76. Federal Law, amending the General Social Security Act, the Industrial Social Security Act, the Farmers-Social Insurance Act, the Pension Act 1965, the Federal Theatres Act and the Federal Railways Pension Act

The National Council has decided:

Article 1

Amendment of the General Social Insurance Act

The General Social Security Act, BGBl. No. 189/1955, as last amended by the Federal Law BGBl. I No 35/2012, shall be amended as follows:

.. In accordance with § 666, the following § 667 shall be added together with the heading:

" Special pension adjustment

§ 667. All guesthouses, which are on the 1. At this point in time, the factor 1.011 is to be multiplied by a factor of 1.011 at this point in time, if:

1.		their date of reference (section 223 (2)) before 1. Jänner 2007,
2.		their height on 1. Jänner 2008 has not reached the amount of 747 € and
3.		they were only multiplied by the adjustment factor for 2008.

By way of derogation from Z 1, for the multiplication of survivors ' pensions, which are derived from an already recognized performance, the reference date of this benefit shall be the decisive factor. "

Article 2

Amendment of the Industrial Social Insurance Act

The Industrial Social Security Act, BGBl. No 560/1978, as last amended by the Federal Law BGBl. I No 35/2012, shall be amended as follows:

.. In accordance with § 345, the following § 346 and heading is added:

" Special pension adjustment

§ 346. All guesthouses, which are on the 1. At this point in time, the factor 1.011 is to be multiplied by a factor of 1.011 at this point in time, if:

1.		their date (section 113 (2)) before 1. Jänner 2007,
2.		their height on 1. Jänner 2008 has not reached the amount of 747 € and
3.		they were only multiplied by the adjustment factor for 2008.

Article 3

Amendment of the Farmers-Social Security Act

The farmers social security law, BGBl. N ° 559/1978, as last amended by the Federal Law BGBl. I No 35/2012, shall be amended as follows:

.. In accordance with § 335, the following § 336 is added together with the title:

" Special pension adjustment

§ 336. All guesthouses, which are on the 1. At this point in time, the factor 1.011 is to be multiplied by a factor of 1.011 at this point in time, if:

1.		their date (section 104 (2)) before 1. Jänner 2007,
2.		their height on 1. Jänner 2008 has not reached the amount of 747 € and
3.		they were only multiplied by the adjustment factor for 2008.

Article 4

Amendment of the Pension Act 1965

The Pension Act 1965, BGBl. N ° 340, as last amended by the Federal Law BGBl. I No 35/2012, shall be amended as follows:

1. According to Article 17, Section 2f, the following paragraph 2g is inserted:

" (2g) The child of a deceased official or a deceased official, that is the 18. The child shall be entitled to a monthly orphan's pension if and as long as the child is a participant in the volunteer social year, the volunteer environmental year, the memorial service or the peace and social service. is active abroad, until the completion of the 27. 2. In accordance with § 95b, the following § 95c with headline is inserted:

" Special pension adjustment

§ 95c. § 667 ASVG is to be applied in a reasonable way. "

(3) The following paragraph 72 is added to § 109:

" (72) § 17 para. 2g in the version of the Federal Law BGBl. I n ° 76/2012 will enter into force with 1 June 2012. "

Article 5

Amendment of the Federal Theatterpensionsgesetz

The Federal Theatre Pensions Act, BGBl. No 159/1958, as last amended by the Federal Law BGBl. I No 35/2012, shall be amended as follows:

.. The following paragraph 3 is added to Article 11:

"(3) § 667 ASVG shall be applied mutasensitily."

Article 6

Amendment of the Bundesbahn-Pension Act

The Federal Railways Pension Act, BGBl. No 86/2001, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I No 35/2012, shall be amended as follows:

1. According to Article 16 (8), the following paragraph 8a is inserted:

" (8a) The child of a deceased official or of a deceased official, the 18.
