136. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection for the temporary employment of foreigners in agriculture and forestry

Due to § 5 of the Foreigners Employment Act-AuslBG, BGBl. No. 218/1975, as last amended by the Federal Law BGBl. I n ° 135/2009, shall be:

§ 1. For the agricultural and forestry sector, a quota of 4 700 for the temporary employment of foreign workers is fixed and is divided among the Länder as follows:

§ 2. Under these quotas, employment permits may be granted for a period of up to six months during the entire period of validity of this Regulation. For foreigners who have been employed for a limited period of time during the previous three years under a quota for the temporary employment of foreign workers in the agricultural and forestry sector, and which have been Transitional provisions on the free movement of workers of the EU (Article 32a of the AuslBG) may be granted to employment permits with a period of validity of up to nine months. The period of validity of the employment permits shall not end after 31 December 2011.

(2) Employment permits under the terms of the Regulation BGBl. No 460/2010 allocated quotas and ending on 30 April 2011 are to be set off against the quotas referred to in § 1.

(3) Foreigners who are subject to the transitional provisions on EU free movement of workers and asylum seekers are to be preferred in the granting of employment permits.

§ 3. This Regulation shall enter into force on 1 May 2011 and shall be repeal with 30 November 2011.
