126. Regulation of the Federal Minister for National Defence and Sport, which amends the Soldier General Electoral Regulations 2000 (SV-WO)

On the basis of § § 44 (8) and 44a of the Military Act 2001 (WG 2001), BGBl. I n ° 146, as last amended by the Budgetaccompanying Act 2011, BGBl. I No 111/2010, shall be ordered:

The Soldier General Electoral Regulations 2000 (SV-WO), BGBl. II No 412, shall be amended as follows:

1. In the title as well as in § 3 para. 4 and in § 9 becomes the official name "Federal Minister for National Defence" in the respective grammatical form by the name of the authorities "Federal Minister for National Defence and Sport" in the correct grammatical form in each case.

2. The promulgation clause is:

" On the basis of § § 44 (8) and 44a of the Military Act 2001 (WG 2001), Federal Law Gazette (BGBl). I n ° 146, as last amended by the Budgetaccompanying Act 2011, BGBl. I No 111/2010, shall be: "

3. In the table of contents the title is to § 11:

" § 11. Special provisions for soldiers in the training service from the 13. Month "

4. § 11 together with the headline is:

" Special provisions for soldiers in the training service from the age of 13. Month

§ 11. (1) For the election of soldiers ' representatives for soldiers in the training service pursuant to Section 44a (1) of the Military Act 2001 (WG 2001), Federal Law Gazette (BGBl). I n ° 146, and their replacement men as well as for a convocation of such a soldier representative or substitute man shall apply, unless otherwise stipulated by law, § § 2 to 10 shall be subject to the following measures:

1.

Within the first six months of each third calendar year, the persons entitled to vote shall elect two representatives of the soldiers as well as two substitute men for the first time in 2011.

2.

The commander of the polling station is the Federal Minister for National Defense and Sport.

3.

The election extends to the entire scope of action of the Federal Minister for National Defense and Sport.

4.

The reference date for the determination of the right to vote is 42. Day before Election Day.

5.

The election committee shall be ordered eight weeks before the election day.

6.

In place of the officer in accordance with § 4 (5), § 6 (3) and § 8 (5), another suitable staff member of the Central Office of the Federal Ministry of Defence and Sport may also be appointed.

7.

The voters ' list shall be set up by the military personnel office six weeks prior to the election, beginning with the deadline.

8.

The right to object to incorrect entries in the voters ' list shall be heard two weeks before the election day.

9.

The election is to be held as a nationwide postal ballot.

10.

The ballot paper is invalid if it contains the names of more than two eligible soldiers. If the ballot paper contains less than two names, it shall remain valid. If the ballot paper contains the same name several times, this name shall be deemed to be added only once.

11.

Those soldiers who have the two highest number of votes are elected to the soldiers ' representatives. Those soldiers who, according to the elected soldiers ' representatives, have the next two lower number of votes, are elected as replacement men.

(2) For the election of soldiers ' representatives for soldiers in the training service pursuant to Section 44a (2) of the WG 2001 and their replacement men, as well as for a convocation of such a soldier representative or substitute man, unless otherwise specified by law, § § 2 to 6 and 8 to 10 with the following measures:

1.

The commander of the polling station is the respective academy or school commander.

2.

In the cases referred to in Article 2 (2), a re-election shall take place within three days after the entry of the order for new elections or after the extinguishing or fame has been granted, provided that military requirements do not conflict with the requirements of the new election.

3.

The reference date for the determination of the right to vote shall be:

a)

the first day of the respective course, or

b)

in the case of Z 2, the day of entry of the application for new elections or after the commencing of the extinguishing or frenching process.

4.

The voter list shall be laid down

a)

through three days prior to the election, beginning with the deadline, or

b)

in the case of Z 2, one day before the re-election. "

5. In § 12, the following paragraph 1 is inserted after paragraph 1:

" (1a) The title, the promulgation clause, the table of contents, § 3 para. 4, § 9 and § 11 with headline, in each case in the version of the regulation BGBl. II No 126/2011, enter into force on 1 May 2011. "
