485 regulation of the Federal Minister for labour, Social Affairs and consumer protection for the temporary employment of foreigners in the agriculture and forestry

Due to section 5, paragraph 2 No. 1 of the aliens Employment Act - aliens, BGBl. No. 218/1975, as last amended by Federal Law Gazette I no. 98/2012, is prescribed:

§ 1. For the sector of agriculture and forestry, a quota is set at a height of 4 275 for the temporary employment of foreign workers and on the provinces, divided as follows:

              Burgenland:...               100

              Carinthia:...               265

              Lower Austria:...               780

              Upper Austria:...               1-230

              Salzburg:...               65

              Styria:...               870

              Tirol: …………………………………………….….               430

              Vorarlberg:...               75

              Wien: ………………………………………….……               460

Section 2 (1) within the framework of these quotas employment permits may be granted during the whole temporal scope of this regulation up to six months with a period of validity. For foreigners, each limited dealing with agriculture and forestry in the previous three years within a quota for the temporary employment of foreign workers in the sector were and are subject to the transitional provisions for the EU – free movement of workers (Article 32a aliens), employment permits up to nine months may be given with a period of validity. The duration of the employment permits do not end after December 31, 2013.

(2) foreigners, who are subject to the transitional provisions for the EU – free movement of workers, and asylum seekers are preferable in the granting of employment permits.

§ 3. With 3 January 2013, this Regulation shall into force and with 30 November 2013 override.
