Regulation of the Federal Minister of Transport, Innovation and Technology, with which the regulation of the Federal Minister for Transport, Innovation and Technology on a waterway traffic regulations and the regulation of the Federal Minister for Transport, Innovation and Technology The public economy and transport are subject to change via a shipping and transport system for lakes and rivers

Pursuant to § § 1, 16 (1) and (2), 17, 18 (1), (2) and (3), 23 (1) and 37 (3) of the Maritime Law, BGBl. I n ° 62/1997, as last amended by BGBl. I No 111/2010, shall be ordered:

Article 1

The regulation of the Federal Minister of Transport, Innovation and Technology on a waterway traffic order, BGBl. II No 289/2011, as last amended by BGBl. II No 410/2011, shall be amended as follows:

1. In § 0.02 Z 1, after the expression " 6.26 Z 3, " the expression " 6.33, " inserted.

2. In § 1.02 Z 6 the expression " Naval " by the expression " Vehicle " replaced.

3. In § 1.02 Z 7 the expression " Ship " by the expression " Vehicle " replaced.

4. In § 2.02 Z 2, the expression " Register Character " by the expression " Official marks " replaced.

5. § 6.29 Z 2 lit. d is:

" (d)

Vehicles according to Z 1 lit.b; "

6. § 11.05 Z 2 lit. a is:

" (a)

in the case of nationals, a passport or a passport; "

7. § 11.05 Z 2 lit. b sublit. aa is:

" (aa)

a passport or a passer-set; "

8. § 11.09 Z 5 reads:

" 5.

In so far as this does not affect the fulfilment of the conditions set out in Z 2, the Authority may, on a case-by-case basis, for events, rehearsals and exercises of shipping-related restrictions which are made known by shipping signs. or by means of regulations pursuant to § 16 (1) and (2) or Article 17 (1), and to the provisions of this Regulation concerning:

a)

the obligations of the ship ' s guide, crew and other persons on board;

b)

the use of the waterway;

c)

Requirements for vehicles;

d)

Ship surfers;

e)

the characteristics of the vehicles;

f)

the name of the vehicles;

g)

the driving rules;

h)

the rules for the standstill;

h)

shipping operations;

i)

the use of floating bodies;

j)

water-skiing and similar sports;

k)

the limitations of bathing, swimming and sports diving;

l)

the regulation of shipping in the Vienna Danube Canal;

m)

the traffic in the port and

n)

the use of the stairways

Allow exceptions.

9. In Annex 14, the text of "Application for authorization ..." to "... vote" replaced by:

" Application for the approval of an event on waterways

in accordance with § 18 of the Maritime Law, BGBl. I n ° 62/1997, as amended and § § 1.23 and 11.09 of the Waterways Traffic Regulations (WVO), BGBl. II No 289/2011 in the current version

In order to enable the Authority to comply with its obligation to give residents or other users of the waterway an adequate opportunity to comment on the event, the application is subject to the provisions of § 11.09 Z 1 of the WVO. no later than 6 weeks before to submit the scheduled date of the event. If this deadline falls below this deadline, the applicant has to request in accordance with § 11.09 Z 4 WVO the opinions of the bodies to which the opinion is to be given in accordance with Z 3, and to submit the opinion to the Authority.

It will in addition recommended that the planned course of the event be coordinated with the local shipping authority (http://www.bmvit.gv.at/verkehr/schifffahrt/binnen/aut/schifffahrtsaufsicht.html) before the application has been submitted. "

10. In Annex 14, the checklist shall be replaced by:

15. Exceptions to the provisions of the WVO for the identification of the vehicles (§ § 2.01 and 2.02) are required (e.g. racing boats without approval)

16. The marking of vehicles (§ § 2.01 and 2.02) is to be changed for the duration of the event (e.g. for film shooting)

17. Exceptions to the rules of the WVO (§ § 6.01 to 6.37 and 16.01 to 16.05) are required

18. Exceptions to the provisions for waterskiing (§ § 6.35 and 16.03) are required (for example, simultaneous towing of more than 2 persons)

19. Exceptions to the regulations for swimming, swimming and sports diving (§ § 6.37 and 16.04) are required

20. In the course of the event, swimming bodies (rafts, sailing boards, waterbikes or similar personal watercrafts such as zB) will be held. Jetski, amphibious vehicles and other mobile constructions, assemblies or objects with or without machine drive) used

NOTE: Only objects that are moved during the event are to be regarded as "floating bodies"-for example, fixed pontoons for zB, see point 26.

21. Sailing vehicles with a water displacement of more than 250 kg are used without a sufficient machine drive for the safe maneuvering.

Article 2

The regulation of the Federal Minister of Public Economy and Transport on a shipping traffic order for rivers and lakes, BGBl. No 42/1990, as last amended by BGBl. II No 237/1999, shall be amended as follows:

§ 64 reads as follows:

" Events

§ 64. (1) water sports events, water festivals and other events, in particular those which may lead to a collection of vehicles or floats or which may impede or endanger shipping, and those with such events Samples and exercises are subject to official authorization.

(2) The authorization referred to in paragraph 1 shall be granted where appropriate measures are taken to ensure the safety of navigation and of persons, the protection of the air or the waters against pollution, the protection of banks and installations, and the regulatory and regulatory framework. the name of the vehicles;

7.

the driving rules;

8.

the rules for the standstill;

10.

the behaviour of the storm warning;

11.

water-skiing and similar activities;

12.

the limitations of bathing, swimming and sports diving;

13.

the protection of the uferzone and

14.

the traffic in the port
