412. Regulation of the Federal Minister for Transport, Innovation and Technology, which amends the Regulation on the approval of construction projects for cableways (VgBrope 2006)

Due to § § 18 (2) and 20 of the Cable Car Act 2003, Federal Law Gazette (BGBl). I n ° 103/2003, as last amended by the Federal Law BGBl. I No 83/2007, shall be:

The Regulation on permit-free construction projects at cable cars (VgBrope 2006), BGBl. II 287/2006, is amended as follows:

1. In Section 1 (2), the word order shall be "minor reconstructions and minor ablation measures" through the phrase "Not extensive rebuilding and conversion as well as related ablation measures" replaced.

2. § 1 (3).

3. § 2 reads:

" Construction projects on cable cars in accordance with § § 2 and 119 para. 2 rope bG 2003 do not require a cable car-legal building permit and operating permit, provided that:

1.

the conditions set out in § § 18 and 19 rope bG 2003 are given,

2.

there is no direct factual and technical connection with an authorisation subject to a project, and

3.

there are no innovative features. "

4. § 3 Z 2 reads:

" 2.

these construction projects do not have an adverse impact on operational safety. "

5. § 6 first sentence reads:

"Construction projects pursuant to section 18 (1) (1) of the German cable car Act 2003, the implementation of which shall be carried out under the direction of a person within the meaning of Section 20 of the German rope code 2003, are to be carried out in the following on-or conversions as well as related ablation measures:"

6. § 6 Z 7 reads:

Maintenance hangings for towed lifts;

Lighting equipment for journeys in the dark in towed lifts, including the necessary accessories for lighting and track loudspeakers in the event of a power failure (e.g. Batteries);

42.

Additional installation of inspection drives for towing lifts with high rope guidance, including the monitoring equipment for simultaneous operation with the drive, provided that these construction measures are not carried out with the help of a cable car construction the professional enterprise;

21. § 7 First sentence reads:

"Construction projects according to § 18 (1) Z 2 rope bG 2003, for which a person is not required in the sense of § 20 SeilbG in 2003, are listed below or reconstructions as well as related ablation measures:"

29. § 8 reads:

" § 8. The competent authority of the cable car company shall be informed of changes to safety components in accordance with § 18 (3) of the cable car 2003 at the latest six weeks before the start of construction, following a detailed description of the construction project and a detailed description of the construction project.
