67. Federal Act amending the Code of Criminal Procedure in 1975

The National Council has decided:

The Code of Criminal Procedure in 1975, BGBl. No. 631/1975, as last amended by the Federal Law BGBl. I No 43/2011, shall be amended as follows:

1. In Section 19, Section 1, Z 3, the parenthesis shall be: "(WKStA)" by the citing quote "(Economic and Corruption Prosecutor's Office-WKStA)" replaced.

2. § 20a (1) is amended as follows:

(a) Z 5 is:

" 5.		Seizure by the authorities (§ 153a StGB), restrictive agreements in the case of award procedures (§ 168b StGB), acquisition by agents or agents (Section 168c (2) of the German Civil Code) and to the extent that it is to be assumed, on the basis of certain facts, that the deed was committed in respect of a value of the advantage over a value of EUR 3 000, bribery (§ 304 StGB), benefit acceptance (§ 305 StGB), preparation of the bribery or the acceptance of benefits (§ 306 StGB), bribery (§ 307 StGB), Benefit (§ 307a of the StGB), preparation of bribery (§ 307b of the German Civil Code) and prohibitions Intervention (§ 308 StGB); "

b) In the Z 6, after the turn " BGBl. No. 569/1978 " the twist " , but only to the extent that the company concerned has a share capital of at least EUR 5 000 000 or more than 2000 employees, " inserted.

3. In § 20b, paragraph 3, the quote shall be "§ 302 StGB" through the turn "§ § 302 and 304 to 308 of the German Civil Code (StGB), in so far as the deed was committed in respect of a value of the prejudice which was not exceeded 3 000 euros," replaced.

4. § 514 is added to the following paragraph 17:

" (17) § § 19 (1) Z 3, 20a (1) (1) Z 5 and 6 and 20b (3) in the BGBl version. I n ° 67/2011 will enter into force on 1 September 2011, § 20a (1) Z 2, 3, 4 and 7 in the version of the Federal Law BGBl. I No 108/2010 will enter into force on 1 September 2012. § 20a (1) (2) to (13) in the version of the Federal Law BGBl. I n ° 98/2009 shall expire on 31 August 2011. '

5. In § 516 para. 7 the quote becomes " 20a (1) in the version BGBl. I No 108/2010 " by quoting " § 20a (1), (1), (5), (6), (8) and (9) in the version of the Federal Law, BGBl. I No 67/2011 " replaced.

6. In § 516, the following paragraph 7a is inserted after paragraph 7:

" (7a) The WKStA is for those in § 20a (1) Z 2, 3, 4 and 7 in the version of the Federal Law BGBl. I No 108/2010, in so far as the investigation procedure has been carried out after 31 August 2012. "
