23. Federal Law on Measures against Unsolicited Advertising Calls, which changes the Telecommunications Act 2003
The National Council has decided:
The Telecommunications Act 2003-TKG 2003, BGBl. I n ° 70/2003, as last amended by the Federal Law BGBl. I No 50/2010, shall be amended as follows:
1. According to Article 107 (1), the following paragraph 1a is inserted:
"(1a) In the case of telephone calls for advertising purposes, the call number display may not be suppressed or falsified by the caller and the service provider shall not be prompted to suppress or distort the service provider."
2. In Section 109 (3), Z 19 is deleted.
3. In Section 109 (3), the following Z 19a shall be inserted after Z 18:
" 19a. |
Contrary to Article 107 (1a), the telephone number display is suppressed or falsified or is caused to be suppressed or falsified; " |
4. In § 109 para. 4, the point after Z 7 is replaced by a stroke point and the following Z 8 is added:
" 8. |
contrary to § 107 para. 1 calls for advertising purposes. " |
5. § 137 the following paragraph 3 is added:
" (3) § 107 (1a) and § 109 (3) and (4) in the version of the Federal Law BGBl. I No 23/2011 will enter into force with DDMMYYYY. "
