60. Federal Act, which changes the 1967 Family Law Balancing Act

The National Council has decided:

The Family Law Balancing Act 1967, BGBl. No. 376, as last amended by the Federal Law BGBl. I n ° 19/2013, is amended as follows:

1. § 8 (3) reads:

" (3) From 1 September 2013, the family allowance shall be increased monthly for each child if:

a)

is granted for two children, € 6,4 for each child,

b)

is granted for three children, for € 15,94 for each child,

c)

is granted for four children, at € 24.45 for each child,

d)

is granted for five children, at € 29.56 for each child,

e)

is granted for six children, € 32.97 for each child,

f)

is granted for seven children, € 35.4 for each child,

g)

is granted for eight children, at € 37,23 for each child,

h)

is granted for nine children, at € 38.65 for each child,

i)

is granted for ten children, to € 39.78 for each child,

j)

is granted for eleven children, € 40.71 for each child,

k)

is granted for twelve children, € 41,49 for each child,

l)

is granted for thirteen children, to € 42.14 for each child,

m)

is granted for fourteen children, to € 42.7 for each child,

n)

for fifteen children, for € 43,19 for each child and

o)

is granted for sixteen and more children, by 50 € for each child. "

2. According to § 13, the following § 14 is inserted:

" § 14. (1) A full-year child who is entitled to the family allowance may apply to the competent tax office for the transfer of the family allowance to be made to his current account. The application may relate only to periods for which a family allowance has not yet been paid.

(2) A transfer as referred to in paragraph 1 shall be subject to the consent of the person entitled to the family allowance. This consent may be revoked at any time, but only for periods for which family allowances have not yet been paid.

(3) It is also possible for the person who is entitled to the family allowance for a child to apply for the transfer of the family allowance to a checking account of that child. The application may relate only to periods for which a family allowance has not yet been paid. This application may be revoked at any time, but only for periods for which family allowances have not yet been paid.

(4) The amount of family allowance for a child who is transferred to the transfer pursuant to para. 1 or 3 shall be determined in accordance with Article 8 (2) to (4). "

3. In § 30h (2) the word order shall be "the appeal to the independent financial Senate" through the phrase "the complaint to the Administrative Court of the Federal Government for Finance" replaced.

4. In § 31d paragraph 4, the phrase "the appeal to the independent financial Senate" through the phrase "the complaint to the Administrative Court of the Federal Government for Finance" replaced.

5. In § 31e, the word "vocation" by the word "Complaint" and the phrase "the independent financial Senate" through the phrase "the Administrative Court of the Federal Government for Finance" replaced.

6. The previous text of § 39g receives the sales designation "(1)" ; the following paragraph 2 is added:

"(2) From the funds of the compensation fund for family allowances, the Federal Ministry of Finance (Federal Ministry of Finance) is to pay a lump sum of € 300 000 for the technical implementation of the direct payment in accordance with § 14 until 1 September 2013."

7. The previous text of § 42a receives the sales designation "(1)" ; the following paragraph 2 is added:

"(2) The Administrative Court of the Federal Republic of the Federal Republic of the Federal Republic of Germany shall decide on complaints against complaints pursuant to paragraph 1 above."

The following paragraph 23 shall be added to § 55:

" (23) § § 8 (3) and (14) in the version of the Federal Law BGBl. I n ° 60/2013 will enter into force on 1 September 2013. Section 39g (2), as amended by the aforementioned Federal Law, shall enter into force with the day following the customer's presentation. § § 30h (2), 31d para. 4, 31e and 42a para. 2 in the version of the above-mentioned Federal Act are 1. Jänner 2014 in force. "
