90. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the setting of conditions for quality wines typical of the region with origin profiles for the Neusiedlersee wine-growing region (DAC Regulation "Neusiedlersee")

Due to § 34 (1) of the Wine Act 2009, BGBl. I n ° 111, as last amended by the Federal Law BGBl. I No 111/2010, shall be ordered:

§ 1. The political district of Neusiedl am See, with the exception of the municipalities of Winden and Jois, forms the wine-growing area of Neusiedlersee.

§ 2. Wine may be placed on the market under the name "DAC" or "Districtus Austriae Controllatus" in connection with the indication of the Neusiedlersee wine-growing region, if it meets the requirements for quality wine of specified regions and the following Requirements are:

The wine must have been prepared exclusively from grapes harvested in the Neusiedlersee wine-growing region.

2.

The indication of the brand name, the vine variety or a smaller geographical unit than the wine-growing region must be made in such a way that it is subordinated to the indication "Neusiedlersee".

3.

The indication of a further traffic description shall be prohibited (in particular, traffic names such as "quality wine", "cabinet" or "late harvest"). The designations "DAC" or "Districtus Austriae Controllatus" shall be indicated on the label in direct connection with the wine-growing area of Neusiedlersee and in written signs which are significantly smaller than those for the indication "Neusiedlersee" used.

As a further wine-growing area, "Burgenland" may be indicated in characters which are smaller than those used for the indication "Neusiedlersee".

The wine may only be delivered in glass bottles to the consumer, unless it is to be immediately enjoyed at the place of administration. In the case of delivery in glass bottles, only nominal volumes, which are a part or a multiple of 0.75l, are permissible. In addition, the bottling of the wine in 5-liter bottles is allowed.

6.

The indication of the harvest year is compulsory.

7.

The content of unfermented sugar shall not exceed 4.0 grams per litre.

8.

"Neusiedlersee DAC" can be placed on the market under one of the following two categories:

a)

"Neusiedlersee DAC":

-

Grape variety: Zweigelt, a recording-harmless section must be tolerated;

-

Taste: typical, fruity, spicy;

-

Colour: covered strong red;

-

Odour: typical varietal bukett;

-

Extension: in the wooden barrel or steel tank;

-

the actual alcoholic strength shall be indicated at a minimum of 12.0% on the label;

-

the indication of a name of a Riedendesignation is not permitted;

-

the indication of the vine variety shall be compulsory;

-

the wine shall not be delivered to the consumer prior to 1 March of the year following the harvest. The application for obtaining the state test number may be submitted from 1 February of the year following the harvest.

b)

"Neusiedlersee DAC Reserve":

-

Pure-care Zweigelt (a laborious cut is to be tolerated) or Zweigelt-dominated Cuvée. In this case, the two-component part must be at least 60% and, in addition, only autochthonous grape varieties may be used;

-

Taste: typical, fruity, spicy, strong;

-

Colour: covered strong red;

-

Odour: typical varietal bukett;

-

Extension: in the traditional large wooden barrel or barrique;

-

the actual alcoholic strength by volume shall be indicated by at least 13.0% vol. on the label;

-

the wine must not be delivered to the consumer before 1 March of the second year following the harvest. The application for obtaining the state test number can be made from 1 February of the second year following the harvest.

The date for the placing on the market and the application for obtaining the state test number may be made on the basis of special conditions of the vintage or as a result of the market situation, the Regional Wine Committee Burgenland changes. The National Wine Committee is to be informed immediately.

The state test number issued for a wine with the name "Neusiedlersee DAC" may only be used for the placing on the market of the wine tested under the name "Neusiedlersee DAC".

In the Federal Office of Viticulture, the Federal Office for Viticulture is responsible for the tasting of the national test number for wine with the sales designation "Neusiedlersee DAC" ("Neusiedlersee DAC"). All the co-esters of the official cost commission must have been trained by the Regional Wine Committee of Burgenland with regard to the evaluation of the typical taste profile of "Neusiedlersee DAC".

Wine with the sales designation "Neusiedlersee DAC" may only be transported with a state test number for "Neusiedlersee DAC". The same applies to all the carving parts of a wine with the traffic name "Neusiedlersee DAC", which is produced by cutting a number of partial quantities. The test number shall be indicated on the invoice, delivery note or other business documents.

§ 3. Wines with the trade name "Neusiedlersee DAC" are to be produced and bottled in the Neusiedlersee wine-growing region. A production or Bottling outside the area may only be carried out with the approval of the Regional Wine Committee Burgenland. Such authorisation may be granted, in particular, if the vineyard of the manufacturer is situated in the Neusiedlersee area and the manufacture of the wine is carried out on an operation of the manufacturer outside the territory or if: Land contracts exist between a manufacturer with an establishment outside the Neusiedlersee lake and owners of vineyards in the Neusiedlersee area. The place of provenance, land number (s) and area (s) shall be shown on the invoices, delivery notes and transport documents to be paid.

§ 4. Anyone intending to submit an application for a state test number for a wine with the name "Neusiedlersee DAC" has to inform the Regional Wine Committee Burgenland in writing (also e-mail or fax).

§ 5. Wine with the name "Neusiedlersee DAC" may only be given if the bottle is marked with a specific marking, the appearance and form of which the regional wine committee of Burgenland defines and in one of the transport routes published specialist publication. This marking can only be obtained with the appropriate authorization of the Regional Wine Committee Burgenland. This Committee shall determine the amount of the amount to be raised by the Committee in the context of the issuing of authorisation and the publication of the amount of the amount in a specialist publication suitable for this purpose and disseminated in the transport travel. . The funds thus acquired are to be used, after deduction of administrative costs, for the implementation of measures to improve the knowledge and transparency of wine with the name 'Neusiedlersee DAC' ('Neusiedlersee DAC ').

§ 6. This Regulation shall apply to wine from the 2011 vintage. Quality wines up to and including the vintage 2011 may continue to be placed on the market, subject to compliance with the existing labelling requirements.
