56. Ordinance of the Federal Minister of Justice, with which the regulation of the Federal Minister of Justice on the debiting and confiscation of court fees (accounting and confiscation ordinance-AEV) is amended

On the basis of § 4 (6) of the Court Fees Act, BGBl. N ° 601/1984, as last amended by the basic bulkhead fee novella, BGBl. I No 1/2013 shall be assigned:

The ordinance of the Federal Minister of Justice on the debiting and confiscation of the court fees (Abbuchungs-und Einziehungsverordnung-AEV), BGBl. No 599/1989, as amended by the BGBl Regulation. II No 162/2000, shall be amended as follows:

1. In the promulgation clause, the reference "§ 4 (5)" on "§ 4 (6)" and the turn " BGBl. I No 26/2000 ' on " BGBl. I No 1/2013 " changed.

2. § 1 together with the headline is:

" Judicial Accounts

§ 1. The following accounts shall be considered as judicial accounts credited to the Federal Government for the benefit of the Federal Republic of Germany by means of the court and judicial administration fees paid by debit and confiscation, at BAWAG P.S.K. Bank for Labour and Economy and Austrian Postsparkasse Aktiengesellschaft determines:

1.		For the division of the Federal Ministry of Justice the account with the designation "Federal Ministry of Justice" with the BIC: OPSKATWW and the IBAN code: AT 686000000005490000
2.		For the division of the Higher Regional Court Vienna the account with the designation "Oberlandesjudijurisdiction Wien" with BIC: OPSKATWW and the IBAN-Code: AT 696000000005460009
3.		For the division of the Upper Regional Court Linz the account with the designation "Oberlandesjudijurisdiction Linz" with the BIC: OPSKATWW and the IBAN code: AT 166000000005450002
4.		For the division of the Oberlandesgericht Graz the account with the designation "Oberlandesjudijurisdiction Graz" with the BIC: OPSKATWW and the IBAN code: AT 046000000005470006
5.		For the business unit of the Oberlandesgericht Innsbruck the account with the designation "Oberlandesjudijurisdiction Innsbruck" with the BIC: OPSKATWW and the IBAN-Code: AT 366000000005480003 "

3. § § 2 to 4 are deleted.

4. In § 5, first sentence, after the turn "the account from which the court fees are to be drawn in," the phrase "as well as the account of the credit institution" and inserted after the first sentence of the following sentence:

"The account shall be indicated by indicating the IBAN (International Bank Account Number) and the account-leading credit institution by specifying the BIC (Business Identifier Code)."

5. In Article 6 (2), the following sentence shall be inserted after the first sentence:

"As a result, the authorization shall be deemed to have been granted in accordance with § 34 ZaDiG."

6. § 7 deleted.

7. In § § 11 to 13 the word sequence shall be "Austrian Postal Savings Bank" and "Austrian Postal Savings Bank" through the phrase "BAWAG P.S.K. Bank für Arbeit und Wirtschaft und Österreichische Postsparkasse Aktiengesellschaft" replaced.

8. In § 12 are Z 2 and 3:

" 2.		the name, the account and the credit institution of the fee-holder who is the account of the account,
3.		a judicial account (§ 1) as well as "

9. In Section 13 (1), the word order shall be "Bookkeeping of the Oberlandesgericht Wien" through the phrase "Accounting Agency of the Federal Republic" and the turn "of the judicial account (§ 1)" through the turn "a judicial account (§ 1)" replaced.

10. The following paragraph 4 is added to § 15:

" (4) § § 1 including heading, 5, 6, 11 to 13 in the version of the BGBl Regulation. II No. 56/2013 and the repeal of § § 2 to 4 and 7 shall enter into force on 1 February 2013. "
