365. Regulation of the Broadcasting and Telekom Regulatory GmbH, which changes the number-transfer regulation 2012

On the basis of Section 23 (3) of the Federal Act, which enacted a Telecommunications Act (Telecommunication Act 2003-TKG 2003), BGBl. I n ° 70/2003, as amended by the BGBl version. I No 44/2014 shall be assigned:

The regulation of broadcasting and telecom regulation GmbH, which lays down provisions concerning the transmission of numbers between mobile telephone service providers (number transfer regulation 2012-NÜV 2012), BGBl. II No 48/2012, shall be amended as follows:

1. In accordance with § 1 Z 4, a line point shall be inserted and the following Z 5 and 6 shall be added:

" 5.		"Mobile VPN": a mobile virtual private network that logically aggregates different mobile connections;
6.		"Kopfrufnummer": a component of a national telephone number for the addressing of telecommunications terminal equipment, which are used exclusively for a switching function in the case of private network functions realized in mobile networks. "

2. According to Article 3 (1), the following paragraph 1a is inserted:

"(1a) The number transmission information shall be requested by the participant during an upright contractual relationship."

3. § 3 (2) reads:

" (2) The number transmission information shall be transmitted to the participant as follows:

1.		Personal handout or
2.		by e-mail to an e-mail address provided by the participant for this purpose, or
3.		electronically via an online portal or
4.		by fax or
5.		by mail.
The customer's request shall be taken into account in the choice of the type of transmission of the number transmission information. "

4. According to Article 3 (2), the following paragraph 2a is inserted:

" (2a) The number transmission information shall also be sent to the subscriber in the cases referred to in paragraph 2 (2) (1) and (Z) 3 to (5) by e-mail from the mobile telephone service provider in which the subscriber has requested the issuing of the number transmission information, to a shall be transmitted by the participant for this purpose to the e-mail address. "

5. § 3 (3) deleted.

6. § 3 (4) reads:

" (4) The request for the issuing of a number transmission information must be processed immediately. The issuing of the number transmission information shall be effected immediately within the respective business hours, but at the latest within a period of 20 minutes. The time limits mentioned shall begin with the applicant's application to the mobile telephone service provider or operator who is to be released. with the transmission of the subscriber's request from the potentially receiving to the mobile telephone service provider. In the case of delivery by post, the number transmission information shall be sent to the post office at the latest one working day after the application has been submitted. Samstage, 24 December and 31 December are not counted as working days. "

7. § 3 (5). is:

" (5) In the case of a request for a number transmission information of more than 25 connections, the respective number transmission information shall be no later than one working day after the application, with Saturdays, 24 December and 31 December not being used as working days. shall be sent in accordance with paragraphs 2 and 2a. '

8. In § 4, the following Z 3a is inserted after Z 3:

" 3a.		a clear indication that the participant does not incur any costs when using the extraordinary right of dismissal pursuant to section 25 (3) of the TKG 2003, "

9. In Section 5 (1) (1) (1), after the phrase "the number to be transmitted is" the phrase ", with the exception of paragraph 2 (2) (9)," inserted.

10. In Section 5 (1) Z 5, the point at the end of the sentence shall be replaced by an accent, and the following Z 6 shall be added:

" 6.		individual call numbers of a mobile VPN with a copy number are to be ported. "

(11) In § 5 (2) (7), the point at the end of the sentence shall be replaced by an accent and the following points 8 and 9 shall be added:

" 8.		in the case of the use of the extraordinary right of dismissal pursuant to section 25 (3) TKG 2003,
9.		the porting has been requested within 14 days of the end of the contract with the receiving mobile telephone service provider. "

12. § 11 together with the title is:

" Number Transfer by Contract End

§ 11. The number transfer shall also be carried out if the porting has been requested within 14 days of the end of the contract with the receiving mobile telephone service provider. "

13. § 13 together with the title is:

" Charges

§ 13. (1) For the number transmission information, a charge of a maximum of € 1,-(including all taxes and charges) may be charged per connection.

(1a) For the number transmission information, a charge of up to € 80,-(including all taxes and taxes) may be charged for all connections in the case of a port of more than 80 lines.

(2) A fee of no more than € 9,-(inclusive of all taxes and taxes) per connection may be charged by the porting participant for the transfer of the call numbers. This fee also includes the setting-up position of a new telephone number for the issuing mobile telephone service provider.

(2a) For the transmission of call numbers for more than 80 lines, the porting participant may charge a total charge of € 720,-(including all taxes and charges) for all connections. This fee also includes the provision of new telephone numbers to the losing mobile telephone service provider.

(3) Neither the mobile telephone service operator nor any third party whose mobile telephone service operator is serving to carry out the porting may not be charged a fee for the porting of a fee in excess of para. 1 to 2a for the porting.

(4) If the participant has the right in accordance with Section 25 (3) TKG 2003 to terminate the contract extraordinatly, no charge iSd (1) to (2a) may be charged. "

14. The previous § 17 receives the sales designation "(1)" and the following paragraph 2 is added:

" (2) The amendments to § 1 Z 4, 5 and 6, § 3 para. 1a to 5, § 4 Z 3a, § 5 paragraph 1 Z 1, 5 and 6, para. 2 Z 7, 8 and 9, § 11 including the title and § 13 together with the title in the version BGBl. II No. 365/2015 will enter into force on 1 March 2016. "
