374. Regulation of the Federal Minister for Defence and Sport on the basic training for the use group M BUO 2 (Basic Training Regulation M BUO 2 2012)

On the basis of § § 26 to 31 and 149 (5) of the Staff Regulations Act 1979 (BDG 1979), BGBl. No. 333, last amended by the Budgetbegleitgesetz 2011, BGBl. I No 111/2010, shall be ordered:

Scope

§ 1. (1) This Regulation lays down the basic training for the use group M BUO 2 (sub-official training), including the admission to basic training.

2. Without prejudice to their military grade, the persons participating in the training of the subofficers shall be deemed to be under-officers ' under-furnace warrior and shall be subject to the provisions of this Regulation.

Objectives

§ 2. The training of sub-officers shall provide the skills and skills necessary for the performance of the duties as commander and commander, as well as the training and training of an organizational element of the "Group" level, as well as within the framework of the Pre-deployment is necessary. The necessary skills and skills are achieved by

1.

Teaching of the necessary basic knowledge in the legal field, the expert knowledge of the armed and functionally independent knowledge as well as the practical mediation of the relevant leadership skills and

2.

Mediation of the armour-and function-dependent expertise as well as the practical mediation of the corresponding leadership skills.

Construction of basic training and forms of training

§ 3. (1) Subofficialtraining shall comprise:

1.

the preparatory course, including the admission procedure for the further courses,

2.

the course of military leadership 2 and

3.

the course guide organizational element 2.

The courses according to Z 2 and 3 together form the further training of the under-ovary.

(2) The preparatory course must be carried out several times per calendar year according to the official requirements of the Heeresunteroffiziersakademie. It serves to determine the personal and professional aptitude of the subofficers of the subofficers and to the commander of an organizational element of the "Group" level in use and within the framework of the Preparation of the application and the admission to the further training of the under-oven. In the course of this course, the admission procedure is to be completed for further training in the field of subofficiation.

(3) The course of the military tour 2 serves the purpose of communicating the objectives according to § 2 Z 1. It must be carried out several times per calendar year in accordance with the official requirements of the Heeresunteroffiziersakademie, and it has the following requirements in the Appendix 1 to include training courses (teaching and timetable "Military Leadership 2").

(4) The course management organization element 2 serves the purpose of conveying the objectives according to § 2 Z 2. It is in accordance with the service requirements according to the respective requirements for the use of the sub-officer and the sub-officer of the subcommittee. Training institution after Appendix 2 shall be carried out and shall have the Annexes 3 or 4 to include training courses (teaching and timetable "course management organisation element 2").

(5) The training courses for the courses referred to in paragraphs 3 and 4 shall be allocated in accordance with the service requirements and the vacant apprenticeship positions. Without prejudice to a positive authorisation procedure for further training in the field of subofficialtraining, only those who are under-oficeration and sub-officers may be assigned to the course of the management organisation element 2,

1.

who have completed the military leadership training course 2 and

2.

provide the necessary conditions for the further training of the sub-officers in respect of the relevant weapons or specialisation.

(6) The requirement laid down in paragraph 5 (1) (1) may be re-viewed at the request of the subofficial or the under-officers ' warden, in accordance with important military interests.

1.

the commanding officer or commander of the Armed Forces Command and the Command Support, each with respect to their area of competence; and

2.

in all other cases by the Federal Minister of State or the Federal Minister for National Defence and Sport.

(7) The placement of individual training contents is also permitted in the form of self-employed courses or a distance education or a practical use or self-study or by other appropriate forms.

Authorisation

§ 4. (1) Admission requirements for the preparatory course are

1.

the positive aptitude test for the training service in accordance with § 37 (1) of the Wehrgesetz 2001 (WG 2001), BGBl, I No. 146, with the aptitude at least to the subofficial or to the lower officer and

2.

the successfully completed training of military leadership 1.

(2) The authorisation procedure for further training has to be composed of:

1.

the aptitude test and

2.

the approval test.

(3) In the context of the aptitude assessment pursuant to section 2 (2), the personal and professional suitability of the subofficers of the subofficers to the subofficial or to the subofficial shall be based on the personal capacity of the senate. to establish a military organization element ("assessment").

(4) The admission test according to paragraph 2 Z 2 shall be submitted in partial examinations before individual examiners or individual examiners and includes the examination subjects

1.

German,

2.

Mathematics,

3.

Battle Service,

4.

Maps and terrain,

5.

Weapons and Shooting Service and

6.

physical performance.

The partial exams according to Z 1 to 4 are in writing, those according to Z 5 and 6 are practically to be deposited. Partial exams that have not been passed can be repeated within one year from the initial entry to the appropriate partial test.

(5) The authorisation procedure shall be deemed to have been concluded successfully if:

1.

the suitability for the subofficial or the subofficial referred to in paragraph 3 has been established; and

2.

all part-examinations of the approval test according to paragraph 4 have been passed within the time limit laid down there.

In these cases, the admission to the further training of the subofficinal shall remain valid for the three courses referred to in § 3 (3) following the date of paragraph 5. In all other cases, the entire preparatory course, including the authorisation procedure, must be repeated.

Examination bodies for authorisation

§ 5. (1) An admission commission is to be set up for the approval procedure at the Heeresunteroffiziersakademie. This Commission shall consist of:

1.

the commandant or the commander of the Army Submission Academy as chairperson or chairperson,

2.

the Vice-Chairman and

3.

the required number of other members.

(2) The Chairperson of the Commission or the Chairperson of the Commission shall have the Vice-Chairmen and the other members from the circle of officials of the categories M BO 1 or M BO 2 or M BUO 1 or M BUO 2 or equivalent. In each case, use groups or comparable contract staff for a period of five years. If necessary, the Commission shall be supplemented by other members for the remainder of the respective functional period.

(3) Membership of the Commission

1.

Rests on the day of the initiation of a disciplinary procedure until its final conclusion and during the period of a dismissal, and

2.

In any case, it ends with the final imposition of a stricter disciplinary penalty than a fine or with the expiry of the period of order or with the transfer to another country or with the departure from the service.

(4) From the Chairman or Chairperson shall be determined from among the members of the Commission in accordance with the technical requirements for the respective evaluation.

1.

the Senate for the respective aptitude findings in accordance with section 4 (3) and

2.

the individual examiners for the respective partial exams of the approval test in accordance with § 4 (4).

In the cases of Z 1, the senate shall consist of at least three members of the Commission. A member of the Senate is to be entrusted with the chairmanship of the Council. The Senate has to decide with a simple majority of votes after non-public deliberation. A abstention is inadmissible. In the event of a tie, the vote shall be taken by the chairman or the chairman of the Senate.

Examination Rules for the Service Examination

§ 6. (1) The service examination shall include the examination subjects

1.

Heereskunde und Gefechtsmittellehre,

2.

Principles of Austrian constitutional law and the organisation of public authorities as well as the law of the European Union,

3.

the foundations of the civil service and remuneration law of the federal staff,

4.

the basic principles of administrative procedural law,

5.

the foundations of military law,

6.

Political Education,

7.

physical education,

8.

English,

9.

Perform and perform tasks,

10.

Training methodology and management behaviour,

11.

Weapons, equipment and specialised training; and

12.

Perform and perform tasks in the insert/organizational element ("Operations/OrgEt").

The level of requirements of the examination subjects is derived from the teaching contents of the Annexes 1 and 2 and 3 or 4.

(2) The service examination is to be carried out in the examination subjects in partial examinations

1.

as referred to in points 1 to 8 and 11 of the first paragraph, before individual examiners, and

2.

1 Z 9, 10 and 12 before an examination senate.

(3) The partial examinations are to be deposited in the examination subjects

1.

pursuant to paragraph 1 (1) and (6) in writing

2.

pursuant to paragraph 1 (2) to (5) and (10),

3.

in accordance with paragraph 1 Z 7 in practice,

4.

1 Z 8 according to the applicable examination regulations for language examinations in the Austrian Federal Army, as well as

5.

pursuant to paragraphs 1, Z 9, 11 and 12 in writing and in practice.

Written examinations are to be held as a written examination and must not last longer than two hours. If a test compartment consists of more than one of the above-mentioned test parts during a course, the last part of the test shall indicate the extent to which the test is carried out.

(4) The sub-officers shall be assigned to the partial exams (examination plan)

1.

Military tour 2 after completion of the respective training subject by the commandant or commander of the Army Submission Academy and

2.

In the course of the course, organization element 2 after completion of the respective training subject by the commandant or the commander or the head of the person responsible for the respective use of the sub-officer or of the Underoffizer attendant in consideration of training Appendix 2.

(5) The allocation to the partial exams referred to in paragraph 1 (1) (9) to (12) shall be permitted only if the training provided for that purpose has been completed to such an extent by the sub-officers of the undertaking concerned that the subdivisions have been completed. The attainment of the relevant training objectives can be expected or a proof of the completion of a similar training has been provided.

(6) No exams may be repeated twice. The repeat tests shall be made possible within three months. In any case, a second examination is to be taken before an examination senate.

Audit bodies for the service examination

§ 7. (1) The Examination Committee shall consist of:

1.

the commandant or the commander of the Army Submission Academy as chairperson or chairperson and

2.

the required number of other members.

(2) The other members shall be from the circle of officials of the categories M BO 1 or M BO 2 or M BUO 1 or M BUO 2 or equivalent groups of uses, or the comparable contract staff or the other in their Subject to the order of five-year-old persons. If necessary, the Examination Committee is to be supplemented by additional members for the remainder of the respective functional period.

(3) The examination senate shall consist of three members of the examination board. Preference is preferably to be taken into account. A member shall be members of the M BUO 1 or M BUO 2 or equivalent categories of use or equivalent contract staff, as far as possible.

Accounting for subofficialtraining

§ 8. (1) Unteroffiziersanwärterinnen und Unteroffiziersanwärter, die

1.

On the basis of § 3 of the Regulation on basic training for the use group M BUO 2, BGBl, which is valid until 31 December 2008. II No 519/2003, or

2.

have successfully completed the one-year volunteer training, or

3.

have been approved for the training of troop officers,

In any case, they are exempt from the completion of the preparatory course, including the admission procedure in accordance with § 4 (2). In such cases, Section 4 (5) shall not apply for the duration of the validity of an authorisation procedure.

(2) The successful completion of the Military Tour 2 of this Regulation shall be deemed to have been successful.

1.

of 1. Semester of the underof-training course according to § 3 of the regulation on basic training for the use group M BUO 2, BGBl, which is valid until the end of 31 December 2008. II No 519/2003, or

2.

Military tour 2 according to § 3 (3) of the basic training regulation applicable to the use group M BUO 2, BGBl, which is valid until 31 December 2011. II No 465/2008.

(3) As a successful completion of the Curriculum Management Organizational Element 2 according to this Regulation, the successful conclusion shall apply.

1. (a)

of the second semester of the subordinated training course in accordance with § 3 of the Regulation on basic training for the use group M BUO 2, BGBl, which is valid until 31 December 2008. II No 519/2003, with regard to the relevant weapons or subject-specific direction Appendix 2 , or

b)

of the corresponding course Management organizational element 2 in accordance with § 3 (4) of the basic training regulation applicable to the use group M BUO 2, BGBl. II No 465/2008,

2.

The one-year volunteer training with regard to the respective weapons degree or direction of specialisation after Appendix 2 ,

3.

training as a military dog ("obedience and protection") with regard to the speciation of animal husbandry and use, military dogs,

4.

the practical flying aptitude test (selection) and the admission to the military pilot training and military pilot training in the field of military pilot and

5.

the training 1a in the course of the hunting command training with regard to the weapon control Jagdkommandotruppe.

(4) The successful completion of the partial examination of the examination subject Weapons, equipment and specialist training pursuant to § 6 (1) Z 11 shall be deemed to be successful completion of the examination.

1.

training at higher technical schools or in technical schools with a view to technical service in accordance with the intended use,

2.

vocational training in the fields of "electrical engineering and electronics" or "metal engineering and mechanical engineering" or "information and communication technologies" or "motor vehicle technology" or "agricultural machinery technology" or "plant and operating technology" with regard to the technical service, in accordance with the intended use,

3.

the Bundesfachschule für Flugtechnik (Bundesfachschule für Flugtechnik) in the field of aviation technology,

4.

vocational training in the fields of "Aircraft Mechanics/Technology" or "Lightweight aircraft construction" with regard to the field of aircraft technology,

5.

vocational training in the fields of 'construction', 'wood, glass and clay', 'building technology', 'electrical engineering and electronics' and 'metal technology and mechanical engineering' with regard to the weapon control of the pioneering force in accordance with the intended use,

6.

the "cook" teaching profession with regard to the field of catering,

7.

the teaching qualification test for military instructors in the field of road transport and transport, and

8.

The first diploma examination of the study "Instrumental singing education" or an instrumental course at a music university or at a conservatory with regard to the subject of music service.

(5) Successful partial exams

1.

the basic training for the use group M BUO 2, BGBl, in accordance with § 3 of the Regulation on the basic training for the use group M BUO 2 up to the end of the 31 December 2008. II No 519/2003 or

2.

Following the basic training regulation applicable to the use group M BUO 2, BGBl, which has been in force until 31 December 2011. II No 465/2008,

shall be considered to be a successful completion of the relevant sub-tests under this Regulation.

(6) The valid proof of the knowledge of the foreign language English in the course of an assignment examination in accordance with the applicable examination regulations for language examinations in the Austrian Federal Army in accordance with the requirements level to be achieved by Appendix 1 is considered to be a successful partial examination of the examination subject English in accordance with § 6 (1) Z 8.

(7) With regard to the field of military strip and military police service:

1.

Paragraph 3, Z 1a and 2, shall not apply.

2.

A successful completion of the "National Military Strip Training" after Appendix 4 Outside of the training courses, the successful completion of the corresponding part of the examination subjects according to § 6 (1) Z 11 and 12 applies.

(8) With regard to the weapon control, the Jagdkommandotruppe is not to be applied.

Transitional provisions

§ 9. (1) The successful completion of the basic training for

1.

the group of uses M BUO 2 and

2.

the usage group D-service in sub-officialfunction

the regulations in force at the time of the respective conclusion shall be considered to be a successful completion of the training of the sub-officialtraining under this Regulation.

(2) The calculation of the settlement in accordance with § 8 (2) shall be applied until 31 December 2012. After the expiry of this period, such an invoice shall only apply with the proviso that a valid proof of the knowledge of the foreign language English is also provided in accordance with Section 8 (6).

(3) For the training of sub-officers, which shall be subject to the basic training ordinance applicable until 31 December 2011 for the use group M BUO 2, BGBl. II No. 465/2008, have been started and are successfully completed by the end of December 31, 2012, in any case the Examination subject English according to § 6 para. 1 Z 8 is no longer applicable.

In-and out-of-power

§ 10. (1) This Regulation shall enter into force 1. Jänner 2012 in force.

(2) As of 31 December 2011, the basic training regulation M BUO 2, BGBl. II No 465/2008, except for force.
