246. Regulation of the Federal Minister for Economic Affairs, Family and Youth on the notification and notification of fuel prices to the price transparency database in accordance with the price transparency law (price transparency regulation on fuel prices 2011)

On the basis of § 1a of the Price Transparency Act, BGBl. No. 761/1992, as last amended by the Federal Law BGBl. I No 54/2011, shall be ordered:

§ 1. (1) Operators of petrol stations, who also offer consumers (§ 1 KSchG) fuels on a commercial basis, each have the prices for diesel fuel and super-gasoline 95 Oktan, which are excellent at their petrol station area, at the latest within half an hour. after the respective price change to the price transparency database of E-Control, to be reported in electronic form. If a new fuel price is fixed at 12 noon, the fuel price shall be reported immediately. The price reports must be made via an electronic platform provided by the E-Control or via an automated short message service SMS. EControl has to confirm the message being made to the petrol station operators. The service station operators shall also report the opening hours of the respective gas station, the type of operation, the possible methods of payment, access modalities and other service facilities to the E-Control for publication to the database.

(2) E-Control shall provide the service station operator with authenticated access for the data input via the electronic platform and for data entry via SMS for the purpose of the price registration. The petrol station operators have to register with the E-Control.

§ 2. (1) E-Control has to provide consumers with location-related queries and to notify competitively the most favourable prices in the vicinity of the site. In order to avoid the possible misappropriateness of wide access routes and their environmental impact, the other filling stations in the vicinity are also to be found without a price indication, which do not have the lowest prices.

(2) In the sense of the broadest possible information for consumers about the current price situation, the E-Control can make the most favorable prices available at the moment, subject to the use of the Autofahrerklubs usage regulations. Provided that the car drivers ' clubs offer to consumers in accordance with the most favourable filling station along a main route, the relevant data will be made available to them for each specific query. The conditions of use may, in particular, contain provisions concerning the non-commercial exploitation of this information and the form of presentation of re-use.

§ 3. EControl is obliged to keep the data transmitted for a period of at least one year. It has reported on a quarterly basis the reported data in a summary report to the Federal Minister for Economic Affairs, the Family and Youth, with particular reference to price developments and frequency of price changes and queries. . This report by E-Control is also available to the Association for Consumer Information and the Federal Chamber of Labour (Bundesarbeitskammer) with the transmission of the electronic data bases.

§ 4. Section 1 (2) of this Regulation shall enter into force at the end of the day of its presentation and the remaining provisions shall enter into force seven days after the date of the customer's decision. The database will be run as a trial run until 15 August 2011. The criminality of infringements of the provisions of this Regulation shall apply from 16 August 2011. The Regulation will not enter into force on 31 December 2013.
