236. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the allocation of milk quotas in the 12-month period 2011/2012 (milk quota allocation regulation 2011)

Pursuant to Section 10 (2) of the Law on the Market Rules 2007 (MOG 2007), BGBl. I n ° 55, as last amended by the Federal Law BGBl. I No 23/2010, shall be ordered:

Responsibility

§ 2. The market organisation "Agrarmarkt Austria" (AMA) is responsible for the enforcement of this Regulation and of the acts referred to in § 1.

Dispatch Quantity

§ 3. With effect from the 12-month period 2011/2012, 30 000 tonnes of milk quota will be allocated to milk producers.

Application

§ 4. (1) If a milk producer has not submitted an application for aid in 2011, but otherwise fulfils the conditions laid down in Article 10 (2) (2) (1a) of the MOG 2007, the milk quota shall be allocated by 31 August 2011 at the latest, according to one of the AMA to apply for the AMA.

(2) If a milk producer submitted an aid application in 2011 and also fulfils the conditions laid down in § 10 para. 2 Z 1a MOG 2007, he can withdraw the application for quota allocation in writing by 31 August 2011 at the latest. This letter is to be sent to the AMA.

Allocation Measurement

§ 5. (1) For the allotment measurement, the quota for the deliveries of the holding (main holding and partial holdings) and of the Almbetriebe as well as the representative fat content of the quota for deliveries, which is due on the date of 31 March 2011, shall be the individual operating quota for the allocation of the dispatching. of the main establishment.

(2) The allocation shall take place on the main holding in accordance with § 10 paragraph 2 Z 1 of the MOG 2007.

§ 6. The AMA must decide on the applications for allocation and inform the milk producers of the quotas allocated for deliveries as well as their representative fat content with effect from 1 April 2011. The quotas for deliveries are to be rounded up on a whole number of figures.
