234. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on qualification measures in connection with motor vehicle air-conditioning systems

On the basis of § 2 and § 4 (2) of the fluorinated greenhouse gas law 2009, BGBl. I n ° 103/2009, by the Federal Minister for Agriculture, Forestry, the Environment and Water Management, in agreement with the Federal Minister for Economic Affairs, Family and Youth, is responsible:

§ 1. The purpose of this Regulation is

1.

laying down the procedure for obtaining a training certificate for the qualification of persons designated in Regulation (EC) No 842/2006 on fluorinated greenhouse gases, OJ L 327, 30.12.2006, p. No. 1., in conjunction with Regulation (EC) No 307/2008 laying down the minimum requirements for training programmes and the conditions for the mutual recognition of training certificates for staff in relation to certain fluorinated greenhouse gas-containing air-conditioning systems in certain motor vehicles, OJ L 327, 28. No. OJ L 92 of 03.04.2008 p. 25, and to carry out certain activities in motor-vehicle air-conditioning systems, and

the assignment of tasks in connection with the issue of training certificates to certain relevant industrial organisations working in this field as certification bodies in accordance with Article 4 (2) of the Fluorinated Greenhouse gases-Act 2009.

Qualification requirements

§ 2. Persons engaged in activities related to the recovery of fluorinated greenhouse gases from motor vehicle air-conditioning systems shall have the theoretical (T) and practical (P) knowledge and skills referred to in the Annex by the possession of a Proof of training in accordance with § 4 (1) of the fluorinated greenhouse gases Act 2009, in order to be deemed appropriate within the meaning of Regulation (EC) No 307/2008.

Certifying bodies

§ 3. (1) As certification bodies, the Federal Chamber of the industrial economy is acting in the transferred sphere of action

(2) A confirmation issued by the course organizer in accordance with § 4 (1) of the fluorinated greenhouse gas law 2009 concerning the completion of a course of training which is held for the purpose of obtaining a training certificate, shall be issued to the The certifying body shall ensure that the course is held by a suitably qualified person and covers the technical knowledge and skills listed in the Annex. (3) Where an existing training course covers the knowledge and skills set out in the Annex but does not contain the certificate referred to in Article 5, the certifying body shall have a course certificate To issue a certificate of training without the need to repeat the training course.

Recognition of qualifications

§ 4. The certifying body shall have certificates or other evidence, including relevant course confirmations, on acquired relevant relevant qualifications in relation to the knowledge listed in the Annex, and To recognise skills to an appropriate extent to obtain a training certificate in accordance with § 4 (1) of the fluorinated greenhouse gas legislation 2009.

Training certificate

§ 5. The certificate of training is entitled " Training certificate according to § 4 (1) Fluorinated greenhouse gases-Act 2009 in conjunction with the Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on Qualification measures in relation to motor vehicle air conditioning systems " shall be designated and shall include at least the following information:

the name of the certifying body;

2.

the full name and date of birth of the holder,

3.

a serial number of the training certificate,

4.

the authorised activities, with reference to Regulation (EC) No 842/2006 and Regulation (EC) No 307/2008,

5.

the date of issue and the signature of the issuing authority.

Obligation to record the certifying bodies

§ 6. (1) The certifying body shall keep records of all persons who have received a certificate of training in their field of action. These records shall be kept up-to-date and shall be kept up to date:

1.

the name of the person who received a training certificate;

2.

the date of issue,

3.

the serial number of the training certificate and

4.

Name and seat of the company in which the person operates.

(2) If this is necessary for the performance of the tasks of the Federal Minister for Agriculture, Forestry, Environment and Water Management, the records are to be made available to him on request.

Final provisions and entry into force

§ 7. (1) The Regulation shall enter into force at the end of the day of its operation.

(2) This Regulation provides for the adoption of the measures required under Regulation (EC) No 842/2006 in conjunction with Regulation (EC) No 307/2008.

(3) The names of persons chosen in the Regulation shall be understood to be gender neutral.
