The National Council has decided:
Article 1
Amendment of the Criminal Code (StGB)
The Criminal Code, BGBl. No 60/1974, as last amended by the Federal Law BGBl. I n ° 111/2010, is amended as follows:
Section 301 (3) reads as follows:
" (3) Who, in a manner referred to in paragraph 1, provides a communication on the content of results from information on the data or data of a communication or on the monitoring of messages, or of an optical or acoustic Surveillance of persons using technical means (§ 134 Z 5 StPO) is published, if these results have not been taken previously to the Act (§ 145 para. 2 StPO), with imprisonment up to one year or with fine up to 360 punishing daily rates. "
Article 2
Amendment of the Public Prosecutor's Act
The Public Prosecutor's Law, BGBl. No. 164/1986, as last amended by the Federal Law, BGBl. I n ° 111/2010, is amended as follows:
The following sentence shall be added to Article 5 (5):
"The same applies to arrangements in accordance with Section 76a (2) of the StPO."
2. § 42 the following paragraph 16 is added:
" (16) § 5 (5) in the version of the Federal Law BGBl. I n ° 66/2011 will enter into force on 1 April 2012. "
