306. Regulation of the Federal Minister for Transport, Innovation and Technology, amending the Passenger Ship Ordinance

Pursuant to § 7 (4) of the Maritime Fulfillment Act-SSEG, BGBl. No 387/1996, as last amended by BGBl. I n ° 32/2002, shall be assigned:

The Regulation on safety requirements for passenger ships (passenger ship ordinance), BGBl. II No 150/2000, as last amended by BGBl. II No 252/2005, shall be amended as follows:

1. § 2 Z 4 reads:

" 4.

"High-speed rolling stock code" means the International Code 1994, which forms an integral part of the SOLAS Convention, for the safety of high-speed craft and also an integral part of the International Code 2000 for the Safety of High-speed Vehicles, which constitutes the SOLAS Convention ".

2. § 2 Z

" 5a.

"Passenger ship Directive": Directive 98 /18/EC on safety rules and standards for passenger ships, OJ L 206, 22.7.1998, p. No. 1., as amended by Directives 2002 /25/EC, OJ L 144, 4.5.2002, p. No. 1, 2003 /24/EC, OJ L 98, 9.4.2003, p. No. 18, 2003 /75/EC, OJ L 123, 17.5.2003, p. No. 6 and 2010 /36/EU, OJ L 190, 18.7.2010, p. No. OJ L 162, 29.6.2010, p. 1.

3. The last sentence of § 2 Z 8 reads as follows: " and their maximum speed in accordance with Chapter 1, Section 1.4.30 of the International Code2 1994 for the Safety of High Speed Vehicles, or Chapter I, Section 1.4.37. of the International Code 2000 for the Safety of High Speed Vehicles High speed craft is less than 20 knots. "

4. § 3 (2) reads:

" (2) For high-speed passenger craft, the International Code 1994 for the Safety of High-speed Vehicles in Chapter 1, Section 1.4.10. and 1.4.11 of Chapter 1, Section 1.4.12. and 1.4.13. of the International Office for High-speed Vehicles shall apply to the International Safety and Health Organization. Codes 2000 for the safety of high-speed craft categories. "

5. § 5 (1) Z 3 reads:

" 3.

For the navigation equipment on board, Chapter V, Rule 17 to 21 of the SOLAS Convention shall apply. Navigational equipment on board which are listed in Annex A.1 of the Ship Equipment Regulation and which comply with the requirements of this Regulation shall be deemed to comply with the type-approval requirement laid down in Chapter V, Regulation 18.1, of the SOLAS Convention "

6. § 5 (4) Z 1 reads as follows:

" 1.

High-speed passenger craft as from 1. Jänner, built in 1996 or undergoing repairs, alterations or modifications of a larger type, shall comply with the requirements of Chapter X, Regulation 2 and 3 of the SOLAS Convention, unless:


in June 1998 at the latest, their keel laying took place or they were in a corresponding construction condition,


Delivery and commissioning took place no later than December 1998 and


they comply with the requirements of the Code for the Safety of Vehicles with Dynamic Lift. "
