According to Art. 140 (5) and (6) B-VG and in accordance with Section 64 (2) of the Constitutional Court Act 1953, BGBl. No. 85/1953, is made known:
The Constitutional Court, with the recognition of the 8. October 2015, G 264 /2015 -18, delivered to the Federal Chancellors on 28 October 2015. October 2015, rightly recognized:

Section 28 (2) of the German Data Protection Act 2000, BGBl. I No 165/1999, idF BGBl. I n ° 133/2009, is being repealed as unconstitutional. |

The repeal shall enter into force upon expiry of 31 December 2016. |

Previous legal provisions do not enter into force again. " |
