56. Regulation of the Minister of Justice, with the Ordinance of the Federal Minister for Justice about the payment and collection of court fees (authorization - and recovery regulation - am.) is changed

On the basis of § 4 para 6 of the court fees Act, Federal Law Gazette No. 601/1984, as last amended by the basic book fees amendment, Federal Law Gazette I no. 1/2013 is prescribed:

Ordinance of the Federal Minister for Justice about the payment and collection of court fees (authorization - and recovery regulation - am.), Federal Law Gazette No. 599/1989, no. 162/2000, is as follows in the version of regulation BGBl. II changed:

1 in the clause of the promulgation of the reference "section 4 para 5" on "§ 4 paragraph 6" and the phrase is "Gazette I no. 26/2000" on "Federal Law Gazette I no. 1/2013" changed.

2. paragraph 1 together with the heading:

"Justice accounts

§ 1. Determines as justice accounts on which you will be credited by debit and collect paid court and justice administration fees in favour of the Federal Government, following accounts at BAWAG P.S.K. Bank für Arbeit and Wirtschaft und Österreichische Postsparkasse Aktiengesellschaft:



1. for the Division of the Federal Ministry of justice the account named "Ministry of Justice" with the BIC: OPSKATWW and IBAN code: AT 686000000005490000 2.
OPSKATWW for the Division of the Oberlandesgericht Wien the account named "Court of appeal Bureau Vienna" with BIC: And the IBAN code: AT 696000000005460009 3.
OPSKATWW for the Division of the Oberlandesgericht Linz the account named "Oberlandesgericht Linz Bureau" with the BIC: And the IBAN code: AT 166000000005450002 4.
OPSKATWW for the Division of the Oberlandesgericht Graz the account named "Court of appeal Bureau Graz" with BIC: And the IBAN code: AT 046000000005470006 5.
OPSKATWW for the Division of the Oberlandesgericht Innsbruck the account named "Oberlandesgericht Innsbruck Bureau" with the BIC: And the IBAN code: AT 366000000005480003 "3. Paragraphs 2 to 4 are eliminated.

4. in article 5, first sentence, is after the phrase "the account from which the court fees to collect are," the phrase "as well as the bank credit institution" and inserted the following sentence after the first sentence:

"The account is to call by specifying the BIC (business identifier code) by specifying the IBAN (international bank account number) and the bank credit institution."

5. in article 6, paragraph 2, the following sentence is inserted after the first sentence:

"Thus the authorization for the collection of fees within the meaning of § 34 considered ZaDiG given."

6 section 7 is eliminated.

7. in paragraphs 11 to 13, respectively, the phrase "Austrian postal savings bank" and "Austrian postal savings bank" be replaced by the phrase "BAWAG P.S.K. Bank for Arbeit und Wirtschaft und Österreichische Postsparkasse Aktiengesellschaft".

8. in article 12, Nos. 2 and 3 are:



"2. the name, the account and the account Bank of fees Hopper, 3. a judicial account (section 1) as well as" 9. In article 13, paragraph 1 the phrase "Accounting of the Oberlandesgericht Wien" are substituted by the phrase "Accounting agency of the Federal Government" and the phrase "the justice account (section 1)" with the phrase "a judicial account (section 1)".

10 the following paragraph 4 is added to § the 15:

"(4) paragraphs 1 and heading, 5, 6, 11 and 13 as amended the regulation BGBl. II Nr"  "56/2013 and the repeal of paragraphs 2 to 4 and 7 apply with February 1, 2013."
