147. Regulation of the Federal Minister for Economic Affairs, Family and Youth, with which the Regulation on the automated operation of steam boilers-ABD-V is adopted and the Regulation on the establishment and operation of steam boilers is amended

Article 1

Regulation of the Federal Minister for Economic Affairs, Family and Youth on the automated operation of steam boilers-ABD-V

Due to § 10 paragraph 1 Z 3 of the Kesselgesetz, BGBl. No 211/1992, as last amended by BGBl. I n ° 80/2007, as well as § 5 (2) of the Steam boiler operating law-DKBG, BGBl. No 212/1992, as last amended by BGBl. I n ° 96/2009:

Scope

§ 1. (1) This Regulation shall apply to fixed steam boilers operated in a fixed-place manner and shall be regulated by

1.

the operation of steam boilers without permanent supervision,

2.

the operation of steam boilers by means of remote monitoring and

3.

requirements for the water quality of steam boilers and boiler water.

(2) For steam boilers with low risk potential according to § 5 (1) of the Pressure Equipment Monitoring Ordinance-DGÜW-V, BGBl. II No 420/2004, only the provisions of § § 2, 3 (1) Z 6, 3 (2), 5 and 8 and 6 (1) apply.

(3) This Regulation shall not apply to steam boilers with a low risk potential in accordance with Article 5 (8) DGÜW-V, in which the safety of the device during operation is given in the course of its design for the intended operation and the operating mode.

Definitions

§ 2. (1) Operations without permanent supervision (BosB): automated operation of steam boilers, which necessitates periodic monitoring of the function of the safety system by means of steam boiler warders at the place of installation of the boiler. In this mode of operation, the steam boiler heater does not have to be constantly at the site of the steam boiler.

(2) Remote monitoring: the operation by means of remote monitoring is a mode of operation in which the boiler is constantly kept at a defined location separated from the site of the boiler; the steam boiler warms the intervention in However, the mode of operation of the steam boiler is at all times possible to ensure the monitoring of the boiler operation and the maintenance of the safe condition.

(3) Boiler protection system: all equipment, equipment and safety-related electrical, electronic and programmable electronic systems that keep the boiler within permissible limits.

(4) Persons knowledgeable: persons who are in a position to assess the functional safety of the boiler protection system or the water treatment on the basis of their training and experience, and with those for the boiler protection system or the water treatment system relevant regulations, rules of technology and manufacturer's instructions for assembly, maintenance and operation.

Operation of steam boilers without permanent oversight (BosB)

§ 3. (1) The operation of steam boilers without permanent supervision shall be permitted for all those steam boilers which meet all the following requirements:

1.

The operation is carried out with automatic heating.

2.

Automatic heating can only be in operation if all boiler protection systems are in operation.

3.

Equipment with safety function (limiter) according to § 2 para. 1 Z 3 of the Pressure Equipment Ordinance-DGMO, BGBl. II No 426/1999, as amended, the steam boilers are automatically kept within the permitted limits (e.g. Temperature, pressure, water level, feedwater quality, flow rate).

4.

If the permissible limits are not complied with, the steam boilers are transferred to a safe state by the triggering of an appropriate, automatically controlled operation or are switched off.

5.

After the heating has been switched off, the secondary heat is reliably removed without human intervention (evaporation safety).

6.

The safety of evaporation shall be in accordance with the provisions of Appendix 1 In the case of steam boilers in accordance with Article 1 (2), the evidence submitted by the manufacturer on the safety of the vapour is sufficient.

7.

After a safety shutdown, the heating cannot automatically start again, but must be unlocked on site.

(2) The boiler protection systems of the steam boilers referred to in paragraph 1 shall be subject to the following functional tests during operation:

1.

Functional tests of all delimiters shall be carried out during start-up and at periodic intervals (iS of para. 3 and 4). The periodic function test includes an examination of the permissible safety-relevant values such as temperature, pressure, water level level, flow rate as well as the functional testing of the fuel supply. The function test must be carried out at any time and must be free of feedback on other safety devices.

The quality of the water supply and boiler water shall be checked by a competent expert who is familiar with the water treatment at least every three days after the manufacturer's instructions and after prior consultation with the boiler inspection post. This review also includes the quality of additional feed-in (e.g. Condensate). This provision can also be fulfilled through continuous monitoring of water quality.

The result of each delimiter test must be clearly visible to the steam boiler heater.

(3) Proof of periodic function tests shall be provided either by:

1.

forcibly checking with safe time-monitoring or

2.

automatic recording and logging of the audit operations carried out, or

3.

a combination of the possibilities mentioned above

, If a 72-hour continuous operation took place without checking the function test by the steam boiler heater, the steam boiler must automatically and safely switch off after two further hours with fault message at the latest.

(4) As an alternative to paragraph 3, a monthly functional test by physical triggering (operating start-up) of the switching points of the delimiters referred to in paragraph 2 Z 1 with a safety shutdown is permissible.

(5) In the case of steam boilers in accordance with Article 1 (2), the functional tests of the boiler protection systems according to paragraph 2 shall be carried out according to the manufacturer's instructions.

(6) If the result of the function test is negative, the heating is to be switched off and locked.

(7) The results of the function tests shall be documented in the operating book (§ 5).

(8) Changes to the setting of safety devices after commissioning are for steam boilers, with the exception of those according to § 1 (2), after a previous demonstrable vote with a notified body pursuant to § 20 (1) of the DGMO (DGMO) with appropriate accreditation scope; for steam boilers in accordance with § 1 para. 2, this shall be allowed after a prior demonstrable vote with the manufacturer. The safety devices shall be protected against unauthorised changes.

(9) The equipment of the installation space must meet the requirements of the Appendix 1 Z 2.

(10) More detailed rules on the operation of steam boilers without permanent supervision shall be provided in Appendix 1 Z 3.

Operation of steam boilers with remote monitoring

§ 4. (1) The remote monitoring of steam boilers shall, in accordance with Appendix 2 shall be made.

(2) The equipment components used for this purpose with safety function and the pressure-maintaining equipment parts as well as the assemblies formed therewith have to correspond to the DGMO.

Operating Book

§ 5. (1) For each steam boiler, an operating book shall be carried out in which the following entries shall be made:

1.

Confirmation of an expert on the maintenance and examination work at the security institutions,

2.

the assessment of the regular operational water tests by the steam boiler and its audit opinion on the performance tests and controls carried out; and

3.

all faults as well as special findings on the occasion of the testing and maintenance work.

(2) The operating book shall be submitted to the boiler auditor in the case of recurrent investigations.

(3) The operation of the operating book can be carried out in any suitable reproducible, tamper-proof form. In the case of electronic management of the operating book, electronically secured signatures shall be used.

Feed and boiler water

§ 6. (1) Steam boilers may only be operated with a water supply and boiler water suitable for use in accordance with the type of boiler, the highest operating pressure fixed and the operating conditions.

(2) The water supply and boiler water shall be reviewed and assessed by an expert at least half a year. The records to be recorded shall be reviewed by the boiler or auditor's office in the context of the periodic external investigations.

Linguistic equality

§ 7. The gender-specific terms and terms used in this Regulation (steam boiler, expert, boiler tester) each include the male and female form.

Transitional provisions

§ 8. (1) Before the entry into force of this Regulation, steam boilers which are legally in operation and which comply with the DGMO may, as a choice, be authorised in accordance with the provisions of the present Regulation or of the Regulation on the establishment and operation of Steam boilers-ABV, BGBl. No 353/1995. The choice of the further mode of operation shall be entered in the operating book.

(2) Steam boilers which have been lawfully put into service in accordance with § 25 of the DGMO may continue to be operated in accordance with the provisions of the ABV. If such steam boilers are shown to have the same level of safety as those provided for in this Regulation, such boilers may continue to be operated in accordance with the provisions of this Regulation. The fulfilment of the requirement for the same security shall be assessed by a notified body with relevant accreditation. This evaluation and the choice of the other mode of operation shall be entered in the operating book.

Article 2

Amendment of the Regulation on the establishment and operation of steam boilers-ABV

The regulation of the Federal Minister for Economic Affairs on the establishment and operation of steam boilers-ABV, BGBl. No 353/1995, shall be amended as follows:

1. § 11 together with headline reads:

" Transitional provision

§ 11. The provisions of § 1 (1) (1) to (4) and § § 3 to 7 are applicable to steam boilers, which after the entry into force of the regulation of the Federal Minister for Economic Affairs, Family and Youth on the automated operation of steam boilers-ABD-V, BGBl. II No 147/2012, which are to be legally put into service. "

2. § 12 together with the title shall be deleted.
