205. Regulation of the Federal Minister for the Interior, amending the Regulation on the Integration Agreement

On the basis of § 14 (3), 14a (6), 14b (4) and 16 (4) and 16 (4) of the German Law on the Law of the Niederlassungs-und Aufenthaltsgesetz (NAG), BGBl. I No 38/2011 , is-in accordance with Section 15 (2) in agreement with the Federal Minister for Finance-decreed:

The regulation of the Federal Minister of the Interior on the integration agreement (integration agreement regulation-IV-V), BGBl. II No 449/2005, shall be amended as follows:

1. In Section 1 (1), the word sequence shall be deleted. "Literacy Courses and" .

2. In § 1 para. 2, after the word order "Legal basis of the institution," the phrase "Information on the teaching staff employed, in particular their qualifications" inserted and the word "Course Times" through the phrase "Information on Course Times" replaced.

3. In Section 1 (3), the word order shall be "the literacy courses and the German integration courses replace the requirements of the respective framework curricula (Appendix A and B)" by the phrase "the German integration courses the requirements of the framework curriculum (Annex A)" .

4. In Section 1 (7), after the word order "The legal basis of the course holder," the phrase "the teaching staff employed," inserted.

5. § 2 (1) reads:

" (1) For the holding of German integration courses, the course carrier has exclusively to use teachers who demonstrate the following qualifications:

1.

A completed course for "German as a Foreign Language" (DaF) or for "German as a Second Language" (DaZ) by a

a)

completed DaF or DaZ university studies to the extent of at least 180 ECTS, or

b)

university degree or a university course of at least 180 ECTS credits and a DaF or DaZ supplementary training in the amount of at least 100 hours of 45 minutes in theory and practice

and at least 450 hours of 45 minutes of teaching experience in the field of DaF or DaZ in adult education,

2.

A degree in German studies or a living foreign language in the main subject, or a completed course of study in linguistics and at least 450 hours of 45 minutes of teaching experience in the area of DaF or DaZ in the adult education,

3.

a degree from a teacher training college to obtain teaching qualification in German and at least 450 hours of 45 minutes of teaching experience in the area of DaF or DaZ in adult education or in public or with the public law schools, or

4.

A job as a trainer in continuing vocational training with at least 3000 hours of 45 minutes of teaching experience in the field of DaF or DaZ in adult education. "

6. In Section 2 (2), the word sequence shall be deleted "as well as in the case of German integration courses, the final examination (§ 8 para. 2)" and becomes the phrase "and the results of the final exams are" by the word "is" replaced.

7. In § 2 para. 3 the word order shall be "Appendix A or B" through the phrase "Appendix A" replaced.

8. In Section 3 (1), the phrase "the framework curricula for literacy courses and German integration courses (Annex A and B)" through the phrase "the framework curriculum for German integration courses (Annex A)" replaced.

9. In Section 4 (1), the phrase "the contents of the respective framework curriculum, within the scope of the German Integration Course" through the phrase "the contents of the framework curriculum for German integration courses (Annex A)," replaced.

Section 6 (1) reads as follows:

"(1) The German integration course comprises 300 teaching units of 45 minutes each."

11. In § 6 para. 2, the staple citation shall be "(Section 8 (1))" by the citing quote "(Section 7 (1))" replaced.

12. § § 7 and 8 together with the headings are:

" German Integration Course (Module 1)

§ 7. (1) The objective of the German Integration Course (Module 1 of the Integration Agreement) is to achieve the A2 level of the Common European Framework of Reference for Languages, as described in the framework curriculum for German Integration Courses (Appendix A).

(2) The completion of the German integration course is a final examination, at least at the A2 level of the Common European Framework of Reference for Languages, through the ÖIF.

Final examination by the ÖIF

§ 8. (1) The registration of the individual examination candidates for the final examination is carried out by the course institute by electronic means.

(2) The final examination is

1.

by two qualified auditors of the ÖIF, or

2.

, in agreement between the ÖIF and the Institute of Health, by a qualified auditor of the ÖIF and the spa institute

, The final examination is to be collected for all participants of the German integration course no later than 14 days in advance and to be carried out on dates and locations suitable with regard to the number of examination applications. If necessary, the examinations must be carried out at least in provincial capitals or at the seat of the district administration authority. § 5 shall apply mutatily.

(3) The Examination Candidate must have a valid identity document at the beginning of the examination and must comply with the examination regulations of the ÖIF.

(4) The qualified examiners shall evaluate the test part and transmit the total audit services taken off to the ÖIF. This assesses the examination performance of the test parts writing, reading and hearing, checks the results of the test piece, checks the results of the test piece, and determines the overall result.

(5) Proof of successful completion of the German integration course must be issued by the ÖIF in the form of an audit certificate, the original of the certificate being to be submitted to the candidate for examination and a copy thereof ÖIF remains. The test certificate shall correspond to the specimen of Appendix B.

(6) In the event of non-existence of the final examination, the ÖIF shall inform the examination candidate in writing and shall indicate the possibility of repeating the final examination.

(7) Repeats of a negative final examination shall be admissible within the time limit laid down in Section 14a (2) of the NAG. Par. 1 to 5 shall apply. "

13. In § 9 para. 1, the quote shall be "§ 14 (5) Z 5" by the quotation "§ 14a (4) Z 2 and section 14b (2) Z 2" replaced.

14. § 9 (1) Z 3 reads:

" 3.

15. § 9 (2) to (4) reads:

" (2) Each institution shall, in the language diploma or certificate referred to in paragraph 1 thereof, confirm in writing that the foreign language in question shall at least have knowledge of the German language.

at A2 level of the Common European Framework of Reference for Languages, or

2.

to B1-level of the Common European Framework of Reference for Languages

.

(3) If there is no confirmation in accordance with paragraph 2, proof of sufficient knowledge of German at the appropriate level shall be deemed not to be provided.

(4) As proof of sufficient knowledge of German according to § § 14a (4) Z 2 or 14b (2) (2) Z 1, certificates of the ÖIF are valid after successful completion of an examination at A2 level or B1 level of the Common European Framework of Reference for Languages. The certificate shall be in accordance with the model of Appendix B. "

16. § 10 reads:

" (1) The maximum rate for the cost participation of the federal government in accordance with § 15 para. 1 NAG for German integration courses to the extent of 300 teaching units is 750 euros per course participant.

(2) If the number of teaching units is reduced in accordance with Article 6 (2), the maximum rate for the share of the costs referred to in paragraph 1 shall be reduced accordingly.

(3) If the content of the content of the course is beyond the course objective, the cost contribution of the Federal Government shall be governed by the teaching units specified in the course confirmation for the attainment of the course target; paragraph 1 applies. "

17. The title of § 11 reads:

"Final Provisions"

18. The content of the previous § 11 is given the sales designation "(1)" and shall be added to the following paragraphs 2 to 4:

" (2) § § 1 (1) to (3) and (7), (2), (3) (1), (4) (1), (6), (7) and (8) together with headlines, 9, 10, 11 and the heading, as well as annexes A and B, as amended by the Federal Minister of the Interior BGBl. II No 205/2011 will enter into force on 1 July 2011.

(3) In the cases of Section 81 (18) and (19) of the NAG, this Regulation is in the version of the Regulation of the Federal Minister of the Interior BGBl. II No 449/2005.

(4) This Regulation, as amended by the Federal Minister of the Interior BGBl, is for certifications and renewals of the certifications of the Kurbearers. II No 205/2011. Certifications of the course holders, which pass on 30 June 2011, retain their validity for the intended period of time. "
