439. Regulation of the Regulatory Commission of E-Control with which the Other Transport-Gas-System-User-Tariff-Regulation 2007 will be amended (SonT-GSNT-VO Novelle 2012)

Pursuant to § 31h para. 5 iVm § § 23 ff of the Gaswirtschaftsgesetz-GWG, BGBl. I n ° 121/2000, as amended by the Federal Law Gazette (BGBl). I n ° 45/2009 iVm § 170 (5) GWG 2011, Federal Law Gazette I No. 107/2011, is being ordered:

The Energy-Control Commission Regulation, which includes the network-use charge for cross-border other transport of natural gas and for the cross-border transport of natural gas from a feed-in point to the control zone to an exit point the regulation zone (Other transports-gas-system-use tariff-Regulation-SonT-GSNT-VO 2007), published in the Official Journal of the Vienna newspaper no. 189 of 28 September 2007, in the version of the SonT-GSNT-VO Novel 2011, published in the Official Journal to the Vienna newspaper no. 248 of 23 December 2010, is amended as follows:

(1) § 2 (4) and (5) are replaced by the following:

" (4) The net usage fee shall be determined for the rule zone East:

a)			for transports with a transport route up to 150 km:
1.				Work Price: 0.0163 cent/kWh
2.				Performance Price: 139.69 cents/kWh/h
b)			for transports with a transport route of more than 150 km:
1.				Work Price: 0.0653 cent/kWh
2.				Performance Price: 558.77 cents/kWh/h

(5) The transport routes shall be allocated to the tariff groups referred to in paragraph 4 as follows:

Section 3 (3) reads as follows:

(3) The allocation of the shares in the network usage fee resulting from paragraph 2 shall take place in accordance with the current conditions as follows:

(3) The following paragraph 7 is added to § 4:

" (7) § 2 (4) and (5) as well as § 3 (3) in the version of the SonT-GSNT-VO Novelle 2012 are presented with 1. Jänner 2012 in force. "
