121. Federal law amending the Federal Constitutional Law on the limitation of the remuneration of public officials, the Federal Act on the Protection of the Federal Republic of Germany and the Law on the Law of the Law of the Federal Republic of Germany

The National Council has decided:

Article 1

(constitutional provision)

Amendment of the Federal Constitutional Law on the limitation of the references of public officials

The Federal Constitutional Law on the limitation of the references of public officials, BGBl. I No 64/1997, as last amended by the Federal Constitutional Law BGBl. I No 76/2010, shall be amended as follows:

1. § 3 (1) first sentence reads:

"By 5 December each year, the President of the Court of Auditors shall identify an adjustment factor and make known in the Official Journal of the" Wiener Zeitung " the amount of the initial amount applicable to the corresponding year for the period referred to in Article 1 (1) (1). References with effectiveness to 1. Jänner of the following year is to be adapted. "

2. The following paragraphs 18 and 19 are added to § 11:

" (18) The adjustment provided for in Article 3 (1) shall not apply until 31 December 2012 for salary which exceeds 49% of the initial amount in force on 31 December 2011.

(19) § 3 in the version of the Federal Law BGBl. I n ° 121/2011 will enter into force on 1 September 2012. "

Article 2

Amendment of the Federal Data Protection Act

The Federal Data Protection Act, BGBl. I No 64/1997, as last amended by the Federal Law BGBl. I No 52/2011 shall be amended as follows:

(1) The following paragraph 11 is added to § 21:

" (11) The adjustment of the initial amount in accordance with § 3 of the Federal Constitutional Law on the limitation of the references of public officials, BGBl, provided for in § 2 para. 2. I No 64/1997, no later than 31 December 2012. '

Article 3

Amendment of the Law on Bezüge

The Remuneration Act, BGBl. No 273/1972, as last amended by the Federal Law BGBl. I No 76/2010, shall be amended as follows:

In accordance with § 49s, the following § 49t with headline is inserted:

" Discharge of the adjustment of pensions for 2012

§ 49t. The application of Section 41 (2) and (3) of the Pension Act 1965 provided for in Articles 31, 34 (4), 44 (1) and (44k) shall not be applicable until 31 December 2012. "
