Federal law which enforces a federal law on empowerment to take over the refund of the cooling equipment disposal contributions and repeals the federal law for the repatriation of the consumer's cooling equipment disposal contributions

Article 1

Federal law on empowerment to take over the restitution of cooling equipment disposal contributions

Contract for third parties

§ 1. (1) The Federal Minister of Finance is authorized to pay the obligation to repay contributions of the buyers of refrigerators, which are due to the regulation of the Federal Minister for the Environment, Youth and Family on the withdrawal of refrigerators, BGBl. No 408/1992, and the Regulation of the Federal Minister for the Environment, amending the Regulation on the withdrawal of refrigerators, BGBl. No 168/1995, paid contributions for disposal chains or acquired vouchers and have not yet returned the contributions paid for them, by contract to be concluded with UFH Umweltforum Budget GmbH & Co KG in favour of buyers. to the extent that the UFH Umweltforum household private foundation provides an abstract guarantee for the fulfilment of the payment obligations of the UFH Umweltforum Household GmbH & Co KG, as defined in paragraph 2 Z 1.

(2) According to the contract to be concluded

1.		the UFH Umweltforum Household GmbH & Co KG makes a payment of 24 million euros to the federal government for the takeover of the repayment obligations,
2.		the UFH Umweltforum Household GmbH & Co KG shall take over the examination and settlement of the repayment entitlements free of charge until 31 December 2020, as well as
3.		the UFH Umweltforum Budget GmbH & Co KG takes over the payment of the repayments up to 31 December 2013 annually up to an amount equivalent to the annual average repayments in 2009 and 2010.

Purpose

§ 2. The fee to be paid in accordance with § 1 is for the repayment of the claims in accordance with § 1, the consumer protection, for in § 1 of the Heat and Refrigeration Engineering Act, BGBl. I n ° 113/2008, as well as for the purposes of environmental protection and the granting of legal guarantees, including the covering of the court's operation.

§ 3. With the enforcement of this federal law, the Federal Minister of Finance is in agreement with the Federal Minister for Justice, the Federal Minister for Economic Affairs, Family and Youth, the Federal Minister for Agriculture and Forestry, Environment and Water management and the Federal Minister for Labour, Social Affairs and Consumer Protection.

Article 2

Repeal

The Federal Law for the Repatriation of Consumer Refrigeration Equipment Disposal contributions, BGBl. I n ° 111/2010 shall be repealed with effect from the end of 30 December 2010.
