19. Federal Act, amending the 1967 Family Law Balancing Act

The National Council has decided:

The Family Law Balancing Act 1967, BGBl. No. 376, as last amended by the Federal Law BGBl. I No 17/2012, shall be amended as follows:

1. § 30a, para. 1 lit. c is:

,, c)

An education in the upper-level service for health and nursing care at a school for health and nursing care according to health and nursing care law, BGBl. I n ° 108/1997, or an education in medical professional assistance at a school for medical assistance occupations according to the Medical Assistance Law, BGBl. I n ° 89/2012, or "

1a. The following paragraphs 3 and 4 are added to § 30d:

" (3) For journeys on scheduled services, which are possible with a compound student ticket at a certain flat rate per school year, a school travel allowance according to § 30c is at the most up to that for the flat-rate private share of 19.60 euros the reduced amount, which is to be paid for this student's pass. If the entitlement to such a school travel allowance does not cover the entire school year, the school travel allowance per month of claim of 1/12 of the flat-rate price reduced by EUR 19.60 is available for this pupil's ticket. If an already paid payment of the flat-rate part of the pupil is shown for the respective school year in the course of the application, no further deduction of the school travel allowance to be paid shall be effected.

(4) The possible use of a carriage on scheduled services at a flat rate shall exclude the right to a school travel allowance in accordance with § 30c on this route. The school travel allowance determined in accordance with section 3 above shall be increased by the amount of the monthly flat-rate payment in accordance with section 30c (1) to (3) for any residual school journey of more than 2 km per direction. For family home trips over 2 km of remaining routes, the school travel allowance determined in accordance with paragraph 3 is increased by 5 euros per month, up to a distance of 10 km. If the remaining distance exceeds 10 km, the payout amount according to paragraph 3 shall be increased by the per-monthly flat-rate payment in accordance with section 30c (4). "

2. The following paragraph 6 is added to § 30f:

" (6) The Federal Minister for Economic Affairs, Family and Youth is authorized to conclude contracts with Verkehrsverbund organizing companies, according to which the Federal Government for the promotion of driving pupils according to § 30f (1) and (2) in conjunction with § 30a in public transport to the respective transport association organisation company for each school year a flat-rate cut minus the own shares which are paid for it. The flat-rate reduction, reduced by its own shares, is to be determined by agreement between the Federal Minister for Economic Affairs, the Family and Youth and the respective transport association organization. The basis for the flat-rate payment is calculated, for the first time, according to the number of students who are entitled to travel and the fare rates paid in one between the Federal Minister for Economic Affairs, Family and Youth and the respective Transport cooperative society by common agreement to be determined. 3. The previous text of Section 30f (6) shall be replaced by the sales designation "(7)" and shall be amended to ensure that the word order "The Federal Minister for Social Security, Generations and Consumer Protection" through the phrase "The Federal Minister for Economic Affairs, Family and Youth" shall be replaced.

4. § 30j (3) reads:

" (3) The Federal Minister for Economic Affairs, Family and Youth is authorized to conclude contracts with Verkehrsverbund organizing companies, according to which the Federation for the Carriage of Travelling Apprentices pursuant to Section 30j (1) and (2) in the Public Transport to the respective transport association organization for each school year a flat-rate cut minus the shares which are paid on it. 5. § 30k (4) deleted.

6. The following paragraphs 4 and 5 are added to § 30o:

" (4) For journeys on scheduled services, which are possible with a collective apprenticeship ticket at a certain flat rate per calendar year, a travel allowance in accordance with § 30n for a maximum of 11 months per calendar year and up to a maximum of 11 months shall be available. the sum of EUR 19.60 reduced by the flat-rate part of the property, which is necessarily to be paid for the course of this apprenticeship. If the entitlement to such a travel allowance does not extend over the entire calendar year, the travel allowance per month of claim of 1/12 of the flat-rate price reduced by EUR 19.60 is available for this course of the apprenticeship. If an already paid payment of the flat-rate part of the apprentice for the relevant calendar year is proved in the course of the application, no further deduction of the travel allowance to be paid shall be effected.

(5) The possible use of a carriage on scheduled services at a flat rate shall exclude the right to a travel allowance in accordance with § 30n on this route. For a possible remaining distance between the apartment and the company training centre of more than 2 km per direction, the travel allowance determined in accordance with paragraph 4 shall be increased by the per-monthly flat-rate payment in accordance with § 30n para. 1. For family home trips over 2 km of remaining routes, the travel allowance determined in accordance with paragraph 4 is increased by 5 euros per month, up to a distance of 10 km. If the remaining distance exceeds 10 km, the payout amount according to paragraph 4 shall be increased by the per-monthly flat-rate payment in accordance with § 30n para. 2. "

Section 31d (3) second sentence reads:

" The guidelines of the school forum or of the School Community Committee shall be records within the meaning of Section 31c (3) of the FLAG. "

8. § 51 para. 2 Z 3 reads:

" 3.

with regard to § § 31a (4) and 31c (3) of the Federal Minister for Economic Affairs, Family and Youth in agreement with the Federal Minister for Education, Arts and Culture, "

(9) The following paragraph 20 is added to § 55:

" (20) For the entry into force of the Federal Act BGBl. I n ° 19/2013, newly taken, amended or inserted as well as for the expiry of the provisions of the Federal Act of the Federal Republic of Germany shall apply:

a)

§ § 30d (3) and (4), 30f (6) and (7), 30j (3), 30o (4) and (5), 31d (3), second sentence, and 51 (2) (2) (3) shall enter into force as of 1 September 2012.

b)

Section 30k (4) shall not enter into force as of 31 August 2012. "

(10) The following paragraphs 21 and 22 are added to § 55:

" (21) § 30a Para. 1 lit. c occurs with 1. Jänner 2013 in force.
