471. Regulation of the Federal Minister of Transport, Innovation and Technology, which amalgles the Act on the Law of Power-Implementing Regulation 1967 (59). Novelle to the KDV 1967)

Due to the Kraftfahrgesetz 1967, BGBl. No. 267, as last amended by the Federal Law, BGBl. I No 50/2012, shall be arranged:

The law on force driving-Implementing Regulation 1967, BGBl. No 399, as last amended by the BGBl Regulation. II No 278/2012, shall be amended as follows:

1. In § 4 (6) the 10. Record:

"Redesigned tyres shall not be used on steerable wheels on the main steering axle of motor vehicles."

2. In § 11 (8) the 3. Record:

"The daytime running lights must be automatically switched off when the headlights or fog lights are switched on."

3. In § 22a (1) (2) (2) lit. q will be the expression " Directive 2005 /66/EC " replaced by the expression " Regulation (EC) No 78/2009 "

4. In Section 22a (1), the point at the end of Z 8 shall be replaced by a line-point and the following Z 9 shall be added:

" 9.		the fitting of retrofit wheels approved in accordance with EC Regulation No 124 and suitable for the vehicle, in the same dimension as indicated in the approval document, to vehicles of category M1, N1, O1 and O2. "

5. § 52 (10) Z 6 reads:

" 6.		Zapfwaves and their protective cover to the provisions of Directive 86 /297/EEC, OJ L 206, 22.7.1986, p. No. OJ L 186 of 8 July 1986, p. 19, as amended by Directive 2012 /24/EU, OJ L 186, 30.7.2012, p. No. OJ No L 274, 9. October 2012, S 24, "

6. Section 63a (4) and (5) reads as follows:

" (4) Only tractors or motor carts with a design speed of at least 30 km/h, and approved trailers whose total mass is at least 1, may be used to form candidates for category F steering eligibility. 000 kg and which have a braking system according to § 6 (10), first sentence, KFG 1967. The tractors do not have to be equipped with return headlights.

(5) In order to form candidates for steering authority for vehicles of categories BE, CE, C1E, DE and D1E, only such combinations of vehicles may be used which comply with the requirements of the Regulation on the testing of vehicles, BGBl. II No 321/1997, idF BGBl. II No 244/2012, for test vehicles for the respective steering role (§ 7 and § 17 (3) FSG-PV), in which case a vehicle may also be used as a towing vehicle for the classes CE and DE, which meets the requirements of the para. 2 or 2a. "

7. In accordance with Section 63a (5), the following paragraph 6 is added:

" (6) For training to obtain the right to class B, other than light trailers, the maximum authorised mass of the combination of vehicles being more than 3 500 kg but not more than 4 250 kg (code 96), is a Class B school vehicle with a trailer to be used. The maximum authorised mass of the vehicle combination must be more than 3 500 kg. The maximum authorised mass of the trailer must be at least 1 000 kg and the actual total mass of the trailer must be at least 800 kg. "

8. § 64b (4) reads:

" (4) The theoretical training consists of a basic instruction for all classes of steering authorities and a class-specific part for each class of aspiraptors. The teaching content of the basic teaching is to be divided into at least 20 units of instruction (UE) in the case of initial divisions according to Appendix 10a; in the case of expansion, the basic instruction can be omitted and only the respective class-specific part to complete. The teaching content of the class-specific parts shall be divided, in accordance with Appendix 10a, at least to the following teaching units (UE):

1.		Class A 1 as well as classes A2 and A, each with direct entry 8 UE,
2.		Class B 12 UE,
3.		Class BE 3 UE,
4.		Class C1 8 UE,
5.		Class C 10 UE,
6.		Class C (extension of C1) 4 UE,
7.		Class CE/C1E, DE, D1E 6 UE,
8.		Class D1 (extension of B) 8 UE,
9.		Class D1 (extension of C/C1) 4 UE,
10.		Class D (extension of B) 12 UE,
11.		Class D (extension of C) 4 UE,
12.		Class D (extension of D1) 4 UE,
13.		Class F 4 UE. "

9. § 64b (5) Z 1 reads:

" 1.		in the case of category A1 and categories A2 and A, in the case of direct entry on a motorbike in accordance with the curriculum contained in Appendix 10b, not all units of instruction must be completed on a motorbike of the respective class, "

10. § 64b (6) and (7) reads:

" (6) The minimum duration of practical training shall be for:

1.		Class A1 and categories A2 and A, each with direct entry on a motorcycle 12 teaching units (UE), with at least 8 UE of which must be carried out on public transport roads,
2.		Class B
a.			Pre-training 3 UE,
b.			Basic Training 3 UE,
c.			Main training depending on the skills and progress of the driver,
d.			Perfection Training 5 UE, including special trips to the extent of 3 UE (the special trips each include 1 UE night trip, 1 UE motorway exit and 1 UE Overland journey),
e.			Preparation for examination 1 UE,
3.		Classes B and BE in addition to the class B 4 UE BE
4.		Classes B and C/C1 20 UE, of which 8 B, 12 C/C1
5.		Classes B and C/C1 and CE/C1E 22 UE, of which 8 B, 10 C, 4 CE/C1E
6.		Classes B and D/D1 20 UE, of which 8 B, 12 D/D1
7.		Classes B and C/C1 and D/D1 26 UE, of which 8 B, 10 C/C1, 8 D/D1
8.		Classes B and C/C1 and CE/C1E and D/D1 28 UE, of which 8 B, 8 C/C1, 8 D/D1, 4 C1E/CE
9.		Class F 4 UE.
The practical training for categories C, C1, D or D1 may only commenced after the completion of the pre-training (3 UE) and the basic training (3 UE) for the class B. In any case, a special trip is also to be carried out. After completion of the practical training for classes C, C1, D or D1, the final training for class B of 2 teaching units, each of which has to include 1 UE night journey and 1 UE motorway exit, shall be completed. Instead of the main training for class B in the driving school, practice trips according to § 122 KFG 1967 can also be completed.

(7) In the case of the extension of the steering authority of categories B, C/C1 or D/D1 to certain other classes, the minimum duration of practical training shall be:

11. In accordance with Section 64b (7a), the following paragraph 7b is inserted:

" (7b) Training to obtain entitlement to Class B other than light trailers, with the maximum authorised mass of the combination of vehicles being more than 3 500 kg but not more than 4 250 kg (code 96), comprising three Teaching units theoretical training and four teaching units practical training. It is the content to be conveyed as for the class BE. This training may only be performed by teachers of the class BE or driving school teachers for category B, who have registered the code 96 in the driving licence, and a seminar seminar on the level of eight units of instruction for this entitlement shall be carried out. These conditions also apply to instructors who carry out the practical training in order to obtain this authorization. "

12. § 64e (3) and (4) reads:

" (3) The teaching plan seminar for the class BE comprises eight teaching units. On the basis of the practical training plan, driving exercises and overland journeys are to be carried out.

(4) curriculum seminars for classes C, C1, D, D1, CE, C1E, DE and D1E shall each have three days (24 teaching units). On the basis of the practical training plan, driving exercises and overland journeys are to be carried out. A training seminar for class C is also valid for class C1. A training seminar for class D is also valid for class D1. A training seminar for the class CE or DE also applies to the class C1E or D1E. "

13. In accordance with § 69 (30), the following paragraph 31 is added:

" (31) In view of the changes made by the BGBl Regulation. II No 471/2012 shall be subject to the following transitional arrangements:

1.		Section 11 (8) of the BGBl version. II No 471/2012 shall not apply to vehicles which have already been approved before they enter into force, but which must comply with the previous rules;
2		Section 52 (10) Z 6 in the version BGBl. II No 471/2012 does not apply to vehicles which have already been approved before 1 November 2013, but they must comply with the previous rules;
3.		before the 19. Jänner 2013 already used as school vehicles for category F vehicles, which do not have the provisions of § 63a (4) in the version BGBl. II No 471/2012, may be used as school vehicles for category F until 31 December 2017 at the latest;
4.		for applications for the granting of the steering authority of the class BE, which shall be submitted before the 19. In January 2013, § 64b (6) and (7) apply, with the proviso that the previous training regulations must be applied until 31 May 2013;
5.		Annex 5d Chapter VI in the version BGBl. II No 471/2012 shall not apply to the number of marks already assigned;
a)			Until 30 June 2013, registration plates must still be assigned with the existing authority designations "BM" "FB", "FF", "HB", "MZ" or "RA"; as of 1 July 2013, the registration owner of a vehicle, for which a license plate with the authority designations "FB", has yet to be assigned. "FF", "HB", "MZ" or "RA" shall be assigned the possibility of assigning an identifier in accordance with Appendix 5d in the version BGBl. II No 471/2012;
b)			already assigned marks with the authority designations "FB", "FF", "HB", "MZ" or "RA" remain valid during an upright registration of the vehicle; in the case of an application or the assignment of a different character during upright However, the names of the authorities in accordance with Annex 5d in the version of BGBl are admitted. II No 471/2012; exemption from registration plates with the authority designations "FB", "FF", "HB", "MZ" or "RA" are only possible until 30 June 2013 and valid until this date;
c)			You may also wish to continue until the right to take the place of the right to take part in the registration or assignment of a registration mark during the right of admission, even if the registration or attribution of a registration mark has been granted on the basis of the official names "FB", "FF", "HB", "MZ" or "RA". If they are to be reserved by 30 June 2013, an extension of the right to guide this wish is only possible, provided that the time period for the application of the respective renewal request pursuant to § 48a (8a KFG 1967 still to be run until 30 June 2013, but this period ends in this In any case, by 30 June 2013;
6. 14. In Section 70 (14) (3) (3), the phrase is deleted "and Appendix 4 Table for the types of construction, in each case" .

18. 19.
