471. Ordinance of the Federal Minister for economy, family and youth, with the prices for the purchase of electricity from eco-electricity plants on the basis of contracts are set, the eco power clearing agency is obliged to its conclusion in 2012 (eco electricity regulation 2012 - ÖSVO 2012)

On the basis of §§ 10a, 11 and 11B of the green electricity Act (ÖSG), Federal Law Gazette I no. 149/2002, as amended by Federal Law Gazette I is no. 104/2009,



1 prescribed. with regard to articles 1 to 11 and 13 by the Federal Minister of economy, family and youth in agreement with the Federal Minister of agriculture and forestry, environment and water management and the Federal Minister for labour, Social Affairs and consumer protection, 2. with regard to article 12 by the Federal Minister of economy, family and youth: scope

1. (1) this regulation has, without prejudice to the regulation of § 8 para 5, § 12, the fixing of prices for the purchase of electricity from new plants (§ 5 par. 1 Z 22 in conjunction with Z 27 ÖSG subject, where necessary for the construction permits in the first instance are granted after December 31, 2004 and on the basis of renewable wind energy) , Sun (except photovoltaics with a peak performance of up to 5 kW in accordance with Article 10a, paragraph 1 ÖSG), geothermal, wave and tidal energy, biomass, waste with high content of biogenic, landfill gas, sewage gas or biogas can be operated.

(2) Moreover, this regulation in any case also applies



1. with regard to those plants, which on the basis of photovoltaics, except photovoltaics with a peak capacity of up to 5 kW in accordance with Article 10a, paragraph 1 ÖSG, wind power, geothermal, landfill gas and sewage gas run, and the necessary for the construction permits in the first instance had been issued between January 1, 2003 and December 31, 2004, when after June 30, 2006 in operation;

2. with regard to those facilities which are operated on the basis of solid biomass and waste with biogenic high liquid biomass or biogas, and where necessary for the construction permits in the first instance are granted between 1 January 2003 and 31 December 2004 if they are received after December 31, 2007, in operation.

(3) the prices given in articles 5 to 12 are to consider only those single collective dining,



1. completing the eco power clearing agency is obliged in accordance with the eco-electricity Act and 2nd for that in 2012 a request of contracting at the eco power settlement agency has been filed.

(4) for equipment, for which already a contract was concluded with the eco power settlement agency, apply the tariff and the term in accordance with the terms of the initial contract.

Minimum efficiency

Systems on the basis of solid or liquid biomass, waste with high content of biogenic or of biogas, as well as for mixing combustion plant are the prices specified in the regulation § 2 (1) to grant, only when a fuel efficiency (§ 5 par. 1 Z 5 ÖSG) is achieved by at least 60%. The prices given in the regulation are only be granted if an overall energy efficiency is achieved by at least 60% for geothermal facilities.

(2) the achievement of the fuel efficiency and overall energy efficiency is to prove a concept prior to commissioning of the plant. The achievement of fuel efficiency and overall energy efficiency for each completed calendar year is until no later than March of the following year of the eco power settlement agency are to demonstrate, with the first three months after commissioning do not include.

Validity of prices

§ 3. The prices contained in this regulation are in accordance with § 11 para 2a ÖSG



1. for plants referred to in sections 5 to 7 and 11 for a period of 13 years and 2. for plants referred to in §§ 8 to 10 for a period of 15 years from the start-up of the plant.

Definitions

§ 4. The purpose of this Regulation:



1 "solid biomass" forest fuels and blade of benign fuels and whose fruits (ÖNORM CEN / TS 14588);

2. "purely agricultural substrate feedstock" manure as well as plants for the purpose of biogas production from grassland and arable use including their silage as well as field and Depot falling crop residues.

Prices for green electricity from photovoltaics

5. (1) the prices for the purchase of electrical energy from photovoltaic systems which are applied exclusively or to a building or a noise-protection wall, are as follows set:



1 5 kWpeakbis 20 kWpeak 27.6 cents / kWh;

2. over 20 kWpeak 23 cents / kWh.

(2) the prices for the purchase of electrical energy from photovoltaic systems, which are not exclusively or to a building or a noise-protection wall, shall be fixed as follows:



1 5 kWpeakbis 20 kWpeak 25 cents / kWh;

2. over 20 kWpeak 19 cents / kWh.

(3) the additional volume of support (article 21 b ÖSG) for the promotion of electrical energy from photovoltaic systems pursuant to par. 2 500 000 euro per year does not exceed.

Price for green electricity from wind turbines

§ 6. For the loss of electric energy from wind turbines, a price is determined by 9.5 cents / kWh.

Price for green electricity from geothermal energy

§ 7. For the loss of electricity from geothermal energy, a price is determined by 7.5 cents / kWh.

Prices for green electricity from solid biomass and wastes with high biogenic fraction, as well as setting the heat price

§ 8 (1) as prices for the purchase of electricity from power plants, but operated under exclusive use of solid biomass, with the exception of waste with high proportion of biogenic, are set to the following amounts:



1. up to a bottleneck capacity of 500 kW 14.98 cents / kWh;

2. when a bottleneck capacity over 500 kW to 1 MW 13,54 cents / kWh;

3. in the case of a bottleneck capacity of 1 MW and 1.5 MW 13.10 cents/kWh;

4. when a bottleneck capacity of 1.5 MW and 2 MW 12.97 cents/kWh;

5. If a bottleneck capacity of 2 MW to 5 MW 12.26 cents/kWh;

6. when a bottleneck capacity of 5 MW to 10 MW 12.06 cents/kWh;

7. when a bottleneck capacity of 10 MW 10 cents/kWh.

As far as the performance of investments on the basis of solid biomass, about the contract according to § 10 para 5 ÖSG since October 20, 2009 is done, reached 100 MW, or exceeds, is priced as a price for the purchase of electricity from power plants according to Z 1 to 6 11.5 cents / kWh.

(2) with regard to prices, the following applies for the loss of electricity from power plants, waste with high content of biogenic operated using only the energy carrier:



1. use of primary energy sources in accordance with all five-digit key numbers in table 2 of the annex to article 5, paragraph 1 Z 1 ÖSG beginning with SN 17, are the prices laid down in paragraph 1, to 25% reduced;

2. use of primary energy sources in accordance with all five-digit key numbers in table 1 of the annex to article 5, paragraph 1 Z 1 ÖSG beginning with SN 17, are the prices laid down in paragraph 1, to 40% reduced;

3. for use of primary energy sources in accordance with all other five-digit key numbers in table 1 and 2 of the annex to article 5, paragraph 1 Z 1 ÖSG, the 5 cents / kWh is priced.

4. for combinations in para 1, para 2 Z 1, 2 and 3 substances use a proportionate rate comes after the fuel quantities used, referring to the fuel heat output to the application.

(3) the following applies for the loss of electric energy of hybrid and mixed combustion plant to co-firing in thermal power plants, which are operated under use of the biomass or waste with high content of biogenic fuels, with regard to the prices:



1. at exclusive use of solid biomass, the price with 6.12 cents / kWh is fixed;

2. use of primary energy sources in accordance with all five-digit key numbers in table 2 of the annex to article 5, paragraph 1 Z 1 ÖSG beginning with SN 17, are the prices fixed in no. 1 to 20% reduced;

3. use of primary energy sources in accordance with all other five-digit key numbers in the tables 1 and 2 of the annex to article 5, paragraph 1 Z 1 ÖSG, are the prices fixed in no. 1 to 30% reduced;

4. when combinations of feedstocks from Z 1-3 a proportional rate comes after the fuel quantities used, relative to the fuel heat output to the application.

(4) the tariffs referred to in paragraph 2 and 3 will apply irrespective of whether the used waste with high content of biogenic are used in their original form or but previous hacking, changing presses or other troubleshooting steps in their shape and density.


(5) for eco-electricity plants on the basis of solid biomass for the a feed-in tariff pursuant to Regulation BGBl. II Nr 508/2002, as amended by regulation BGBl. II Nr 254/2005, is granted (article 11, paragraph 1 ÖSG), a combined support is provided for electrical energy and heat, if the previous maximum funding level is not exceeded. The maximum funding amount is determined from the product of the single feed amount of electrical energy of the first 12 months after the full operation has been recorded and the granted feed-in tariff minus the market price. § 20 ÖSG shall apply by analogy. The maximum funding level is limited in height by 6 000 hours on the basis of this calculation also with a full load hours. The support rate for the heat is each performance class with the formula WT = ET / 4,4 - WP to calculate, with "WT" denotes the heat price in cents/kWh the support rate for heat in cents/kWh, "ET" the granted feed-in tariff in cent/kWh and "WP". The heat price is 2.4 cents per kWhth.

Prices for green electricity from liquid biomass

§ 9 (1) for the loss of electric energy from liquid biomass determines a price of 5.8 cents / kWh.

(2) for electricity produced in CHP plants operated solely on the basis of liquid biomass and for which where in accordance with § 1 para. 3 2 period a request in accordance with Article 10a paragraph 5 ÖSG on acceptance of eco-electricity is been Z at the prices specified by this regulation, there is a surcharge of 2 cents / kWh, if these systems the efficiency criterion in accordance with § 8 par. 2 CHP Act , Federal Law Gazette I no. 111/2008, meet.

Prices for green electricity from biogas

§ 10 (1) as prices for the purchase of electricity from power plants, which are operated by using the energy of biogas with purely agricultural substrate use materials, be set following amounts:



1. for equipment with a bottleneck capacity up to 250 kW 18.5 cents / kWh;

2. in installations with a bottleneck capacity of more than 250 to 500 kW 16.5 cents / kWh;

3. for equipment with a bottleneck capacity of more than 500 kW 13.0 cents / kWh.

(2) that 1 established prices are Z in para 1 only under conditions ensuring that animal manure with a mass fraction of at least 30% is used. Evidence of the usage of the substrate usage substances referred to in the first sentence is to provide the eco power settlement agency for each calendar year no later than end of January of the following year.

(3) use of others as a purely agricultural substrate use materials reduce the prices fixed in paragraph 1 by 20%.

(4) for electricity produced in CHP plants operated solely on the basis of bio-gas and for which where in accordance with § 1 para. 3 2 period a request in accordance with Article 10a paragraph 5 ÖSG on acceptance of eco-electricity is been Z at the prices specified by this regulation, there is a surcharge of 2 cents / kWh, if these systems the efficiency criterion in accordance with § 8 par. 2 CHP Act , Federal Law Gazette I no. 111/2008, meet.

(5) the prices for the loss of electric power from hybrid and mixed combustion plant using biogas as a fuel, are pro-rated according to paragraph 1 or 3 according to the amount of used bio-gas, based on the fuel thermal capacity, fixed.

(6) by way of derogation from paragraphs 1 and 2 1 and 2 ÖSG for where in accordance with § 1 para. 3 2 period a request in accordance with section 10a para 5 ÖSG on purchase of green electricity at prices determined by this regulation is set Z, as prices for those quantities of electricity from gas in accordance with Article 10a paragraph 10 ÖSG para be for plants referred to in § 7 , which has been fed into the grid and prepares them to natural gas quality, established the following amounts:



1. for equipment with a bottleneck capacity up to 500 kW 16.5 cents / kWh;

2. for equipment with a bottleneck capacity of more than 500 kW 13.0 cents / kWh.

(7) for electrical energy a surcharge of 2 cents/kWh for those amounts of electrical energy consists of plants referred to in paragraph 6 gas pursuant to section 10a subsection 10 ÖSG, if the gases injected into the grid to natural gas quality are prepared to (technology bonus).

Prices for green electricity from landfill and sewage gas

§ 11 (1) as prices for the purchase of electricity from power plants, which are operated by using the energy of landfill and sewage gas, be set following amounts:



1. for sewage gas 6 cents / kWh;

2. for landfill gas 5 cents / kWh.

(2) the prices for the loss of electric power from hybrid and combustion plant, using landfill and sewage gas as energy sources, will be pro-rated according to paragraph 1 according to the amount of gas, based on the fuel thermal capacity, fixed.

Prices for certain commodity-dependent plants after the contracting obligation

Section 12 (1) as prices for the decline have applied at the eco power settlement agency electrical energy from electricity generation plants, given pursuant to section 11B ÖSG where in accordance with § 1 para. 3 Z 2 period after expiry of the period of contracting, the following amounts are set:



1. for plants referred to in section 8, paragraph 1, the solid using only the energy biomass are operated, a) with a bottleneck capacity of up to 2 MW 8.5 cents/kWh;

(b) with a bottleneck capacity of more than 2 MW to 10 MW 7.5 cents/kWh;

(c) with a bottleneck capacity of more than 10 MW 7.0 cents/kWh;

2. for installations pursuant to § 10 para 1, which are operated by using the energy of biogas with purely agricultural substrate use materials, a) with a bottleneck capacity of up to 250 kW 9.5 cents / kWh;

(b) a bottleneck capacity of more than 250 kW 8.0 cents / kWh.

(2) in the case of biogas plants with a usage by others as a purely agricultural substrate use materials you be reduced 2 fixed prices by 20% Z in para 1.

Entry into force

§ 13. This Regulation shall enter into force January 1, 2012.
