277. Regulation of the Federal Minister of Transport, Innovation and Technology, amending the Regulation of the Federal Minister for Science and Transport on the Carriage of Dangerous Goods

On the basis of § § 10, 11, 14, and 33 of the Dangerous Goods Transport Act, BGBl. I No 145/1998, as amended by the BGBl version. I No 50/2012 shall be assigned:

The Regulation of the Federal Minister of Science and Transport on the Carriage of Dangerous Goods (GGBV), BGBl. II No 303/1999, as amended by the BGBl version. II No 214/2005 is hereby amended as follows:

2. In § 10 (2) (2) (2) last sentence, the word order is deleted "as well as documents according to § 6 Z 2" .

Section 17 (1) reads as follows:

" (1) The curricula and timetables to be attached to applications for recognition within the framework of the required documents shall have at least the following dates of time (UE = teaching units of 45 minutes in principle):

1.

Initial training

a)

Base Course

18 UE theory and 1 UE practical exercises,

b)

Build-up course Tank

12 UE theory and 1 UE practical exercises,

c)

Built-up Course Class 1

8 UE theory,

d)

Built-up Course Class 7

8 UE theory;

2.

The duration of the refresher training, including the practical exercises, shall be at least 16 UE in the case of multi-purpose courses and at least half the duration of the individual courses provided for the corresponding initial training. "

4. In § 17 (2) the word order is deleted " , of which 3 UE theory and 1 UE practical exercises, " .

5. In Section 17 (3), the word order shall be deleted " , of which 7 UE theory and 1 UE practical exercises, " .

6. § 22 (5) reads:

" (5) The organizer shall keep the directories in accordance with paragraph 4 as well as the written examinations and records according to § 23a for at least seven years and, insofar as this is provided for in § 14 GGBG, without a request in the prescribed To submit, otherwise, on request. If the recognition is granted, the documents referred to above shall be sent to the Governor of the State without a request for the deposit for inspection purposes and for the issue of duplicates of the certificates referred to in § 23. Section 23a is added to the following paragraph 4:

§ 23b and headline reads:

" Examinations after refresher training

§ 23b. After completion of the refresher training, an examination shall be carried out in accordance with the procedure laid down in § 23a of the following:

1.

for the basic course 15 questions, where the achievable maximum number of points is 60 points and the duration of the test is 30 minutes, and

2.

10 questions for each advanced course, the achievable maximum number of points being 40 points and the duration of the test being 20 minutes. "

10. § 25 together with the title is:

" Teaching Staff

§ 25. If the provisions under § 2 (1) to (3) of the GGBG (GGBG) provide for the training of personnel who are not specially regulated as training of dangerous goods officers, dangerous goods guides and experts, this instruction may only be provided by the competent authorities of the companies concerned or under the supervision of those undertakings, or by teaching staff who have the qualifications required for the above-mentioned particularly regulated training for the relevant Transport modes are required. "

11. § 26 together with headline reads:

" Documentation

§ 26. The documentation of instructions in accordance with § 25, provided for in § 2 Z 1 to 3 of the GGBG, shall be kept for at least five years from the date of the instruction. "

12. In § 34 (4), the "Directories referred to in paragraph 3" the phrase "as well as the written examinations and records according to § 36 (5)" inserted.

The following paragraph 5 shall be added to § 36:

"(5) If the written examination is supplemented by oral questions, the organiser shall have written records of the questions and the assessment of the answers."

14. § 38 (4) reads:

" (4) The training courses may only be carried out in the course of courses recognised in accordance with § 33 of the German Federal Law Gazette (GGBG). This recognition shall be deemed to have been granted for training courses which:

1.

as part of an operator's training programme for the training of their personnel or of the personnel of companies acting on their behalf, in accordance with the Air Transport Operator's Certificate Regulation 2008 (AOCV 2008), BGBl. II No 254/2008, as amended in each case, or

2.

from a training permit according to § 46 Aviation Act (LFG), BGBl. No 253/1957, as amended. '

15. § 45 (4) and (5) reads:

" (4) The organiser shall keep the lists in accordance with paragraph 3 for a period of at least four years and shall, on request, submit to the authority which has issued the notification of its recognition.

(5) The organiser shall provide information on the date and place of training as soon as possible after it has been established by the authority which has issued the notification of its recognition. It may at any time carry out unannounced training checks to ensure that the conditions for granting recognition continue to be met and that the training is based on recognition and in accordance with the applicable rules. Regulations are to be implemented. "

16. § 50 together with headline reads:

" Reference to Directives

§ 50. This Regulation lays down Directive 2010 /61/EU on the first adaptation of the Annexes to Directive 2008 /68/EC of the European Parliament and of the Council on the inland transport of dangerous goods to scientific and technical Progress, OJ No. OJ L 233, 03.09.2010 p. 27, transposed into Austrian law. "

17. The previous § 50 with headline reads:
