996, BGBl. No 105/1996, as amended by BGBl. No 575/1996, and ETV 2002, BGBl. II No 222/2002, as amended by the BGBl Regulation. II No 33/2006, printed SNT rules remain binding, with the exception of those in the Annex II , the liability of which shall be repealed. "

2. In accordance with § 7, the following § 7a is inserted:

" § 7a. For the rental of an apartment according to § 2 paragraph 1 MRG, BGBl. No 520/1981 igF, it must be ensured that the electrical installation of the dwelling corresponds to the provisions of the ETG 1992; in the case of installations which do not have any additional protection in accordance with ÖVE/ÖNORM E 8001-1:2000-03-01, as amended by ÖVE/ÖNORM E 8001-1/A1:2002-04-01, ÖVE/ÖNORM E 8001-1/A2:2003-11-01, ÖVE/ÖNORM E 8001-1/A3:2007-10-01 and ÖVE/ÖNORM E 8001-1/A4: 2009-04-01, is, without prejudice to the existing plant condition, the protection of persons in the electrical system by the Installation of at least one fault current circuit breaker with a nominal fault current of not more than 30 mA, immediately in front of the line protection equipment located in the home. If there is no appropriate documentation available, the tenants can the tenant of the apartment does not assume that the electrical installation meets these requirements. "

3. § 9 reads:

" § 9. (1) It is the SNT regulations ÖVE/ÖNORM EN 60335-1 and their amendments (no. 69 of Annex I) only for joint application with the SNT regulation ÖVE/ÖNORM EN 60335-2-76.

(2) Electrical installations within the scope of the SNT rules listed in Annex III (1) to (10) shall, from the date of entry into force of this Regulation, be planned in accordance with these SNT rules and, at the latest as from 1 January 2011, under these SNT rules. "

4. § 10 reads:

" § 10. (1) Insofar as § 9 is not determined otherwise,

1.

the application of the Annex II of this Regulation, with the exception of Z 1, 22, 23, 28, 30, 31, 32, 57 and 58 specified therein, or five years from the date of entry into force of this Regulation, and

2.

the application of the Annex II of the SNT provisions listed in this Regulation: Z 1, 22, 23, 28, 30, 31, 32, 57 and 58, until 31 December 2010; and

3.

the application of the provisions of Annex II of the ETV 2002, BGBl. II No 222/2002, as amended by the BGBl Regulation. II No 33/2006, listed SNT rules, except for those indicated in Z 23, 27, 28, 39, 40 and 41, and until 29. January 2011 allowed; the application of Z 23, 27, 28, 39, 40 and 41 is not allowed. "

(5) The following paragraph 3 is added to § 12 (2):

" (3) The BGBl Regulation. II No 223/2010 has been complied with in accordance with the provisions of Directive 98 /34/EC, OJ L 327, 28.12.1998 No. OJ L 204, 21.07.1998 p. 37, as amended by Directive 98 /48/EC, OJ L 201, 31.7.1998, p. No. OJ L 217, 05.08.1998 p. 18, notified (notifying number 2010 /139/A). "
