44. Federal Law, which changes the School Organization Act

The National Council has decided:

The School Organization Act, BGBl. No 242/1962, as last amended by the Federal Law BGBl. I n ° 44/2009, is amended as follows:

1. In Section 8a (1), after the turn of the "for the public schools" the twist ", excluding schools for professionals with a modular teaching organisation," inserted.

2. In § 8a, the following paragraph 2a is inserted after paragraph 2:

" (2a) The provisions of para. 1 and 2 shall apply to schools for professionals with modular teaching organization in so far as they relate to the organisation of teaching in classes. "

Section 8e (1) reads as follows:

" (1) In the school years 2010/11 and 2011/12, language support courses may be set up, which have the task of pupils of primary schools, secondary schools, polytechnic schools and the lower level of the general education higher schools, which according to § 4 2 lit. a of the school teaching law, BGBl. No 472/1986, because of the lack of knowledge of the language of instruction as an extraordinary pupil, to provide the language skills which enable them to follow the teaching of the school level concerned. They take one or no more than two years of teaching and, after having achieved the required language competence, can be terminated by individual pupils even after a shorter period. "

5. (Determination of the principles) In § 8e (3), the turn "2008/09 and 2009/10" and "one year of teaching" are replaced by the twists "2010/11 and 2011/12" and "two years of teaching".

6. The following sentence is added to Article 35 (3):

"In special forms for professionals with a modular teaching organization, the teaching subjects of the individual semesters are to be taught as modules."

7. In § 40 (1), first sentence, the turn shall be "German, Reading and Mathematics" through the turn "German, Reading, Writing and Mathematics" replaced.

8. § 42 (1) first sentence reads:

" Teaching in the classes of general education higher schools and in the modules of special forms for professionals with modular teaching organization is to be given by specialist teachers. "

9. The following sentence shall be added to section 43 (1):

" Special forms for working persons with modular teaching organization the number of students visiting a module shall be defined in accordance with the requirements of pedagogy and security, as well as the human and spatial possibilities of the principal, with the maximum number of students taking the maximum number of Students in one module are subject to the provisions on the highest number of pupils in the upper level of daily forms. "

10. The following last sentence is added to section 43 (2):

(11) The following sentence is added to Article 53 (2):

Article 56 (1) reads as follows:

" (1) Teaching in the classes of middle-class vocational schools and in the modules of special forms for professionals with modular teaching organization is to be given by specialist teachers. "

(13) The following sentence shall be added to Section 57:

" Special forms for working persons with modular teaching organization the number of students visiting a module shall be defined in accordance with the requirements of pedagogy and security, as well as the human and spatial possibilities of the principal, with the maximum number of students taking the maximum number of Students in a module are subject to the provisions on the class pupil maximum number of day forms. 14. § 59 (1) Z 3 reads:

17. In § 61 paragraph 1 lit. d is the second part of the third sentence:

18. § 62a reads:

" § 62a. Specialist schools for economic professions can also be run as schools for professionals, which are to be divided into semesters and are to be organized in modules with a modular teaching organization. § 63a reads:

" § 63a. Specialist schools for social occupations can also be run as schools for professionals, which are to be divided into semesters and are to be organized in modules with a modular teaching organization. Section 70 (1) reads as follows:

"(1) Teaching in the classes of higher vocational schools and in the modules of the special forms for professionals with a modular teaching organization shall be given by specialist teachers."

23. The following sentence is added to § 71:

" In special forms for professionals with a modular teaching organization, the number of students visiting a module is based on the requirements of pedagogy and security, as well as the personnel and spatial possibilities. by the head of the school, and the maximum number of students in a module shall be subject to the class pupil maximum number of day forms. "

24. In § 73 paragraph 1 lit. a is inserted after the first sentence of the following sentence:

"They are to be organized in modules with modular teaching organization."

25. In § 73 paragraph 1 lit. b is the second part of the last sentence:

26. § 73 para. 1 lit. c Last sentence is:

29. § 75 para. 1 lit. c Last sentence is:

30. In § 77 para. 1 lit. a is inserted after the first sentence of the following sentence:

32. § 77 para. 1 lit. c Last sentence is:

33. § 95 (3) last sentence reads:

34. § 95 (3a) last sentence reads:

"These colleges can also be run as schools for professionals, if necessary with an extension of the duration of their training; they are to be divided into semesters and to be organized in modules with a modular teaching organization."

Article 99 (1) reads as follows:

"(1) Teaching in the classes of the educational institutions for kindergarten pedagogy and in the modules of the courses and colleges for professionals with a modular teaching organization shall be given by subject teachers."

36. The following sentence is added to § 100:

" At courses and colleges for professionals with a modular teaching organization, the number of students visiting a module is based on the requirements of pedagogy and security, as well as on the personnel and spatial planning of the students. to determine the possibilities of the headmaster, the maximum number of students in one module being subject to the provisions on the maximum number of pupils of the daily forms. "

37. § 103 (3) last sentence reads:

"The colleges and courses can also be run as schools for professionals, if necessary with an extension of the duration of the training; they are to be divided into semesters and to be organized in modules with a modular teaching organization."

38. § 107 (1) reads:

"(1) Teaching in the classes of the educational institutions for social pedagogy and in the modules of the colleges and courses for professionals with a modular teaching organization shall be given by subject teachers."

39. The following sentence shall be added to § 108:

" At colleges and courses for professionals with a modular teaching organization, the number of students visiting a module is based on the requirements of pedagogy and security, as well as on the personnel and spatial to determine the possibilities of the headmaster, the maximum number of students in one module being subject to the provisions on the maximum number of pupils of the daily forms. "

40. The following paragraph 22 is added to § 131:

" (22) The following provisions of this Federal Act in the version of the Federal Law BGBl. I No 44/2010 shall enter into force as follows:

Section 8e (1), section 40 (1) and section 63 (5) shall enter into force on 1 September 2010,

§ 8e (3) first sentence enters into force on the expiry of the day of the event in the Bundesgesetzblatt; the laws of execution must be adopted within one year and shall be put into effect on 1 September 2010,

§ 8a (1) and (2a), § 8b (2a), § 35 (3), § 42 (1), § 43 (1) and (2), § 53 (2), § 56 (1), § 57, § 59 (1) (3), § 59 (1), last sentence, § 61 (1) (lit). a and lit. d, § 62a, § 63a, § 66 para. 2, § 70 para. 1, § 71, § 73 para. 1 lit. a, b and c, § 75 para. 1 lit. a, b and c, § 77 para. 1 lit. a, b and c, § 95 para. 3 and 3a, § 99 para. 1, § 100, § 103 para. 3, § 107 para. 1, § 108 occur with 1 September 2010 in Force and find on the individual in the scope of application of the school teaching law for professionals (SchUG-B), BGBl.
