91. Federal Act 2000 modifies the Hallmarking law

The National Council has decided:

The Hallmarking Act 2000, Federal Law Gazette I no. 24/2001, as last amended by Federal Law Gazette I no. 26/2004, is amended as follows:

1. in article 17, paragraph 1 and 4, article 19, par. 3 and 4, § 25 para 1 Nos. 13 and 17 each the phrase "Ministry of finance" by the phrase "Customs Office Vienna" replaced.

2. paragraph 21:

"§ 21 (1) the monitoring of compliance with the provisions of this Federal Act is subject to sections 20 and 27 paragraph 2, in the first instance the Customs Office in Vienna." In second and final instance, the independent administrative Senate Vienna is responsible. The Customs Office in Vienna has to carry out its tasks to use:



1. the control of the Hallmarking bodies, 2.
the precious metal control laboratories.

(2) as the location of the Hallmarking supervisory bodies, other Customs offices can be provided. The Federal Minister of Finance has, taking into consideration



1. the requirements of efficient and cost-effective control and 2.
the needs of the economy and of consumer protection, in particular with regard to article 13, to set these sites through regulation."

3. § 22 together with the header is omitted.

4. According to article 28, the following article 28a is inserted:

"§ 28a. (1) at the time of the entry into force of the Federal Act Federal Law Gazette I no. 91 / 2011 initiated proceedings under sections 13, 14, 15, 17, 19, 26 and 27 paragraph 2 are second set to continue by the Customs Office in Vienna. Fees pursuant to § 13 are the entry into force of the Federal Act Federal Law Gazette I no. 91/2011 by the Customs Office in Vienna to raise up.

(4) with the entry into force of the Federal Act Federal Law Gazette I no. 91/2011 ends the members delegated to the Hallmarking Advisory Board membership."

5. According to article 30, the following article 30a is inserted:

"section 30a. (1) with the entry into force of the Federal Act Federal Law Gazette I no. 91/2011 members of the headcount of the Federal Ministry of finance staff solely responsible for Hallmarking agendas, the Hallmarking bodies belonging to the Customs offices in Linz, Salzburg and Graz and the staff of the precious metal control laboratories are assigned to the Customs Office in Vienna with her each previous site to the ongoing services.

(2) for the duration of their affiliation to a position area of the Federal Ministry of finance no change occurs for the in paragraph 1 referred to staff due to the transfer to the Customs Office in Vienna in its service and pay legal position."

6 the following paragraph 3 is added to § in 33:

"(3) section 17, paragraph 1 and 4, article 19, para. 3 and 4, article 21, article 25, paragraph 1 Z 13 and 17, § 28a and section 30a, as amended by Federal Law Gazette I no. 91/2011 with November 1, 2011 into force." At the same time article 22 together with the header override occurs."
