370. Ordinance of the Federal Minister of Education and Women on the number of uses to be provided for contract staff in the Pedagogical Service in accordance with § 46a (7) VBG and § 19 (7) LVG

Pursuant to Section 46a (7) of the Law on Contract Law 1948-VBG, Federal Law Gazette (BGBl). No. 86/1948, and § 19 (7) of the Landescontractual lehrPersons Act 1966-LVG, BGBl. No. 172/1966, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I No 65/2015, shall be arranged:

Scope

§ 1. This Regulation shall apply to those in the School Organization Law-SchOG, BGBl. No. 242/1962, in the version of the Federal Law BGBl. I n ° 104/2015, regulated public schools as well as private schools with the guidance of a legally regulated school type designation.

Use as an educational counsellor or as an educational advisor

§ 2. (1) The special function Education Counseling with an educational counsellor or an educational counsellor is set up for the middle and higher schools as well as for the practice schools for the New Middle Schools.

(2) In addition, further education advisors will be provided at the middle and higher schools to the following extent:

1.		another educational adviser, or another educational counsellor, in schools with 476 to 1 000 pupils,
2.		two other education advisors in schools with 1 001 to 1 600 pupils,
3.		three other educating counsellors in schools with 1 601 to 2 300 pupils, including 2 300 pupils,
4.		four other educational counsellors in schools with 2 301 to 3 000 pupils, and
5.		five other educating counsellors in schools with more than 3 000 pupils.

(3) Where vocational education and training schools are incorporated into vocational higher education schools in accordance with Article 54 (2) of the SchOG, the entire teaching institution shall be deemed to be a school for the application of paragraph 2.

(4) The educational adviser provided for a practice school for the Neue Mittelschule in accordance with paragraph 1 of this Article shall not be ordered if a teacher who is not subject to the remuneration scheme pd the function of a teacher Pupil/internal counsellor (§ 59b paragraph 4 of the salary act 1956-GehG, BGBl. No 54/1956, or § 41 (2) of the VBG).

(5) The maximum number of educational counsellors intended for a medium or higher school is reduced by the amount of allowances pursuant to Article 2 (1) (1) (1) and (2) of the Regulation of the Federal Minister for Education, Arts and Culture in accordance with Section 61b (3) of the salary law in 1956, BGBl. II No 324/2001, appointed educational counsellors or educational advisers. In this case, the first sentence of the BGBl Regulation shall be reduced for each of the 100 vH of the monthly remuneration in accordance with paragraph 1 of the first sentence. II No 324/2001 on remunerated education advisors or in schools with a number of pupils up to and including 475 pupils, educational advisors or counsellors ordered the number of pupils to be paid Educational advisors and educational advisors for one person each. A fraction of the activity of an educational adviser or an educational adviser of less than 100 vH of the monthly remuneration according to the first sentence of the first sentence of the BGBl Regulation, in accordance with the aforementioned provision. II No 324/2001 shall be included.

Use as a pupil/internal consultant or as a pupil/internal consultant

§ 3. (1) The special function pupil/internal counselor with a student or a student is set up for the new middle schools, for the fifth to ninth grade of the special schools, for the polytechnic schools as well as for vocational schools. For schools with more than 475 students, another student may be ordered or another student can be appointed. For vocational schools, the number of 475 pupils is replaced by the number 1 175.

(2) In the case of the joint management of several schools and classes of the same or of another type of schooling, which have been carried out in the framework of the statutory provisions on the organisation of the school, they are intended to be used for the purposes of: Pupils of the schools referred to in paragraph 1 shall be counted among the pupils and pupils of the school.

(3) The maximum number of pupils who may be appointed according to para. 1 and 2 shall be reduced by not subject to the remuneration scheme pd with the function of a pupil or a student. Pupils/inner counsellors (§ 59b Abs. 4 bis 6 GehG resp. Section 41 (2) of the VBG).

Use as a career guidance coordinator or as a career guidance coordinator

§ 4. The special function Vocational orientation coordination with a career guidance coordinator or a career guidance coordinator is set up for the lower level of the generally forming higher schools, for the New Middle Schools as well as for the fifth to eighth school levels of the special schools. In the case of the joint management of several schools within the framework of the statutory provisions on education and training, only one career guidance coordinator or one career guidance coordinator is due for the several schools. For the seventh and eighth school levels, a total of more than 125 school pupils will be provided with a further career guidance coordinator or another career guidance coordinator. For the seventh and eighth school level, a total of more than 250 school pupils will be provided with two other career guidance coordinators, or two other career guidance coordinators.

Use as a learning designer or as a learning designer

§ 5. The special function learning design New middle school with a learning designer or a learning designer is set up for the new middle schools as well as for the lower level of a general education higher according to the model of the New Middle School School. The appointment of an instructor subject to the remuneration scheme pd to the learning designer or to the learning designer is not provided for in the area of the New Middle Schools, if from those for the relevant school according to § 59b para. 1a GehG and/or § 41 para. 2 VBG to order three coordinators, more than two coordinators or coordinators are to be appointed or appointed.

§ 6. The number of pupils according to § § 2 to 4 is measured on the basis of the number of pupils for the school or school concerned. for the school grades at the beginning of the school year, the total number of pupils.
