338. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management with regard to information on personnel costs and controlling in the field of agricultural and forestry national teachers and national teachers (Lf-LandeslehrPersons-ControllingV-LfLLCV)

On the basis of § 4 (7) of the Financial Equalization Act 2008, BGBl. I n ° 103/2007, as last amended by the Federal Law BGBl. I n ° 82/2012, is to be assigned in agreement with the Federal Minister for Finance:

Section 1

General provisions

Scope

§ 1. This Regulation contains more detailed provisions on controlling in respect of staff expenditure on agricultural and forestry vocational and technical schools in accordance with § 4 of the 2008 Finance Equalisation Act.

Definitions

§ 2. (1) For the purposes of this Regulation, the following shall be understood:

1.

under full employment: employment at the level of the respective use and/or Remuneration group and taking into account the service and remuneration status, including the salary to be applied to the person concerned, or The level of teaching commitment of 20 hours per week is reached;

2.

under full employment equivalent (VBÄ): the percentage of employment as a percentage divided by 100%, the sum of the employment dimensions of a plan job percentage divided by 100.

3.

under multi-service performance:

a)

Every lesson in accordance with Section 61 (1) (1) (1) or (12) of the salary law 1956 (GehG), BGBl. No. 54, in conjunction with Section 114 (1) (1) (1) of the Land and Forest Law Teachers Service Law-LLDG 1985, Federal Law Gazette (BGBl). No 296/1985, or pursuant to Section 61 (1) (1) (1) or (12) of the Act in conjunction with Section 45 of the Contract Law Act 1948 (VBG), Federal Law Gazette (BGBl). No. 86, in conjunction with Section 1 (1) (1) (lit). a of the Land-and forestry-State Contract Teasers Act-LLVG, BGBl. No 244/1969, as well as periods to be included in the teaching obligation as educational activities in accordance with § 60 LLDG 1985, provided that the teaching hour or the educational activities of the Land and forestry teachers are remunerated. (permanent multi-service);

b)

Each lesson in accordance with Section 61 (8) or (12) of the Act in conjunction with Section 114 (1) LLDG 1985, or in accordance with Section 61 (8) or (12) of the Act in conjunction with Section 45 of the VBG in conjunction with Section 1 (1) (lit). a LLVG, for which the national teacher is paid a remuneration (single service).

(2) Other terms and conditions of service and remuneration are in accordance with the relevant provisions referred to in the Appendix, in particular in accordance with the provisions of LLDG 1985, the GehG, the LLVG, the VBG, the Land and the Land. forsteconomics private school law, BGBl. No 318/1975, the 1977 Unemployment Insurance Act, BGBl. No. 609 (WV), the maternity protection act 1979-MSchG, BGBl. N ° 221 (WV), the travel fee rule 1955, BGBl. N ° 133 and the Federal Personnel Representation Act, BGBl. No. 133/1967.

Section 2

Data collection

Data transmission, survey dates and reporting dates

§ 3. (1) The Länder have the Federal Minister for Agriculture, Forestry, Environment and Water Management the data in the presentation according to the Annex to be transmitted electronically in such a way that a data record corresponds to a person (anonymized individual data sets). In the case of transmission, the data format provided for in the installation shall be used.

(2) The survey date shall be the last day of each month. The data collected at the respective survey date must be transmitted at the latest on the tenth day of the second following month.

(3) Prior to the transmission of the data, all necessary edits must be carried out in the data collection to ensure the accuracy of the data.

Information rights and obligations of the countries

§ 4. (1) Each country has the right to inspect the data transmitted by the Federal Minister for Agriculture, Forestry, the Environment and Water Management for free of charge and for the purposes of the data transmitted by the Federal Minister for Agriculture, Forestry, Environment and Water Management. § 4 of the Financial Equalization Act 2008.

(2) At the request of the Federal Minister for Agriculture, Forestry, the Environment and Water Management, the respective country shall immediately, in any case within six weeks, explain the data transmitted, in the event of incomplete transmission of the data provided by the Federal Minister for Agriculture, Forestry, Environment and Water Management. Control

Comparison of the establishment plans with the data collected

§ 5. (1) As a basis for the control of personnel expenditure on agricultural and forestry vocational and technical schools in each country, the Federal Minister for Agriculture, Forestry, the Environment and Water Management is in agreement with the Federal Minister of Finance in accordance with Art. IV (2) and (3) of the Federal Constitutional Law BGBl. No 316/1975 approved establishment plan.

(2) The data transmitted in accordance with § 3 shall be for information of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the staff expenditure at agricultural and forestry vocational and technical schools, and in particular on in order to be able to compare the approved establishment plan of each country with the actual circumstances.

Section 4

Final provisions

The validity and effectiveness of other legislation

§ 6. Where other legislation is referred to in this Regulation, they shall be applied in the version applicable to the entry into force of this Regulation.

Transitional provisions

§ 7. If, for technical reasons, it is not possible to establish the conditions for the electronic data transmission in accordance with § 3 in connection with the system for all fields until the entry into force of this Regulation, the Federal Minister for Land and Forestry, the environment and water management, in agreement with the Federal Minister of Finance, provide forms for the transmission of data for the fields for which electronic transmission is not yet possible, until such time as the Full technical implementation has been carried out in all countries. In this case, the relevant data may be transmitted using the forms.
