320. Regulation of the Federal Chancellor concerning the charges for legal advice in appeal proceedings before the Asylum Court
Due to § 66 (3) of the Asylum Act 2005-Asylum G 2005, BGBl. I n ° 100, as last amended by the Federal Law BGBl. I No 38/2011, shall be assigned:
§ 1. (1) The fee for the legal counsellor in a complaint procedure before the Asylum Tribunal pursuant to Section 66 (1) of the Asylum Act to an asylum seeker is 211,00 Euro exclusive of USt. if legal advice is a legal counsel. Person has been entrusted with the task.
(2) The fee referred to in paragraph 1 shall be due in respect of legal advice carried out for each asylum seeker. With this fee, the associated time, work and material expenses, especially travel and interpretation costs, will be covered in a flat-rate way.
(3) For the respective legal person entrusted with the legal advice, the fee is reduced from the 4001. Legal advice in the calendar year by 25% and from the 7001. Legal advice in the calendar year by 35%, whereby in the calculation of the number of legal advice carried out in the relevant calendar year according to § § 64 and 65 of the Asylum Act 2005 as well as in accordance with § § 84 and 85 of the German Federal Police Act 2005, BGBl. I n ° 100, in the version BGBl. I No 38/2011.
(4) The fee referred to in paragraph 1 shall be as from 1. Jänner 2013 value-secured. The index of consumer prices 2010 (VPI 2010), or a successor index to the latter, is used as a measure of value stability. The index number, which was lauded for October 2011, serves as the reference for the adjustment. Legal persons responsible for legal advice shall be entitled, at the beginning of the calendar year, to follow the month in which the index of the CPI has increased by five points in relation to the index number for October 2011, To demand price adjustment. The index underlying such application of the value-guarantee clause shall then apply to the next calculation as the base number. All variable prices are to be calculated on a rounded decimal place.
§ 2. The Regulation shall enter into force 1. October 2011, in force.
