83. Revelation of the Federal Chancellor concerning the scope of the Convention on the Rights of Persons with Disabilities, as well as the Optional Protocol to the Convention on the Rights of Persons with Disabilities

On the occasion of the deposit of the instrument of ratification, Cyprus has declared the following caveat:

While the Law on the Rights of Persons with Disabilities has been brought into line with Council Directive 2000 /78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation, in its Paragraph 3a stipulates that the law on employment shall not apply to:

(a)

the armed forces, to the extent to which the nature of employment requires special skills which cannot be carried out by persons with disabilities; and

(b)

professional activities in which, on the basis of the nature or the conditions of their implementation, a special feature or ability which a person with a disability does not have, constitutes an essential and decisive professional requirement, provided that: The objective is legitimate and the requirement is appropriate, taking into account the possible adoption of reasonable measures;

Declares the Republic of Cyprus that it has ratified the Convention with reservation relating to Article 27 (1) of the Convention to the extent to which its provisions are contrary to the provisions of paragraph 3a of the Law on the Rights of the of people with disabilities.

According to other communications from the Secretary-General of the United Nations, the following states have their own on the occasion of the deposit of the instruments of ratification. The reservations and declarations made in full or in part withdrawn:

Mexico:

3. In January 2012, Mexico announced that it had made the interpretative statement issued on the occasion of the deposit of its instrument of ratification. 1 is completely retractable.

United Kingdom:

On 21 December 2011, the United Kingdom announced that it had made the reservation made on the occasion of the deposit of the instrument of ratification. 2 on Article 12 (4).
