277. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection on the Statistics of Income and Living Conditions (Income and Living Conditions-Statistics Regulation-ELStV)

On the basis of § § 4 to 8, 10 and 30 of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by the Federal Law BGBl. No 125/2009, is in agreement with the Federal Chancellor and with regard to § 13, in addition, in agreement with the Federal Minister for Finance:

Arrangement for the compilation of statistics on income and living conditions

§ 1. The Federal Institute of Statistics Austria (Bundesanstalt) has been responsible for the fulfilment of Austria's obligations under Regulation (EC) No 1177/2003 for the Community statistics on income and living conditions (EU-SILC) and to the provisions of this Regulation to carry out statistical surveys in accordance with these Regulations and on the basis of the data collected

1.

Statistics on income of persons and households, and

2.

Statistics on living conditions

for calendar years and to be published. In addition to the cross-section data, the compilation of the statistics has to include longitudinal data.

Definitions

§ 2. For the purposes of this Regulation:

1.

Private household: A single person or a group of persons who live together in a private home as an economic community.

2.

bPK-ZP : Area-specific personal identification number "Zur Person" according to Part 1 of the Appendix to § 3 (1) of the E-Gov-BerAbgrV (E-Gov-BerAbgrV).

3.

bPK-AS : Area specific identifier "Official statistics" in accordance with Part 1 of the annex to § 3 (1) E-Gov-BerAbgrV.

Periodicity, continuity

§ 3. The surveys shall be carried out once a year.

Statistical units

§ 4. Statistical units are private households and their members.

Survey characteristics

§ 5. The following characteristics shall be collected by the members of the private households:

1.

which, in accordance with the implementing regulations of the Commission, on Article 15 (2) (lit). (a) mandatory features of Regulation (EC) No 1177/2003;

2.

which, in accordance with the implementing regulations of the Commission, on Article 15 (2) (lit). (f) of Regulation (EC) No 1177/2003 in the calendar year in which it is mandatory to have significant characteristics;

3.

service number, personal satisfaction, financial possibilities, the performance of consumer goods, the possibility of partial haeming of children living in the household, child care costs, type, amount of hours and cost support for off-and-out-and-out-of-the-box office Further education in the year prior to the survey, course participants in the year before the survey, year of immigration, former citizenship, country of birth of the parents.

Survey types

§ 6. (1) The survey characteristics in accordance with § 5 are to be collected using area-specific personal identifiers (bPK) by obtaining statistics and administrative data without the names of the persons concerned in the following ways:

1.

The characteristics of the persons insured with a social security institution belonging to the main association of the Austrian social insurance institutions or entitled to benefits from a sickness insurance institution,

a)

Gender, year of birth and month of birth,

b)

Employment status, position in the occupation and sector of the local unit (workplace) in which the person concerned is employed (was), at the time of the survey and one year before the survey, and in the case of persons without gainful employment at the time of the survey last employment,

c)

Service number,

d)

the country and region of the place of work of the person concerned and the number of persons employed at that workplace,

e)

the salary or salary (contribution basis) of the person concerned,

f)

Type of pensions and the amount of pensions from the statutory pension insurance, the type and amount of transfer benefits from statutory accident insurance and other transfer benefits,

g)

Year and month of the beginning of (last) employment at the time of the survey; and

h)

Any other activity as well as a position in the occupation and activity of the local unit of second employment

by obtaining administrative data from the relevant social security institutions and health care institutions by the main association of the Austrian social insurance institutions;

2.

the characteristics of persons who are the beneficiaries of the labour market service, or those who receive benefits or are supported

a)

Gender, year of birth, month of birth and nationality, and

b)

from the performers: the beginning and end date of the receipt of benefits and the nature and amount of the benefits under the 1977 unemployment insurance act; and

c)

from the beneficiaries: start and end date of the receipt of aid and the type of aid under the Labour Market Service Act; in addition, the amount of aid for those aid, which is not only one-off, direct aid Transfers to persons for their general financial support, in order to ensure that, as of 1 March 2010, the amount of the aid to cover the livelihood, the childcare allowance, the combined aid, the aid for the removal of the aid and the aid to the Start-up aid;

through the procurement of administrative data from the labour market service;

3.

the characteristics of the recipients of child care allowance according to the Child Care Money Act

a)

Gender, year of birth, month of birth and nationality, and

b)

Start, end and height of child care allowance

through the procurement of administrative data from the Lower Austrian Regional Health Insurance Fund;

4.

the characteristics of the workplaces

a)

the economic branch of the workplace;

b)

Number of persons working in this workplace and

c)

Service number

by using data from the Register of the Statistical Units of the Federal Institute (§ 25a of the Federal Statistics Act 2000);

5.

the training characteristics of the persons according to § 5 Z 1 by the use of data from the Federal Institute for Education (§ 10 of the Education Documentation Act);

6.

the characteristics of the household members

a)

Gender, year of birth and month of birth, country of birth,

b)

the status of persons,

c)

Nationality and

d)

Current main residence reporting date

by obtaining administrative data from the reporting authorities by means of the central reporting register;

7.

the nature and amount of the remuneration and charges of those persons for which a wage, income tax or employee assessment certificate has been issued, by the use of the Federal Ministry of Finance in accordance with the tax statistics regulation and in accordance with Section 15 (1) of the Federal Statistics Act 2000, data of the payroll, income tax and employee assessments, anonymized;

8.

the nature and amount of transfer benefits in accordance with the Family Tax Equalization Act in 1967 by obtaining administrative data from the federal tax authorities;

9.

the nature and amount of the services provided in accordance with the Student Assistance Act 1983 by obtaining administrative data of the state aid authorities in accordance with Section 13 of the Student Aid Law 1983;

10.

the nature and amount of the services provided for in accordance with the Law on the Promotion of Studies in 1992 by obtaining administrative data from the study aid authorities in accordance with § § 33 to 38 of the Law on the Promotion of Studies in 1992;

11.

the characteristics of the housing conditions by using the data from the central building and housing register of the Federal Institute in accordance with Annex D (3) to (9) and also Annex E (1) to (8) of the Federal Act on the Register of Buildings and Housing.

(2) The remaining characteristics in accordance with § 5, as well as those characteristics which are not available at the time of collection as administrative data or are not available in accordance with the definitions of Regulation (EC) No 1177/2003, are personal in the nature of the survey of the To collect household members in the context of the sample in accordance with § 7 and to merge them with the characteristics collected in accordance with paragraph 1.

(3) Insofar as the authorities in accordance with paragraph 1 (1) (7) to (11) process the data at the Bundesrechenzentrum GmbH, these are to be procesed by the Bundesrechenzentrum GmbH.

Sample Selection

§ 7. For the annual survey of the characteristics in accordance with Article 6 (2), the Bundesanstalt has to determine a sample of households in accordance with Articles 8 and 9 of Regulation (EC) No 1177/2003.

Implementation of the survey

§ 8. (1) § 6 (1) to (3), (7) and (8) (8) (1) to (3) of the Registration Counting Act shall apply analogously to the conduct of the survey in accordance with Section 6 (1).

(2) For the survey in the context of the sample (§ 6 para. 2), the Federal Institute has to select households from the reporting data received for migration statistics in 1991 according to § 16b (7) of the Reporting Act and the encrypted bPK-ZP to send the members of the selected households to the Central Reporting Register in electronic form, which is linked to the respective encrypted bPK-ZP with the associated encrypted bPK-AS name, date of birth, gender and address of the selected households. Main residence of the person concerned of the Bundesanstalt in electronic form has to be announced. The data of the persons concerned (name, date of birth, sex and address of the main residence) required for carrying out the survey are, as soon as the survey of the cross-sectional data has been completed, separated from the cross-and Store longitudinal data and delete it immediately after the longitudinal data has been created.

(3) The survey of the statistical units is not subject to the obligation to provide information, but is carried out by means of voluntary information exchange. A survey of household members under 16 years of age may only be carried out if the implementing regulations referred to in § 5 (1) and (2) provide for this obligation.

(4) The interviews shall be carried out either through the personal interview of Interviewern (face-to-face interviews) or by telephone interviews or in writing. The selection from these survey methods shall be taken by the Federal Institute in accordance with the principles of economy, efficiency, expediency and the quality requirements of Regulation (EC) No 1177/2003.

Obligations of the holders of administrative data

§ 9. (1) The holders of administrative data referred to in § 6 shall provide the characteristics in accordance with Section 6 (1) free of charge on electronic data storage media within four weeks.

(2) The Federal Minister of the Interior has to inform the Federal Office of the encrypted bPK-AS and the bPK-ZP of those household members who have been known by the Federal Institute for the purpose of questioning pursuant to Section 6 (2) of the German Federal Institute for Internal Affairs (Bundesanstalt). Information was provided which, however, was not included in the transmission according to § 8 (2) of this address.

Information on the purpose of collection and data protection

§ 10. Prior to the initial survey, the Federal Institute has to inform the households to be surveyed in accordance with § 6 (2) of the survey by means of a brochure on the purpose of the survey and the data protection measures taken.

Publication

§ 11. Until the end of the calendar year following the reference year, the Federal Office shall publish the main results of the survey on the Internet free of charge.

Evaluation

§ 12. In accordance with Article 16 of Regulation (EC) No 1177/2003, the Federal Agency has, by the end of the year following the survey, a quality report as an interim report and, by the end of the second following year, a quality report as the final report of the European Commission.

Cost replacement

§ 13. (1) The Federal Minister for Labour, Social Affairs and Consumer Protection has to pay the Federal Institute the costs associated with the surveys and the compilation of the statistics pursuant to this Regulation in accordance with § 32 of the Federal Statistics Act 2000. The flat-rate cost compensation for this is 950,000 euros starting from the 2010 survey year. The above-mentioned cost rate is based on the "consumer price index 2005" (or "consumer price index 2005"), which is determined by the Federal Institute. of the index which may be replaced by the index), with the index number for the month of January 2010 forming the basis of the initial index. However, this safeguard clause shall only be applied in each case where an increase or decrease in the rate of cost increases by at least 5% is achieved through the application of the said safeguard clause. The index value on which such application of the value-retention clause is based then applies to the next calculation as the base number. The payment is made in three instalments. The first instalment is to be paid in the year preceding the survey year by 31 December to the extent of 10% of the total amount, the second instalment is to be made by 31 December of the survey year to the extent of 60% of the total amount, the third rate is up to 31. December of the year following the survey year to the extent of 30% of the total amount.

(2) In 2013, the cost of carrying out the statistics in accordance with this Regulation shall be subject to evaluation and, if necessary, by the Federal Minister for Labour, Social Affairs and Consumer Protection in agreement with the Federal Chancellor and the Federal Minister for Employment, Social Affairs and Consumer Protection. Federal Minister for Finance for the survey years from 2013 to be redefined. For the evaluation, the Federal Institute has to disclose the documents of the internal cost accounting in accordance with Section 32 (2) of the Federal Statistics Act 2000.

Use of gender-specific form

§ 14. To the extent that personal terms are used in this Regulation, they do not have a gender-specific meaning. They are to be used in the application to specific persons in the gender-specific form.
