91. Federal Act amending the Puncting Act 2000

The National Council has decided:

The Puncting Act 2000, BGBl. I n ° 24/2001, as last amended by the Federal Law BGBl. I n ° 26/2004, shall be amended as follows:

1. In § 17 (1) and (4), § 19 (3) and (4), § 25 (1) (13) and (17), the term of the word shall be: Federal Ministry of Finance through the phrase "Zollamt Wien" replaced.

2. § 21 reads:

" § 21. (1) Subject to § § 20 and 27 (2), the monitoring of compliance with the provisions of this Federal Act is the responsibility of the Vienna Customs Office. In the second and final instance, the Independent Administrative Senate is responsible for Vienna. The customs office of Vienna has to fulfil its duties:

1.

the Puncting control bodies,

2.

of the precious metal control laboratory.

(2) Other customs offices may also be designated as the location of the Punation Control Institutions. The Federal Minister of Finance has taken a decision on the

the requirements of efficient and cost-effective control, and

2.

the requirements of the economy and the protection of consumers, in particular with regard to § 13,

to establish these sites by means of regulation. "

3. § 22 together with the title shall be deleted.

4. In accordance with § 28, the following § 28a is inserted:

" § 28a. (1) At the time of the entry into force of the Federal Law BGBl. No 91/2011 proceedings initiated pursuant to § § 13, 14, 15, 17, 19, 26 and 27 (2) second sentence shall be continued by the Customs Office Vienna. Fees in accordance with § 13 are from the entry into force of the Federal Law BGBl. I No 91/2011 by the Vienna Customs Office.

(2) The register, which has so far been conducted by the Federal Ministry of Finance pursuant to § 17, is subject to the entry into force of the Federal Law BGB I n ° 91/2011 of the Vienna Customs Office.

(3) Until the release of a regulation of the Federal Minister of Finance pursuant to section 21 (2), the customs offices Vienna, Linz, Salzburg and Graz shall be deemed to be the locations of the Puncting Control Institutions pursuant to section 21 (2).

(4) With the entry into force of the Federal Law BGBl. I n ° 91/2011 ends the membership of the members sent to the Punitisation Advisory Board. "

5. In accordance with § 30, the following § 30a is inserted:

" § 30a. (1) With the entry into force of the Federal Law BGBl. I n ° 91/2011 will be the staff of the Federal Ministry of Finance who have been assigned to the staff of the Federal Ministry of Finance, the Punching Control Institutions belonging to the customs offices of Linz, Salzburg and Graz, and the staff of the Staff of the precious metal control laboratory are assigned to the customs office in Vienna with their respective previous location for the permanent service.

(2) For the duration of their affiliation to a post office area of the Federal Ministry of Finance, no change in their service and employment law shall occur for the staff referred to in paragraph 1 on the basis of the movement to the customs office in Vienna. Position one. "

6. The following paragraph 3 shall be added to § 33:
