339. Regulation of the Federal Minister of Health, which extends the ban on the placing on the market of genetically modified potato products (Solanum tuberosum L. line EH92-527-1) for three years for the purpose of cultivation in Austria

On the basis of § 60 (1) of the German Genetic Engineering Act-GTG, BGBl. N ° 510/1994, as last amended by the Federal Law BGBl. I n ° 13/2006 and by the Federal Ministries Act of 2009, Federal Law Gazette (BGBl). I No 3/2009, shall be ordered:

§ 1. The placing on the market of products consisting of or containing GMOs for the purpose of cultivation in Austria shall be prohibited:

Potatoes/earth apples (Solanum tuberosum L), which were transformed to obtain a higher amylopectin content of starch by means of Agrobacterium tumefaciens using the vector pHoxwG to the line EH92-527-1 (BPS-25271-9). The product contains the following DNA sequences in two gencassettes:

a)

Gencassette 1:

A nptII gene derived from Tn5 which confers resistance to kanamycin, regulated by a nopaline synthase promoter for expression in plant tissue and terminated by a polyadenylation sequence of the Nopaline synthase gene from Agrobacterium tumefaciens.

b)

Gencassette 2:

A segment of the gbss gene of the potato/erdapfel, which codes for the starch synthase protein bound to granules, in antisense orientation, regulated by the gbss promoter isolated from the potato and terminated by a A polyadenylation sequence of the Nopaline synthase gene of Agrobacterium tumefaciens.

The specific identification marker of the product is: BPS-25271-9.

These products were manufactured by BASF Plant Science (formerly Amylogen HB) in accordance with Directive 2001 /18/EC on the deliberate release into the environment of genetically modified organisms and repealing Council Directive 90 /220/EEC, OJ L 206, 22.7.2001, p. No. 1., as last amended by Directive 2008 /27/EC, OJ L 106, 17.4.2008, p. No. 45., notified by the European Commission by Decision 2010 /135/EU concerning the placing on the market of a genetically modified potato product (Solanum tuberosum L. line EH92-527-1) with increased amylopectin content in the Strength according to Directive 2001 /18/EC of the European Parliament and of the Council, OJ L 106, 17.4.2001. No. 11 of 2 March 2010 and approved by the Swedish competent authority on 31 March 2010 for placing on the market for cultivation and for industrial purposes.

§ 2. The ban in accordance with § 1 also includes potatoes resulting from intersections of the genetically modified potato product (Solanum tuberosum L. line EH92-527-1) with other potato genotypes.

§ 3. This Regulation shall expire on the expiry of 30 November 2015.
