105. Regulation of the Federal Minister for Transport, Innovation and Technology, which contains statistical surveys in the field of postal services (Post-survey Regulation-PEV) and the communication survey regulation-KEV is amended.

Article I

Post-Erbehungs-Regulation

On the basis of § 52 (2) of the Federal Act, which enacted a Postal Market Act (Postmarktgesetz-PMG), BGBl. I n ° 123/2009, as last amended by the Federal Law, BGBl. I No 111/2010, shall be ordered:

Subject of Postal Statistics

§ 1. (1) Statistical surveys are to be carried out for the observation and monitoring of market and competition developments in the field of postal services, statistics are to be compiled and published in accordance with Section 7 (2) of the German Publications Law. It is not possible to draw conclusions from the publication on data of individual companies. This shall not apply if the postal service provider expressly agrees.

(2) The following statistics shall be compiled:

1.

Quarterly figures on shipment quantities and corresponding sales,

2.

Quarterly figures on the number of post offices and/or comparable facilities,

3.

Quarterly values on the number of letterboxes and/or comparable facilities,

4.

Quarterly data on the number of land delivery boxes or comparable facilities and the households supplied with them,

5.

Quarterly values on the number of distribution centers or comparable facilities,

6.

Quarterly figures on economic indicators for employees (full-time and part-time), as well as leasing personnel and free employees, and

7.

Annual values on investments in the postal sector.

Statistical units

§ 2. Statistical units within the meaning of this Regulation are all postal service providers iSd § 25 and 26 PMG.

Survey characteristics

§ 3. The survey characteristics specified in the annexes are to be collected during the period of observation given there and taking account of the comments made there.

Implementation of the surveys

§ 4. (1) surveys within the framework of the postal statistics are carried out by quarterly survey of the units in accordance with § 2. It is a full survey to be carried out.

(2) The compilation of the statistics and other statistical work shall be carried out by the broadcasting company and the Telekom Regulatory GmbH.

Obligation to provide information

§ 5. (1) The owner or responsible head of a unit according to § 2 shall be required to provide information.

(2) The information in accordance with § 3 shall be transmitted by the information providers of the broadcasting company and Telekom Regulierungs-GmbH in the form of structured, electronic form (e-mail or data carrier) which is predetermined, structured and structured.

(3) The information in accordance with § 3 shall be submitted no later than twelve weeks after the end of a calendar quarter for the last quarter of a calendar year.

Collection documents

§ 6. Broadcasting and Telekom Regulierungs-GmbH has to provide the survey documents in electronic form and to provide for the possibility of free access to the information providers.

Evaluation and Publications

§ 7. (1) The statistics compiled in the context of postal statistics may only be used for the following tasks, without prejudice to legal obligations:

1.

Ongoing monitoring and monitoring,

2.

for the fulfilment of national and international reporting and disclosure requirements,

3.

publications and previews (information of the sector),

4.

Information of the legislative bodies and the administration.

(2) The following publications are to be produced by broadcasting and Telekom Regulierungs-GmbH quarterly and shall be published on the Internet no later than one quarter after the conclusion of the survey, in accordance with the provisions of section 1 (1), second sentence, and second sentence:

Statistics on

1.

Quarterly statistics on the quantities of shipment and corresponding sales,

2.

Quarterly statistics on the number of post offices and/or comparable facilities,

3.

Quarterly statistics on the number of letterboxes and/or comparable facilities,

4.

Quarterly statistics on the number of land delivery cases and/or comparable facilities and the households supplied with them,

5.

Quarterly statistics on the number of distribution centres and comparable facilities,

6.

Quarterly statistics on the number of employees (full-time and part-time), as well as leasing staff and freelance staff, and

7.

Annual statistics on investments in the postal sector.

entry into force

§ 8. This Regulation shall enter into force on 1 July 2013.

Amendment of the communication survey regulation

Due to § 90 (2) of the Telecommunications Act 2003, BGBl. I n ° 70/2003, as last amended by the Federal Law BGBl. I No 102/2011, shall be arranged:

The communication survey regulation, BGBl. II No 365/2004, as last amended by the BGBl Regulation. II No 104/2012, shall be amended as follows:

In § 2 (1) the Z 1 and 2 are:
