447. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection for the temporary employment of foreigners in agriculture and forestry

Due to § 5 paragraph 2 Z 1 of the Foreigners Employment Act-AuslBG, BGBl. No. 218/1975, as last amended by the Federal Law BGBl. I No 25/2011, shall be assigned:

§ 1. For the agricultural and forestry sector, a quota of 4 500 for the fixed-term employment of foreign workers is set out and divided among the Länder as follows:

§ 2. (1) In the context of these quotas, the granting of employment permits for a period of up to six months may be granted throughout the period of validity of this Regulation. For foreigners who have been employed for a limited period of time during the previous three years under a quota for the temporary employment of foreign workers in the agricultural and forestry sector, and which have been Transitional provisions on the free movement of workers of the EU (Article 32a of the AuslBG) may be granted to employment permits with a period of validity of up to nine months. The period of validity of the employment permits shall not end after 31 December 2012.

(2) Foreigners who are subject to the transitional provisions on the free movement of EU workers and asylum seekers are to be preferred in the granting of the employment permits.

§ 3. This Regulation shall enter into force with 4. Jänner 2012 in force and with 30 November 2012.
