448 Ordinance of the Federal Government, with the number of the quota obligatory residence permits and the quota of employment permits for temporary employed foreigners and harvest for the year 2013 be set (branch regulation 2013 - 2013 NLV)

On the basis of article 13 of the settlement and residence Act (NAG), Federal Law Gazette I no. 100/2005, as last amended by Federal Law Gazette I no. 87/2012, is prescribed in consultation with the Policy Committee of the National Council:

Total number of the quota obligatory residence permits

§ 1. In the year 2013 may not exceed 5133 quota requiring residence permit according to § 13 ABS. 2 NAG be granted.

Temporarily employed foreigners and harvest

2. (1) may in 2013, on the basis of regulations of the Federal Minister for labour, Social Affairs and consumer protection pursuant to § 5 para 2 subpara 1 of the aliens Employment Act (aliens), Federal Law Gazette No 218/1975, as last amended by the Federal Act Federal Law Gazette I employed foreigners granted no. 98/2012, up to 7 000 employment permits for temporary are facing a related entry and right of residence pursuant to section 24 of the Aliens Police Act 2005 (FPG) , Federal Law Gazette I no. 100, last amended by Federal Law Gazette I no. 87/2012, must be given (§ 13 para 4 No. 1 NAG).

(2) in the year 2013 Z may be granted on the basis of regulations of the Federal Minister for labour, Social Affairs and consumer protection pursuant to § 5 para 2 2 aliens up to 2 500 employment permits for harvest, with a related entry and right of residence pursuant to section 24 may be given to FPG (§ 13 para 4 No. 2 NAG).

Permit subject to quota

§ 3 (1) in the year 2013 a maximum 74 permit subject to quota may be granted in the Burgenland, thereof 1 40 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 20 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 9 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 3 branch permits to exercise a paid activity (§ 49 para 2 NAG);

b) 3 branch permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 3 branch grants without exercise of gainful employment (NAG) article 49, paragraph 1;

4. strive for 5 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(2) in the year 2013 a maximum 131 permit subject to quota may be granted in Carinthia, thereof 1 80 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 35 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 11 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 5 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 3 branch permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 3 branch grants without exercise of gainful employment (NAG) article 49, paragraph 1;

4. strive for 5 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(3) in 2013 may be given in lower Austria more than 346 permit subject to quota thereof 1 300 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 25 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 11 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 5 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 3 branch permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 3 branch grants without exercise of gainful employment (NAG) article 49, paragraph 1;

4. strive for 10 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(4) in 2013 may be granted in Upper Austria more than 707 residence title subject to quota thereof 1 630 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 20 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 17 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 7 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 5 establishment permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 5 establishment permits without the exercise of gainful employment (NAG) article 49, paragraph 1;

4. aim for 40 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(5) in 2013 may be given in Salzburg more than 351 quota requiring residence thereof 1 300 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 25 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 11 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 5 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 3 branch permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 3 branch grants without exercise of gainful employment (NAG) article 49, paragraph 1;

4. strive for 15 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(6) in 2013 may be granted in Styria, Austria more than 542 quota requiring residence permits, thereof 1 460 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 40 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 12 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 4 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 4 establishment permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 4 establishment permits without the exercise of gainful employment (NAG) article 49, paragraph 1;

4. seek 30 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(7) in the year 2013 more than 316 quota requiring residence permits may be granted in Tyrol, thereof 1.

260 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 30 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 11 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 5 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 3 branch permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 3 branch grants without exercise of gainful employment (NAG) article 49, paragraph 1;

4. strive for 15 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(8) in 2013 may be granted in Vorarlberg more than 186 permit subject to quota, thereof 1 150 residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and para 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 20 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 11 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 5 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 3 branch permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 3 branch grants without exercise of gainful employment (NAG) article 49, paragraph 1;

4. strive for 5 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

(9) in the year 2013 may in Vienna maximum 2480 quota requiring residence permits be granted, thereof 1 2350, residence permits for family members of third-country nationals for the purpose of family reunification in the cases of § 46 para 1 subpara 2 and paragraph 4 NAG (§ 13 ABS. 2 NAG Nos. 1 and 2);

2. 60 establishment permits for third-country nationals and their family members who may settle permanently in Austria without acquisition purpose (§ 13 ABS. 2 NAG No. 4);

3. 30 establishment permits for third-country nationals who are in possession of a residence permit "Long-term resident – EC" of another Member State of the European Union and want to come to Austria (§ 13 para 2 Z 5 NAG), thereof a) 20 establishment permits to exercise a paid activity (§ 49 para 2 NAG);

b) 5 establishment permits to engage in a self-employed activity (§ 49 para 4 NAG) and c) 5 establishment permits without the exercise of gainful employment (NAG) article 49, paragraph 1;

4. aim for 40 establishment permits for third-country nationals who are in possession of a "settlement permit - dependant" and a change of purpose on a "residence permit" (§ 13 ABS. 2 NAG No. 3).

In force

§ 4. This Regulation shall enter into force 1 January 2013.
