452. Ordinance of the Federal Minister of Health, with which the Ordinance of the Austrian Medical Association for the quality assurance of medical care by established doctors and medical doctors as well as group practices (Quality Assurance Regulation 2012- QS-VO 2012)

Pursuant to § 195g (4) and § 195f (2) in conjunction with Section 117c (2) Z 8 and § 118c of the Medical Law 1998, BGBl. I n ° 169, as last amended by the Federal Law BGBl. I No 61/2010, shall be ordered:

Article I

Amendment of the Quality Assurance Regulation 2012

The ordinance of the Austrian Medical Association, which was adopted on 16.12.2011, for quality assurance of medical care by doctors and doctors established and group practices (Quality Assurance Regulation 2012-QS-VO 2012) will be adopted as follows: changed:

1. § 35 (3) reads:

" (3) The ÖQMed has informed the statutory health insurance institutions as well as hospital care institutions immediately and demonstrably in writing of the defect survey orders concerning contract doctors and contract group practices. , the contractual partners of the contract doctor or the contract group practice. This message may be connected with the notification in accordance with § 34 paragraph 2. "

Section 36 (4) reads as follows:

" (4) The ÖQMed has the intended control through an on-the-spot visit of contract doctors (contract doctors) and contract group practices to those statutory health insurance institutions as well as hospital care institutions immediately and demonstrably in writing, the contractual partners of the contract doctor or of the contract group practice. In view of their entitlement under § 118e (3) of the Medical Act 1998 to appoint a physician (a doctor) of the relevant subject to participate in the control, the ÖQMed has to immediately and demonstrably set the date for the on-the-spot visit in writing. "
